    Hi Espared12, This really sounds discriminatory that you are experiencing this. I am so sorry to hear this. I wonder if you can get a politician involved. There is no question that the letter expires one year after the date on the green card! Good luck. You started this Jan 2017 Filers thread, I haven't forgotten!

    Hi espared12, I thought your problems at the border had ended long ago. I'm sad to hear that's not the case.
    The officer is wrong. USCIS reworded the letter in July 2017 to get rid of this unnecessary confusion.
    Here's what the extension letter now says - maybe you should print it out?
     
    I hope you guys are well. Our AOS journey together and the dreaded 'Notice of Potential Interview Waiver' letter seems like a lifetime ago now lol'

    Looks like all of us in the California Service Center have been forgotten.  Awesome to see people in Vermont are getting a lot of love!! Had issues with CBP after New Years. They are adamant that my wife's 1 year extension letter expires on receipt date 01/09/2018, instead of 1 year from expiration of her green card. They threatened to charge us $585.00 every time she crosses the Mexico/US border after 01/09/2018. We live in El Paso, TX, so we tried to schedule an Infopass appointment at our local field office with no success. They have no appointments available. So we made an infopass appointment at the US embassy in Ciudad Juarez, Mexico. We went and were told that they are no longer allowed to stamp the I-551 on passports outside of the country. They informed us that our local field office is saturated and we might not be granted a walk in. We were advised to travel to Albuquerque, NM, about 4 hours away, where they do have appointments available to get her passport stamped. USCIS officer confirmed that the expiration of the extension letter is indeed 1 year from receipt date. So now we have our infopass appointment for 01/09/2018 in Albuquerque. Crossing our fingers that we will not have any issues and get her passport stamped.

    Before abandoning residency, I would consider visiting the U.S. embassy in Taiwan to discuss your options. While it is likely that your wife will need to abandon her residency, no need to do so if there are other options available to her. At the very least, you may be eligible for direct consular filing for a new GC, since you are both living abroad, which should be faster than the usual process.

    There is no Immigration Officer in Fargo now.  They will at times bring IO from other states to Fargo, Bismarck and Minot.  Of course they will not tell you anything about when or where.  I am still waiting for an interview after 16 months....

    From what I am reading, if you do not plan to travel internationally, you don't need to do anything. You can get the I-551 stamp in your passport if you do plan to travel, but it is not required otherwise. I guess just hold tight and wait....good luck

    OP, since he has already been denied the visitor visa and you are not ready to be married again, there really isn't any option for him to come over. Please do not use the K1 visa as a "try and see" as this is NOT what this visa is for, it is solely for the purpose of immigrating to the US and getting married. Immigration is a long and expensive process and is a privilege, not a right. Don't start this process without being fully committed and ready to take those steps of commitment and marriage. Only real option you have is to go visit him in his country and see where it leads you to. Good luck.

    Perhaps USCIS issues you a 10-year Green Card when someone was already working on your I-751 case while they receive your N-400 application? 
     
    Ah, they'll skip your I-751 and process your N-400 application, eh? 
     
    Did they say that they were refunding your I-751 application fee?  
     
    This happened to some applicants for their I-130 applications!

    It's been a while since I've been here at the ol' board.  I just wanted to post a status on where we're at in our journey.
     
    After exactly 1 year passed since we sent in our form for Removal of Conditions we received an RFE.  I'm glad we actually got it because not once through the whole year and to this date did our case status update online.  USCIS was apparently of the opinion that we put in exactly one half of an ###' worth of effort in the original package.
     
    We got as much of what they requested we could and responded to the RFE.
     
    Today in the mail we received this.  Thank you to the Post Office for leaving our mailbox open a crack in the pouring rain and soaking it for us first.

    Fire your attorney.
     
    If you have filed an I-751, your status is automatically extended until approval, or, in the case of denial, a final order of removal by a judge.
     
    When the initial one year extension expires, your status does NOT expire - only the proof of it, which is the purpose of the stamp, and there is no requirement to obtain a stamp. It is sensible to, but there is no requirement to do so.
     
    Doesn't matter if you have a 10yr card, 2yr card, I-797C extension letter, or an I-551 stamp - they are all proof of status and not the status itself.

    Iran is on the list because "the government in Iran regularly fails to cooperate with the United States Government in identifying security risks; is the source of significant terrorist threats; is state sponsor of terrorism; and fails to receive its nationals subject to final orders of removal from the United States".
    Rather than harassing our government, your time might be better spent trying to encourage the Iranian government to play nice with the rest of the world and stop behaving like a rogue state.

    I have several friends who have gone through the H1B visa to green card process. Every one of these friends knew all of the US immigration laws to the letter. They could quote chapter and verse. Their intent was to continue to work and live in the US and they were not going to allow their own self-ignorance of the law be a factor in achieving their goals.
     
    Your friend sounds like the opposite. To work on an H1B visa right down to the end of the time period allowed, and then start looking around for options is not wise. Then having a friend come onto an immigration forum and ask questions on his behalf is another indication of a lack of wisdom. Your friend needs to wise up in a hurry, do his own research, consult attorneys, talk to his employer and learn as much about immigration law as possible. If not, he'll probably be going back to Germany, soon.

    My husband had a tough time the first couple of weeks he was here. We didn't argue necessarily, but he did seem more quiet and emotional. I totally understood as he's the person who moved his entire life, and left everything he had ever known. There were even nights that I could hear him crying himself to sleep. I tried my very best to comfort him as much as I could, but I knew it would only take time to heal this issue. My point in telling you this is because if anyone deserves to be a bit dramatic, emotional, and cold at times, it's YOU. And your significant other should be trying to support you, and comfort you as much as he can. Not telling you that you're being overly dramatic, or doing this or that wrong. 
     
    I think the decision to go back home is the best decision you can make. Not only for yourself, but your child. If you can't or wouldn't leave your child with this person alone (in fear of what might be said or done), why would you want to stay with that person?

    There's no need to live for one minute like this.
    Go back to Canada and hold your head very high, because you will have shown more strength and resolve than 99.44% of other women who find themselves in abusive relationships.

    You are eligible to file for naturalization after 2 years and 9 months if you married U.S citizen and during those 2 years and 9 months you were a permanent resident. It is compulsory that you are still married to U.S citizen spouse during the time of filing for N-400. Based on your timeline you are eligible to file N-400 in April-2018. Conditional GC is the same GC but it has a condition which needs to be removed after the specified time mentioned. You can see the N-400 instrucations or visit the website below which has the N-400 form . Read the first page of N-400 which going to be very helpful for you.

    Its my home, but I really have no intention of become a citizen at this time.  I love being a Canadian citizen.  I can't even say I'm proud to be living in the USA despite being immensely proud of my American husband and even of his service.  I would move back to Canada if he wanted to. 
     
    But at least I have the option of doing so if I should ever want to.  Regardless I wouldn't do it before the 5 year mark.  Mostly because I'm not sending the US government any more information proving I have a genuine relationship.

    Nope - 
     
    They WILL ask you for your Green Card and if it is expired - they can't accept you.  Even though you are considered legally resident but you can't prove your status.  Right now I am stuck here in the US because I am waiting for my oath to come in.  My GC expired a few weeks ago and I was supposed to go to Canada with my kids but now my kids are with my parents and I'm stuck here.  I am not going to risk myself by going out of the country and not able to get back in on my expired GC.  I am not going risk to leave my job for another job in the middle of this.

    There are no girlfriend visas in either direction.  If you want to inland process in Canada you need to be common-law at the very least.  You can't just live in Canada as suggested. She can't just live in the USA either.  Immigration in either drection will take a commitment.
