  6. USCIS does not run that play, it would be ICE and the immigration courts. I am not really sure if USCIS employees can immediately be transferred to ICE type work as that is more of a LEO type of work. If anything will slow down USCIS more than it already is, it will be more unfettered paroles.

  9. So for an IR2 visa with the petitioner living overseas, the consulate will expect to see a plan for the petitioner to repatriate back to the U.S. with the eventual beneficiary. This is more common for an IR1 spousal visa, but it applies for an IR2 as well. Good Luck!
  10. Yes, the petitioner must always file their own I864 even if using a joint sponsor. Also, anyone providing an I864 has to show they are living legally in the U.S. as a USC or an LPR. Good Luck!
  11. Typically the petitioner for a family based or family reunification visa has to show plans they intend to live in the U.S. What visa class are you trying for? Do you have other qualifying relatives that can petition for you living in the U.S.?

  13. Your husband will be applying for a spousal visa so in effect becomes the visa applicant. You are still the petitioner, but since the I130 has been approved, the process now moves to the beneficiary other than your requirement to provide the I864. It can be a little confusing, but in the end it is your husband, the beneficiary that is applying for an immigration benefit through your petition. I hope that helps a little. Good Luck!
  14. You can file the I90 to renew a 10 yr GC within 6 months of the expiration. Now of course in the case of the OP they are looking to remove conditions via the I751 and not renew a valid 10 yr GC, so it is not relevant to them, but they certainly could have seen mention of the 6 month window. To the OP, proceed as @Crazy Cat and @OldUser advised with the I751, do not file an I90, and do not follow any guidelines related to an I90 filing. Good Luck! That status can be revoked at anytime, and it is questionable as to why Haitians are still allowed to be part of this program. The DR won’t let them in their country, it has been years since the earthquake, why do they still get TPS?
  18. Yes, my wife travels this way often. Book your tickets in the name on your US passport except for any domestic Vietnamese flights, and take a copy of your marriage certificate with you in case anyone asks about the name difference (in 10 yrs, my wife was never questioned). Good Luck!

  20. Are you talking about the medical examination? I have not heard of a consulate requirement for biometrics. Regardless if you have a choice, choose IR1.
