  1. I agree that an SB-1 will most likely not be successful, but they can always try. As others have asked, it is important to understand what their long-term plans are to give good advice. If they plan on only visiting the US, then LPR status is not really for them, but if they plan on re-establishing residency in the US, the I would also hop on a plane and hope for the best.   2. As you stated, it tends to be more of a cultural thing. Most of the time, the importance that the spouses know what is going on is much more important than the extended families knowing. I suppose there are some cultures where what the extended families know carries some weight, but there are exceptions to that as well (think same sex marriage in cultures that don’t accept that). Personally, I would not be worried about it as you stated. Good Luck!

  4. Many people with immigration intent (I130 in process) still travel to the US on ESTA. I don't believe immigration intent is an immediate denial on an ESTA application, and since the OP's spouse has not actually reached LPR status, I believe ESTA is still an option.
  5. You will need to start over with an I130 petition and she will need to apply for an IR1 visa to re-enter the US as an LPR. She should have ESTA available though. Good Luck!

  7. We actually stayed in Cody, WY which did result in an hour drive to get to Yellowstone, but it wasn't that bad.
  8. That's about it. You have the evidence needed to show a parent relationship which is all you need (unlike a spouse where you show marital comingling of the marriage). Then passport, and required photos. Good Luck!

  10. If she leaves without the I131 Advanced Parole permit while the AOS is in process, the AOS can be considered abandoned. You can try to expedite the AP. Beyond that, I know relative to the I131 being used as a re-entry permit, the applicant can leave after the biometrics are completed, I am not sure if that is the same for AP. Good Luck!

  13. We did Disney once back in the Covid days and except for having to wear a mask, the lines were not to bad since they were limiting numbers in the park. That being said, Disney for us was a one and done, if you want to do it, do it in the Winter, but not for a honeymoon. I would also put a plug in for Wyoming, but the wife and I are big hikers and loved Yellowstone and Grand Tetons. Have fun!

  19. You can do the N600 at your leisure, but apply for the US passport ASAP after he gets the IR2. Too bad your USC spouse did not file for your son years ago. Good Luck!
  20. As @MalloryCat said, you can get married while here on ESTA (no laws against that), and in fact you can get married today since you are currently here. I agree with @Daphne ., I would very much consider taking the consular processing visa route. It is a far superior visa, allows you to work upon arrival with the visa (remotely if your company allows that), and travel; did you bring all your clothes with you on this visit, if not, it might be eight months before you can get an AP approved which allows you to re-enter the US while your AOS is in process. Of course your wife at that point could fly back to get your things, but you won't be able to help. In the end, it is your decision as only you and your soon to be wife know your specific situation.   21. When my now wife got her K1, she did not jump on the next plane to get here. Se actually took almost the entire six months of visa validity to tie things up before moving which gave us the chance to plan a nice wedding at my brother's house for immediate family and friends (~100 people). We did not make any commitments until she had the visa in hand, and once we set the date. That is crazy, I believe in 2014, in my county they were $5 for a cert. copy. Also we were able to get the certificates 2 days after the ceremony when we took the license in person to the clerk and 5 minutes later we had several copies of the certificate.

  23. Refused does not mean Denied. The Refused status is used when a case is waiting for completion of some task during AP. Good Luck!
