    Oh, I know! We've actually had a lot of help with suggestions - everyone in my husband's family was either homeschooled or is homeschooling. The two reasons why we didn't delve deeper into it was a) the language barrier, seeing as they're still working on their english, and b) they want to try regular school once they enter the country with their K2s.

    The requirement for a K1 visa is marriage within 90 days. AOS has no timing requirement, it's just that it's advantageous to do it asap. You'll get the NOA1 soon enough, and once you do, you enter a period of authorized stay. Between the end of the 90-day period and the NOA1 you are, in effect, illegal, but honestly, I wouldn't sweat it too much unless you tend to do business along the Mexican border.
    Talk to the uncle and explain how fast you need to get the papework in.

    Then, coming back again to how it is legal in some countries, you wouldn't be committing a felony. You did something that was perfectly legal in your community, in your culture. How is that a crime of moral turpitude? Or are you expected to follow the rules of the game for every country, because you never know which one you might intend to immigrate to, later down the road?
    I mean, it's not like any of us has this dream, as a kid, to one day find an American fiance, right? Things just happen the way they happen.

    The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.
    You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

    What I felt, when I first went online to look for info on K1's, was that many lawyers out there made it sound like the process was hard and difficult and that hiring them makes it all so much easier and faster. It's not necessarily true. It's common to see posters mention how their experiences with lawyers and/or visa services turned out to make the process take longer and be costlier. Does it mean the OP shouldn't hire a third party for it? Only they know what's best for them. But the vast majority of members have managed to successfully obtain the K1's without resorting to one, and that's something worth mentioning.

    I'm sure we're all very sorry for all you've gone through, just as I'm sure many on here have even worse experiences to share. We've all invested money and time and God knows what else for this process and you don't see anyone else talking about law suits against USCIS. You have every right to feel frustrated. You also have the right to voice that frustration in a respectful manner.

    Well, honestly, if you do not like it. Just go back to your country. At least USA allowing you to stay on their land, even though the processes are slow and ineffective and takes ages of time. However, be grateful of what you have and be more patient, or just simply leave. Do not attack the country who is hosting you no matter what. Take it or leave it.

    The I-129f is used for the non-immigrant visa. For a fiance it applies for K-1 and for spouse it applies for K-3 The K-3 is a free option when filing the I-130 and is intended to allow the alien spouse to enter US and finish the process in US. For many countries there is a large difference in processing time for K vs IR visa processing, so this option was included to help families stay together.
    Applicants are encouraged to file for both and use whichever is approved first
    Reading the rest, I see you have taken the third option available to those actually able to get past immigration

    Thanks Damara for your post. It sounds like you and I experienced a very similar situation. My husband is a 2nd year medical student with no income. His Father agreed to be my sponsor, but I am the sole source of income and we've been living off my savings from my previous job in the UK since November. So when we found out that my job might be in jeopardy it was a scary situation for us both. I think if I was in the position your husband was in, truthfully I also would have gone for option B. But I don't have an option B right now, I kind of wish I did. Because the reality is now that I am very nervous about the retaliation situation you described above. Apologies I have not read any of your other postings, but it just shows that this process is a journey.... a journey which throws curveballs and impacts people very deeply. This forum allows us to discuss, gain advice and most importantly, for me, it has acted as a source of support.
    I can understand your emotion at the encouragement of other VJ members and myself.... especially if this is a scenario you and your husband felt that you didn't have a choice but to choose B. That is definitely a position that none of us should have to be placed in. But this encouragement comes from a stance that this cant continue to go on. And, honestly if I hadn't taken action I would have felt even more "useless" then I already do. And I use that word carefully.... I'm sure many of you have felt this way waiting for work authorization, waiting for advanced parole.... basically waiting for your life to start in the USA. I could not be happier that I'm finally with my husband in the same place..... but that doesn't mean I don't want a life. That doesn't mean I don't want to start building a life for our future family. I feel like I've been twiddling my thumbs for the past 7 months..... and when the thought of this job being taken away happened.... I almost jumped at the chance to resolve it. A task for me to do. Its bittersweet... yes, I succeeded in getting my job back. Does it feel completely condition free.... absolutely not. I pray I don't receive any retaliation for acting on the discrimination of the company... but if I do.... well what do I have to lose? I will of course take any action I can. But this time, with the knowledge and confidence that I have the support of many... not just the DoJ... but other people going through, about to go through or already through the other side. I've not moved to the other side of the world, left my family and friends, a job I loved and a country I love to become a 2nd class citizen in my husbands home country. I've come here to be with the man I love with the hope and belief that my husband and I will both, together contribute to society and be treated equally in the process. Yes, this may seem naïve. But, I don't think its unachievable. And yes, my advice is still don't settle if you are discriminated against. The law is there for a reason. We've all abided by it during the process of coming to reside in the USA... so I absolutely will be leaning on it, if and when I need to.
    I'm grateful that you shared your experience and I'm sorry your husband felt forced into option B. But I hope that the rest of your journey is curveball free.

