daviddelen reacted to Thomas&Cleofe in Divorce after citizenship
Wow....I don't mean to judge you or your situation, but the way you painted your picture makes it sound as if you had this planned out from the beginning.
Also, what are you going to state to the judge for reason for divorce???
The only reason you give for wanting a divorce is to marry your ex.....

daviddelen reacted to AnnaMaria in Divorce after citizenship
Well, like Hypnos said, you're going to encounter some incredible challenges if you attempt to do this.
1st - Unless you plan on moving back to the Philippines and marrying your ex, you can't apply for a spousal visa because guess what, you are married right now to a U.S. Citizen. So for the spousal visa, you have to LEGALLY marry your ex again, either in the Philippines or here if he can get a visa, but again, if he goes through a Fiance visa, you have the interview where they'll see you were divorced and all the red flags will start popping up.
2nd - At your adjustment of status interview, if your husband doesn't know about this and you LIE to gain citizenship to go through with this, you're going to be hit with fraud. You need to talk to your husband about this, because if at your interview someone sees two completely different people, one happy and the other miserable, they are going to do some hardcore interrogating.
3rd - I know this website is about visa advice, but i'd like to think the people who ask for help have good morals. Reading your post, it seems like he loves your kids and you didn't mention any marital problems with the U.S. citizen himself, just that you want your ex back. I'm assuming at this point you have not told your husband, otherwise you wouldn't have stated that you wanted to divorce him after you got your citizenship. Think about the hurt and pain you may cause this person and the time and emotion he put into helping you come with him here and bringing your children, and loving them as you said. Again, this isn't a judgement, I just hope you considered how this is going to affect another human being who seems to love you and your children as his own.
You really need to consider the situation you're facing. If you want to go through with this, you need to be honest to your U.S. husband so that if you do proceed with the citizenship procedures, everyone is on the same page with what is going on. To be honest, it does sound like you tried to evade immigration as Hypnos said, therefore i'm not sure how much constructive advice you may get as people do not want to assist someone in fraudulent activity.
But, good luck to you, and I hope the best for your U.S husband, no one deserves this.

daviddelen reacted to dwheels76 in denied visa now trying to appeal
It's really just in the wording. Consular/embassies do not "Deny" anything. We always say that. They "Refuse" to issue you a Visa. Only USCIS can Deny. If that is the wording they are getting ready to send your petition off to USCIS where as stated it will expire if it hasn't already in 2 days as you say.
AP is what it says "Administrative Processing" They are finishing up their report to add on to your petition.
Since they think you are family. I would imagine what cousins sister- brother you need to be sure to have DNA/Bloodtest test something to refute so when or if you reapply you have evidence. Getting married will not fix a "we think you are related". Did they actually say that or is that something you think. What did they say at interview?
Most definitely get a lawyer.

The brutal but more logical option is to keep looking.

daviddelen reacted to Hotter Otter in Petitioner Doesnt want to live with Husband
Why would he have rights that meant he could live with her even though she wants a divorce? Women have equal rights in the US, maybe your friend should have done some research about the US before he moved there!
-
daviddelen reacted to Harpa Timsah in Petitioner Doesnt want to live with Husband
Geez... He can live here. He can remove conditions on his own based on divorce. Look at the instructions for I-751. He cannot force a woman to live with him.

daviddelen reacted to Al422 in Vaccinations and other visa denials
However, with the high cost of medical services in the US, you will probably save many hundreds of dollars getting them done before you leave.
You can't do them before the medical exam because the doctor doing the exam is the one who decides which ones you need.

Me either. But I guess we need more information from OP what actually is going on from the beginning, .

I have no idea what actually she is up to.

daviddelen reacted to shell20 in Lawyers, confusion and arguments.
Without our lawyers help ,I have successfully opened a bank account, obtained a social security number, have health insurance and a learners drviing permit, all in my married name. I'm afraid they don't seem to know their back from their front and that is putting it politely.

daviddelen reacted to Monalisa22 in Lawyers, confusion and arguments.
To be honest I don't know why many people pay for attorneys. Unless the case is very complicated or deportation is involved just do the filing yourself. I see too many people who have attorneys are getting checklists, RFE, paperwork missing, etc when this should not be happening when you are paying good money.

daviddelen reacted to Harpa Timsah in Lawyers, confusion and arguments.
I am not sure how they "tied" you to a contract for AOS. Can you explain that?
I find their reply email much more immature and offensive than the one you send to them. A professional is supposed to mollify you, not get into a teenage argument and threaten you.

