Yes. The one removing conditions is the one petitioning for the removal of those conditions. The US citizen is the spouse.
That question 8 really is a doozy since it is the conditional resident whose fingerprints and photos will be taken. What a headache!

Notice in part 3 that the conditional resident is removing conditions through a marriage to a US citizen or a lawful permanent resident. Therefore the info for part 4 is related to the person the conditional resident married.

jamie916.. You have I think 3 different posts going on, on similar topics.
Based on your posts, your fiance lives in a disputed region of India, tried for a German visa through a German spouse that's in divorce proceedings. You've met him once in Thailand, and asking for the next set of steps.
Before I make a suggestion, be aware of Indian men seeking western women to land a visa. He has no particular ties to his home, is from a marginalized community, looking for down on their luck, not very highly educated, older western women. I'm in no way passing judgement on you, but you fall in that category. He's already lied to you about his age, and kept you away from meeting his family online. These are flags that stand out.
That being said, despite his travel to Thailand which he didn't need a visa for, his chances of a US B2 visa are slim, since he lacks substantial ties to India. A K1, while eligible, would not be easy, would cost months and many hundreds of dollars. If he is really the one for you, your best bet is to go to India.. or a third country once his divorce is final, and get married. You can then petition him for a spousal visa. He's wasting time trying for the B2 visa.

The answer needs to be Yes, because that's the truth. Answering No would be a lie, and a crime (the form states that your answers must be true under penalty of perjury).
Minors incur no overstay until they turn 18, so even if he overstayed 10 minutes, 10 years, or until the day before his 18th birthday, it makes no difference as to his future visa eligibility.
Amend the form, this time answering truthfully.

The correct answer was "Yes" he did over stay a visa as it was a visa in his name even though he was a child.
The fact he was under 18, well under 18 by what you put, that overstay would be forgiven and he would not deal with any sort of ban.
Always be upfront and honest on forms. Lying on forms, regardless if he would be held accountable or not for an overstay, can cause worse problems for him now.

Transborderwife is correct polyamory is NOT polygamy. Plus as far as I know in every other state (with the exception of Utah) you actually have to marry more than one person for it to count as polygamy (in Utah, co-habiting with several people as one would with a spouse also counts, I'm assuming for historical reasons).
So unless either OP or her husband plans on marrying this other lady, or live with her in Utah, they are not doing anything illegal.
Everybody can have their views/opinions on their arrangement, but what's legal and what isn't are objective facts.

That is because Hispanic is not a race - it is a general term for individuals from. Spanish-speaking countries (like many of those from central and south America).
Are you white? Black? Mixed? Taino? Amerindian?

The only difference between the two visas is if one gets a 2-year or a 10-year GC on entry. The process of getting these visas is exactly the same, though.
