    It would be a good idea to contact your Senator about this. Find the form on their web site then send it in right away. I would also set an Info Pass meeting with USCIS and talk directly to them in person.
    This is one case I have seen where the infamous embassy in Egypt has really gone out of its way to make things as difficult as possible based I think on other experiences having nothing to do with the facts surrounding this exact case.
    The O P here has done everything she can to make sure this went well and as we see they still wont issue the visa. I don't know for example if his English " sucked " but he is Egyptian so how could he be expected to have perfect English? I'll bet the COs ability in Arabic isn't perfect either. His English was good enough to have a long term relationship with the O P. Long enough to have married her. My English still isn't perfect but 8 years ago no one questioned my ability at the embassy.

    Only USCIS can revoke the underlying I-130 petition, not DoS. DoS will return the file to USCIS and state their reasons for why they believe your I-130 approval should be revoked. USCIS will either agree with DoS' recommendations and send you a Notice of Intent to Revoke (NOIR), or disagree, re-affirm your approval, and send it back to the NVC.
    If USCIS decides to issue a NOIR you will have an opportunity to rebut the negative points that USCIS have decided.
    You should file a FOIA request in order to obtain a copy of the case file from the embassy which will tell you why they denied the visa.
    It will take around 6 months for USCIS to decide what action they are going to take. You should strongly consider retaining an immigration attorney experienced in these sorts of cases, or at the very least consult with them.

    Part 1 you list your name and reason for filing, which is 1a.
    Part 2 is about the intending immigrant, their name and address.
    Part 3 you just say Yes, you sponsoring the person named in Part 2. If no family members are also immigrating, then the sections for family members will be left blank.
    Part 4 is your name again, and your address and such. You never list the joint sponsor's info. They will have their own separate I-864 to fill out.

    As long as you enter the USA on the spousal visa after the 2nd anniversary, you get the IR1. With your timeline, it'l be worth it- less fees and paperwork later.

    That's right .The second question that they might ask him if he would say i want my interview in Arabic is so how do you guys communicate ?! If he does great with you as you said he will do great with them as well .

    Unfortunately this isn't a linear process. Just because the guy who filed before you gets approved today, that doesn't mean you'll get approved tomorrow!
    You can contact your Senator/Congressman, some people seem to have some success with that. The only thing you can do is wait, and wait, and wait. This WILL happen for you, there's just no way of knowing when.
    However, please please please don't make any firm wedding plans before your fiancee has the visa in her passport! There's lots of stories of people on here who book things and then have to cancel them, losing lots of money

    Yes it is true. Bring a copy of your marriage cert and point your anniversary date out to the immigration officer at PoE, so they don't forget about it.

    I suggest not to apply for a visitor visa , just wait till your petition is approved and then apply for IR-1 , all what you do when you apply for a visitor visa is losing your money > I had the same experience , my husband sent me invitation to visit him in the states , although I had all the documents that prove I would come back after the visit is over , but the Visa Officer denied me the visa saying having a husband in America means my ties there are stronger than the ties in my country and asked me to wait till the petition is approved.

    July 10th was my husbands appointment at the Cairo Embassy with the Consular Officer. We have finally reached the end of the tunnel. He was approved for his visa and offered plenty words of congratulations from the Officer( from my understanding he was a very happy man).

    My husband account of his appointment:

    I showed up at 7 am at the gate got in 7:30 and my name was on gate I took off my shoes and belt cuz they have too much metal to cross the gate then I put shoes in X-ray to check it might hiding something in it then got my things back and went inside the embassy. I took number and waited to be called.

    A Egyptian lady working in embassy was placing files in order and put my number on my file so the Embassy officer can call me by number. The Embassy officer called my number the officer was so nice smiling man said good morning sir i replied good morning to you too sir.

    He asked me if the lady give you DHL paper to Write your address on it. I told him no so he got one for me and told me write your address here, so i did. Then the officer told me put your 4 right hand fingers on the finger scanner so i after that he told me he will reactivate the visa in the next two weeks so i smiled so he told me you look so happy told him yes sir i have been 15 month in this AP ....yes i can see that ,the officer said.

    He asked me which part of the state i will go told him Jax FL told me hmmm nice place i hope you enjoy living there and welcome to US. I told him thanks sir he asked me when was last time you saw your wife told him March told me so she were here recently told him yes he said okay.

    It turns out that it was not a signature they needed. The appointment was for fingerprinting, DHL confirmation form for delivery of passport and Waybill number.

    Thank you G Walters for your sweet encouragement you were right. The Officer told my husband that they had to reactive his visa because it was issued but never sent to us 6 months ago.

    Its has been a very long journey that started 4 years ago with a simple "hi and a simple Good Night. I can not praise Allah enough for all the blessings he has provided for me. I can finally say we can start planning for our future as husband and wife.

    It's only one regular birth certificate sufficient for nvc, your husband can get it from his city, and he should certify it from foreign affairs.

    Be careful of pronouns like "it". CR1 and IR1 are both visa categories and resident status categories.
    The correct answer is that the visa category will depend on the visa issue date. The status granted on entry will depend on the entry date. You can have a CR1 visa and IR1 status granted if the anniversary occurs between the issue date and the entry date.

    You can only use 2 joint sponsors if more than 1 person is immigrating. You cannot combine income of two joint sponsors, you can combine income of a co-sponsor (family member of the joint sponsor). Each joint sponsor should have enough income to qualify based on poverty guidelines.
    IF only 1 person is immigrating, you need to find a joint sponsor with enough income to cover the immigrant and the household size of joint sponsor.

    It should give everyone an idea how busy the embassies are... take the number and divide it by 52... Costa Rica is pretty dead at 543 for 2013. Good for me and Lucybelle

    I found the website to see the number of Immigrant visas at each embassy. Albania only has about 2000 but i havent heard anything yet.

    In my many years of VJ life i noticed many emotions. It's like this.
    You file the I-130 and when you get NOA2 you feel you won the lottery. You know all the next steps or maybe you think you know, but suddenly all knowledge you gathered after all those months of waiting has failed you. Thus the many threads "I got NOA2 what do I do next". LOL You wait you get case# anti-climatic even though now some of the power is in your control. But the prize we seek is CASE COMPLETE. OMG Case Complete. I am euphoric. I can't think. I got to call somebody. Why won't they give me an interview now. What is their issue. I mean it's me, dwheels76 for goodness sake. i have called you everyday 3 to 4 times i know all your names Supervisor Gus, and Tammy, Jessica, and Kurt. Now I'm waiting thinking, do I clean out the closet for him or her (if hubby coming OMG where will he put his stuff)? Waiting do I go to interview, spend that money. OMG please tell me this is just torture. Interview announcement, the first person dares, now the flood of emotions comes and people call some get it now some have to wait Oh me me me . And you hear the operator say those words and you want to cry, shout, slap somebody (well I did) hehe Now the endless wait for interview day and the reality of seeing my baby. Did I gain weight? Will they like the US? Did they miss me? Do I have a pimple (okay not serious but still) Welcome to the Visa Journey.

    It depends on your embassy. Some embassies are busier than others and will cap out much faster, especially if there is a few month backlog of folks waiting , like Egypt for example.

    PD's have nothing to do with a IR1/CR1. Its your case complete that gets you scheduled. PD's will be used if there's like alot of you and scheduling is tight. It also comes in to play for LPR's because they have a Visa count. And its also embassy specific wen you get scheduled.