You need to sign docs with whatever name you're currently using. Your lawyers are complete idiots and are wasting your money. Forms are straightforward and there are thousands of people that did them themselves.

daviddelen reacted to Merrytooth in Fiancee and I want to do K-1 Visa, Here is our situation. Help is greatly appreciated
Do you have a birth certificate?
If yes, there will be discrepancy with your birth date.
It is best that you get your passport reissued in the correct birth date before the K1 visa interview.
You don't want the wrong birth date to snowball into bigger issue down the immigration path.
Border agencies keep records and this record-keeping is becoming more and more sophisticated - and if they find a discrepancy for the same person on something like that you may have problems travelling anywhere.

daviddelen reacted to Bill and Vicky in Huge screwup by US or USCIS. Our I-485 cancelled due to no-show
I would suggest to you that you stop thinking of this as "USCIS has screwed up". They sent you a letter saying that you had an interview in California. I know you tried, but obviously you didn't convince them to move the interview. Until you have something in writing saying it has been moved, you are responsible for showing up regardless of where it is. And it says right on the interview letter that a failure to appear means you've abandoned the process.
Now that you've gotten out of the mindset of "the government screwed up and I had no fault whatsoever", make an Infopass appointment and talk to a human being. Dress nice and be early for your appointment. Beg and plead your case. You did change your address, you made repeated attempts to change the appointment, etc. You want to obey the law and process. Ask them to please help you. Be contrite and apologetic, even if you are convinced they are wrong and you are right.
Or, spend money on an attorney and continue to be antagonistic. Your choice.
Regards,
Bill

daviddelen reacted to raven52 in Not being able to go!
What has NOT been mentioned, is what was the offense, that caused the 5 years probation?
Could this lead to a denial, even if you did meet?
Good, Luck, you are going to need it, regretfully, but this would be a truely miracle, by not having the "together time".,.,.positive proof., I am a short timer here, but I have not seen an approval, without, evidence of the "required meeting".,.,..,and the other requirement, "you are free to marry".,.,.,that is the two requirements for a K-1.
The attorney is probably a good idea.

daviddelen reacted to Marco&Bettina in Delays at CSC??
Wow. Fishandchips was not rude to you in any way & yet your entire post is an assault on him/her.
For what it's worth, I'm also TSC & admittedly butt-hurt. You are fortunate you are at CSC, since you don't like the word luck.
Edit: Additionally, USCIS states processing times are 5 months, so you are not able to place a Service Request until it has been that long.

daviddelen reacted to KayDeeCee in Why is medical examination so expensive in London??
Local clinics set their own prices for an exam and vaccinations. Coming from the UK, you may find yourself with a bad case of 'sticker shock' at the prices for healthcare in the US.

daviddelen reacted to Harpa Timsah in Please help! Petitioner got laid off while in AOS
You can prepare another I-864 for the interview and get a co-sponsor. The I-864 must be accurate and approvable both at the time of submission and the time of approval, so with the change in circumstances, a new I-864 will be required.
Unless he gets a new job, like today.
And, if he got laid off, then he should apply for unemployment compensation. This is insurance, and not a public charge thing at all.
Best of luck.

daviddelen got a reaction from Marco&Bettina in Possible Ways to Overcome the Delay at TSC
I think the best way is to contact huge newspapers like the NYT and first state the issue framing it as unequal treatment. Texas citizens are being treated differently on a federal level than those in California for example. It's the kind of thing that would stir outrage and sell newspapers. It's a win win.

daviddelen reacted to Harpa Timsah in Is he ever going to change?
In addition to the alcoholics anonymous meetings for him, there are al-alon meetings for family of alcoholics. The people there have been through what you are going through and can help you sort through the pain. http://www.al-anon.alateen.org/
He will not change without help. Good luck to you.

Sorry this happened to you, but without concrete proof that he comitted fraud (email where he admits it, him having another wife etc), his greencard will remain.
Best you can do is divorce and move on.

daviddelen reacted to Lainie B in Getting married after 90 days of entering the U.S with a K-1 visa
Get married in a courthouse within the 90 days, then have the big ceremony and reception with your family and friends when you are ready. Lots of people do it this way.

I was giving feedback as someone who works in a state government office and liaises with federal government and news media outlets daily. I see what you are saying regarding percentages, but government officials always ask for numbers as the basis of an argument.
