    You know you make an excellent point and please note that I'm in no way referring to or offending the OP, but I have seen the nerves of some people who live abroad never file taxes and then come over to the US to get things like financial aid for school, medicaid and the works.
    I think the government should start requiring proof of taxes paid in order to claim any benefit in this country. If you don't contribute, you shouldn't leech. Not to mention that I have seen several posts here about people who don't pay taxes because they work off the books.

    "If you are a U.S. citizen or resident alien, the rules for filing income, estate, and gift tax returns and paying estimated tax are generally the same whether you are in the United States or abroad. Your worldwide income is subject to U.S. income tax, regardless of where you reside."
    That website also says you must file in USD and gives info on how to convert.
    USCs everywhere in the world have to file and pay taxes. Our tax dollars fund social programs that the USC can take advantage of whenever they return. Its only fair to pay into a program that you can then use once you're back in the US.

    Well that's for sure. One less money pit anyhow, and with the kids, it would be advisable to miss it if possible.
    You do not need a G-325a for the children. You need different documents for their petitions than you do the father's. They each need: copy of the marriage certificate, copy of any divorce decrees, and a copy of the child's birth certificate.

    You didn't have to send the original since they only ask for a copy. The original is only necessary at the interview, but since you already sent it in they should have it there already.
    Well theft is one of those things that affect the moral character part of the application, but since it was 7 years ago it may not have much weight especially since you didn't go to jail. Again this is just my opinion, I'm not sure how the IO makes this determination and I don't want to tell you if it will affect you if I'm not sure myself.
    Hopefully, someone who knows for sure can chime in, but this is the best I can tell you.

    1) No fee. Just send a copy of your I-485 NOA with the I-765 renewal application to show your AoS is still pending.
    2) Correct.
    3) (i) A completed I-765; (ii) a copy of the front and back of your current expiring EAD; (iii) the aforementioned copy of your I-485 NOA receipt; (iv) two passport photographs.

    There is a double standard with embassies. Younger females and older guys no problem. Younger men and older women is more often
    a problem and being viewed with suspicion. High fraud embassies will scrutinize age differences more than low fraud embassies.

    Anyone offended is frankly not worth your time. I really wish I had good advice but perhaps including an affidavit from each of you in your fiancé package that you fear for his life if his family finds out about your relationship due to their views on homosexuality would be helpful? I don't know. I hope someone who has lived through this will have more information for you. I also wonder if perhaps it might not be grounds for expedition that your fiancé may have reason to fear for his life.

    Congratulations on your engagement and I hope that this will go quickly and easily for you.

    I'm not sure how reliable the following website is, but I did a small google search and there seem to be a lot of differing opinions on whether this income is considered self employment and subject to SE tax or unearned passive income.
    Some claim that it depends on whether this is your only source of income, or whether you run a business. Most people seem to agree that it is self employment and subject to the SE tax. Therefore, if it is considered employment for the IRS, it most likely is also for USCIS, but you would have to know the USCIS regulations to know for sure.
    We can't just assume that it's the same just because. The reason I say so, here's an example: As I mentioned before the IRS and USCIS are two separate government entities with their own rules and definitions. For the IRS you can be considered unmarried for tax purposes when claiming head of household status even though you are considered married for immigration purposes.
    I'm not getting into details about how that works, but I just wanted to point out that just because the IRS sees this as employment, doesn't mean that USCIS will.
    So for OP: Your best bet is to find out with an immigration attorney who specializes in E2 visas. It's much better to do that and know for sure than to lose a good source of income on speculation alone. That is the problem with gray areas of the law that some people see it as black and white and others not so much, that's why they are gray.

    I'm not sure about mail, you would have to contact them directly to find out. You're in Pennsylvania, I think you're closest consulate may be in NY. According to the link I will post below, he needs an acta de nacimiento legalizada and his cedula.
    He definitely doesn't have to go to DR to get a birth certificate, he can get one from the consulate and they should be able to legalize it. I know the consulate here in NYC has the JCE and you can get birth, marriage, divorce records. Last time I heard though they were closed so you would want to contact them to see if they are still open.
    In the event that he is unable to get it from the consulate, he still doesn't have to go to DR. Records in the DR are public and basically anyone can request them. When I needed my birth certificate for my citizenship, I gave my aunt the libro, folio, and acta no and the oficialia where I was registered and she sent my cousin to get it for me and had it shipped. I sent her the money via La Nacional so that she could get the certificate and ship it back.
    Again you want to find out with the consulate what they need and whether you are able to obtain these docs in the US or have to have someone in DR send them to you. Also I think the price is $135 for same day passport and I'm not sure if $60 for 3 day pickup. Good luck.

    Well you don't have a timeline or any info on your profile therefore I can't assume if you already had a medical done which is why I said medical and vaccines. I and another member had already posted answers to your question and I was simply informing you about the costs to expect if you had to get both. In the future, if you want answers there is no need to get nasty with those who are trying to help.

