    Either Option 3 or give your own wedding & fiance/spouse priority and potentially not attend the wedding if option 1 doesn't work out, after all it should be more about being with your partner than attending someone else's wedding.

    I think any advice that any of us could provide wouldn't be legal and hence it won't be provided, all I can say is that you can't use his employment on the I-864 and will require a joint sponsor.

    He is pretty much SOL, even if he filed a N-600 and they issued his citizenship certificate then they would say all he needs to do us come claim it but they will never let him back in the country to do so. It apparently happens quite a lot but rarely ends well so he may as well get used to living in Honduras.

    What I don't get is how was he a GC holder for 12 years and citizenship never came up? Seems to be some key details missing from this story.

    You typically need to wait about 2 weeks after any SSN changes for the systems to sync up, the first time you tried the systems must not have synced yet.

    How exactly would that help anyway? It isn't like there is a small pool of repeat scammers that people are falling for.
    People just need to be more aware and not let "love" get in the way of their common sense, someone posted a list of warning signs on a recent thread and that should be stickied and expanded upon.

    There is so much conflicting information in this thread from the OP, only just now has the fact that he served divorce papers a month ago surfaced and at times he states the only grounds for annulment in NH is religious reasons and at others that it is if his wife had a pre-existing marriage. Not to mention all the inconsistencies in the story and timeline, I'd be very interested in hearing the other side of the story.

    A purchased H1-B? How could that even work? Maybe they could falsify the I-797's etc but how would they ever get it past a US consulate in order to get the Visa stamp (which is much more than just a stamp but rather a full ID printed on a passport page) in order to get back into the US. I could see how one could purchase a position that an employer would petition on your behalf but that would require an otherwise legitimate position that would pass scrutiny and nursing isn't an acceptable skill for a H1-B.
    There are big holes in this story...
    I've got some ocean front property in Arizona...

    What did the lawyer have to say, and what does he recommend now? You're likely well past the help that can be offered here.
    What are the circumstances of your relationship? Did you threaten to kill him, but filed VAWA yourself with the goal of staying here?
    Things aren't adding up.

    The 30/60/90 day rule is irrelevant for Adjustment Of Status with USCIS and intent alone can not be used as a reason to deny AOS, this subject has been discussed many times here.

    We just got back from our interview-- we were approved on the spot, and even got a stamp in the passport to allow us to travel (we may have a work trip coming up).
    We got to the office at 9:05 for our 9:20 interview. We were called back at 9:35 and were back out and done by 9:55! The officer asked very basic questions, and was thankfully in a jovial mood. (When he asked my husband if he had any children, I kind of giggled and said "He better not!" and we all laughed.) He photocopied our marriage certificate and some of the things I brought along (wedding invite, newspaper clipping, photo).
    I'm so glad this is done, and am so thankful for you all. Without Visa Journey, we never could have done this on our own. Virtual hugs!!

    You don't need a SSN to getting a marriage license in California - http://www.cdph.ca.gov/certlic/birthdeathmar/Pages/MarriageLicenseceremonygeneralinfo.aspx nor should you anywhere in the US.

    Void is not the same as annulled. Hire a lawyer to help you.

    It is right there as an option on the official form to file for annulment http://www.courts.state.nh.us/forms/nhjb-2245-fs.pdf the sixth result for a google search for New Hampshire annulment fraud.

    She is not going to make it to her sister's wedding.
    It's unlikely that she will get AP in time. Would you risk buying the plane ticket without AP or wait for AP (if it comes in time by some miracle) and pay a lot for a ticket to fly in a few days?
    Here is a suggestion. Get a civil marriage in July. File to adjust her as your wife. Have your wedding in September. Get AP by October (hopefully).

    Send exactly as many as are asked for EACH form. If 2 are asked for AOS and 2 for EAD then send 4. if you need some for AP or any other form add accordingly. Read instructions and follow them

    You may as well give up on the notion of getting a H1B, at the very earliest it wouldn't be until October 2015. Your best option would be a green card via marriage, the proper way to do that would be to go through the process of getting a K1 visa through your consulate, then get married in the US and AOS with an I-485 but what all the cool kids seem to be doing is entering the US on the VWP with absolutely no intention of getting married but on a whim decide to tie the knot and then go the I130 + I485 AOS route.

    All you can do is be honest and bring as much supporting evidence to support your case as possible. I sure hope this wasn't just a honeymoon and there was a real emergency need to travel but that doesn't sound like the case if your request to expedite the AP was denied.

    you filed wrong
    to add your income to combine yours with your husbands, you are the one to file the i864A not his father's
    since the two of you don't make enough, you shouldn't have sent any of your income since it's not necessary
    he files the i864 as sponsor and his father files another i864 as joint sponsor
    if his income isn't enough, then his father files the i864 and his wife files the i864A as his father's household member
    to add your income on your husband's i864 you needed to file the i864A as well as his household member or don't use your income at all since it wasn't enough anyway

    Umm, you're wrong. She can file a waiver based on divorce if the marriage was in good faith and she has proof. People do it all the time and get their 10 yr cards. All she needs is a copy of divorce decree (final).