    Hey everyone,
    So 5 minutes ago I received an email advising that the company will proceed with my employment. They seemed to be relatively apologetic and thanked me for my patience.
    So in conclusion, for anyone who comes across this thread in the future..... don't accept it if company refuses to hire you on an EAD (unless its a legal requirement you are a US citizen)..... I had a successful outcome and learnt a lot in the process.
    Thanks once again for the valuable information gained from this thread, I really do appreciate the advise and well wishes and am believing for good journeys for you all too!! Now bring on my PR interview ha ha

    Wow.... the worker hotline moves fast.
    A lady called me and said she spoke to my employer and they will be offering me the job. She said she told them they couldn't not hire me because it was an EAD. She also said importantly, if I were to receive any retaliation from the company once I start there then I should contact them and gave me her direct number.
    I have yet to receive the phone call from my employer to re-offer me the job.... hoping this comes soon. I'd hate to say that this process has left me a little skeptical. But here's hoping I receive a call from my future employer.
    Its nice to know that we do have some sort of protection when things like this happen.... we all play by the rules and sacrifice a lot to be with our spouses. I gave up a job I loved back home and whilst the process on getting a job here in the USA hasn't been hiccup free... I'm hoping this to be the end of the saga.
    I really appreciate everyone's feedback, it gave me the confidence to not roll over and accept this. I would encourage anyone who stumbles upon this thread if you are experiencing a similar situation then call the worker hotline and get them to help. I'm sure a call from Washington DC as opposed to me explaining an EAD definitely held more weight with the HR team.

    SparklyPony, she wanted to change her name, but like she said yesterday, her lawyer gave her bad advice and she ended up applying for AOS/EAD/AP in her maiden name. So she will receive all these documents in her maiden name. So she is all good for now.

    IF you have applied for AOS/EAD in your maiden name you will receive both your work permit and your green card in your maiden name. Accordingly, IF you have applied for AOS/EAD in your married name, both documents will be in your married name. There is no such thing as "automatically change".
    Once you receive your green card in your maiden name and you still wish to change your name, it is a more complicated process. That is why it is strongly advised to apply for AOS/EAD already using the married name.
    I assume your passport is in your maiden name. IF your green card will be in your maiden name as well, you can travel to Vietnam simply with your valid foreign passport and your green card. However IF you have your green card in your married name, you will have to take a certified copy of marriage certificate with you as well, as a proof of name change. A certified copy of marriage certificate is the proof that both names belong to you.

    Make sure you bring any divorce paperwork. Just because you will be married, and one branch of the government here already deemed it legal based on the K1 application doesn't mean the branch that processes the AOS will get it. You also may want to do any translations before you come over.

    That was the thing, all the consulate instructions said was how much the fee was and that it was to be paid at the time of the interview, at the Embassy - it didn't specify anything regarding payment methods except that personal checks aren't allowed.
    Anyway, the interview was yesterday and they accept cash or any major card, in case anyone tries to search for this info later.

    That's what it says to everyone - it's a standard reply. Don't pay any attention to it.
    Keep checking the CEAC website, soon it will change to Ready which is when your Embassy receives the case. Then just go along with what is customary for your specific embassy. Good luck!