    Intent to marry is not applicable to a CR1/IR1 case, I'm sorry if you're misunderstanding that. For a K1 case, it can be decent evidence of intent to marry but when you're already married, it just shows you bought rings. Not everyone needs a ring. Everyone is different.
    Regarding the rest of your post: My intent is to give a 3rd person view, such as an adjudicating officer would give, vs someone who is trying to hold your hand and say everything is wonderful. Everyone can send whatever they wish, it is their case and their prerogative. But if you send the wrong information, you will get an RFE. If you send too much information that isn't of good quality, it can lead to a harder interview and/or an RFE because they're not convinced and think you just sent filler or fluff. So my goal is to help people, not just the OP, learn what is good, quality evidence that will help their cases, and not add fluff that doesn't. If I say it in a manner that seems to be harsh, it's because experience has taught me that saying things in a straight, forward, to the point manner is more effective. Of course you can't hear my voice or know inflection of speech over the internet. So while typed, it sounds perhaps cynical, or maybe just downright tactless, that's never my intention. I don't want to hurt feelings while getting my point across, but occasionally it happens. I apologize when it does and I'm informed of such.

    You are able to file now in August (make sure it's not a day more the 90 days lol).
    In order to be able to file now in August, by the date of filing, you have to have been married for 3 years with your USC spouse, they have to have been a USC for 3 years, and you have to have been living as spouses together for 3 years.
    So make sure those events have reached a 3 year mark before you submit the n400, with the exception of being an LPR for 3 years because you are allowed to apply 90 days before.
    Also traveling within the US (USVI is part of the US) doesn't count as time spent outside the US. Also trips of less than 6 months have no negative effect on the n400 anyway.
    As for the passport photos, I would rather use glossy, that's how I do them as well as professional photo places.

    Yes I agree with the above. Don't send it exactly 90 days before send it a few days later, just in case. You aren't required to send it right during the 90 day period anyway.

    My fiancé has locks and is Rastafarian. I would never ever ask him to cut them off. Very often he pulls them back in a ponytail. I think he looks just fine and just as presentable as anyone else. To judge by something as superficial as looks to deny a visa would be a great injustice. I would seriously hope that would not occur. It wouldn't go over well with me or my fiancé.

    I had the similar problem.
    I fixed it by engaging an immigration liason staffer at my congressman's office, they got the card reshipped to the proper address.
    as to SSN - that's cr@p - must be a typo somewhere in the SAVE database system - go back to SSA again, ask for lookup via A# and then VISA name, noting which has the typo.
    If typo is blatant, must go to CBP office and get it fixed, then go back to SSA office a week later.
    your legal presence is stored in SAVE database, searchable by A# and VISA Name... The greencard in hand does not matter.

    Hi,
    It is true that it is much harder to get a B2 visa when you have a pending relative petition. However, the case here was people who already had a visa or VWP prior to being petitioned.
    In either situation, it's strictly a case by case basis. If you can convince the CO that although you have a pending petition, you have very strong ties to your country, they won't deny it simply because of the pending petition.
    Their job is to look at the pending petition as a negative indicator, but that's why they consider other evidence to help counter that.

    The burden of proof here is on the applicant, not the CO.

    We were advised that docs will be sent back to US and USCIS will review the denial reason in 120 days. I made a decision not to wait and go ahead and fly to Azerbaijan to marry my fiancee and apply for a Spouse Visa. I got all documents ready, the only thing we were waiting for was marriage certificate. The problem I had was that In order for me to get married here, in Baku, i need a paper from US that i have never been married before and eligible to get married right now. I had gotten that paper and had it notarized and everything but i forgot it at home when I was flying from US to Azerbaijan. My step-dad mailed it to me here, but it got lost on the way here. As a result we missed our registration date, which was Sep. 27th, as they needed that paper. Since we missed that registered date, we had to wait another Month to get a new date. Well I found a way how to do it without waiting a month. My step-dad overnighted new needed document and i got it this morning. We took the document and rushed to the translation center where they would translate and certify needed doc. and then we would be on our way to get married.Right before we walk in to the translation center, Kristina gets a phone call as we walk and suddenly stops and becomes WHITE. It scared everything out of me as I thought somebody passed away or something. and then she states: "Visa got approved!" then I become White too. They said they reviewed our case and decided to approve her fiancee visa. If they called 2 hrs later we would be married and Fiancee visa would be expired.
    We already sent a passport to Us Embassy in Georgia and they said it will take them 10 days to provide a k-1 visa. I will be returning to US with my baby. We cannot believe this! Everything happens for a reason. If I didn't forget that document when I was traveling to Azerbaijan, it would have been too late and we would have to wait forever before we meet again.
    We think one of the reason they reviewed our case again is that I went to US Embassy in Baku and asked their help to get a new document that I am not married. So US Consular in Baku talked to me personally. Maybe they have centralized system where they saw that I am planning to get married. I have no idea. that is the only explanation.
    Well, there is my short but super happy story.

    Mistake in my birthdate also happened to me. My fiance called the customer service to have it corrected. And we track our case online, it says " On July 5, 2014, your date of birth was updated relating to your I129F Petiton for Fiance. Please check our website for further update....etc". And we got our NOA2 on 3rd week of August. We were not asked of RFE.

    My Khmer wife has a different last name than both her mother and father (they gave her the same last name as one of her grandmother) and we had no issues. Are both your mother and father's names listed on your birth certificate?
    You last name being different than your father's is not problem, as long as your birth certificate/passport/ID card are all the same name and all the paperwork you've submitted have the same info and spellings.
