    I have paid the waiver fee and I have been apart from my spouse since may of 2011. I agree that there are some issues with the immigration system that could be fixed. I also agree with what Carla said earlier as I saw the same tone in your post. The process can be a headache, trust me I know. I only see my husband for a few days every 6 months. However, you knew that you would be in the immigration process and you knew the tourist visa was being abused. No denying that, and although it is difficult we all submitted ourselves to this process to be with the one we live no matter what. I had sympathy for you in the beginning until you started judging others situations and you got called out on it. All cases are different however my husband who was one of those illegals here also is in agreement that although it is a long expensive testing process, there are reasons for this and he is thankful to be given a second chance and permitted to send the i601. Also as for the time frame of the i601 they are apparently working on cases with priority dates of March 2 of this year. And since we all opinionate and judge (lol, it is blunt advice to me ) so much on here, my opinion is the attorney that agrees that what your family was doing with tourist visas isn't abusing the system probably really just wants your money.

    unless one of you have an actual mental illness, i dont see how a psych eval would be very relevant in your case.

    hi, getting the interview moved is not so much an issue. did you ever let nvc know you are planning on filing an i601a waiver? either way let them know so you can move the date. as far as the multiple voluntary departures, i have never heard of that. you may also find some good advice and forums on immigrate2us.net it has a lot of waiver info on it and tons of people at the same stage where you are at. there are also a lot of good attorneys they can recommend to you. i would get a second opinion from another lawyer before you file the waiver.

    His wife is not keeping him from his children seemingly. The situation apparently has not arisen as he is in Canada and they are in the US.
    If he can move to the US and the same State then access issue's are likely to be a lot simpler.

    He did do it.
    First he complains about kidnapping and Hague Convention.
    Then it turns out they moved to the US, without the appropriate paper work, he made a trip back to Canada and when seeking re entry as a tourist was refused.
    Certainly being refused may be a good defence against any claim that he abandoned them. However it seems 2 1/2 years have passed so what happened in this time period could be relevant.
    According to him she did not do a runner with the kids.
    Family Law is a State matter and from what I have seen States usually do not allow children in such situations out of their jurisdiction.

    Hi, ok assuming that you are not in the states right?, it sounds like you will have to file an I-601 waiver (however, one cannot be sure without knowing how you entered the states, and how many times you crossed or attempted to cross). the form the attorney is talking about probably is a g-28 form, which gives attorney permission to "enter the case and or find out case specifics from uscis and receive notices on your behalf" pretty much. My husband had to do a waiver also, not for dwi but for driving without a license and was also given voluntary departure. with NVC just make sure you have the voluntary departure order from the judge and the sentencing documents for your dwi because they will ask for those at nvc and the interview also. if you want more info on the waive process, you should check out the site immigrate2us.net however for NVC info, this is the best site, it helped me through step by step just read the guides and read them again.

    ok, yes my waiver was accepted and approved. I am not sure why by the information you gave they would think you would need to submit a waiver more than once, they must not be that good of a waiver attorney if they cannot stand 100% beside their work. on the other site there are a lot of good waiver attorneys if you want to use an attorney. and from what I have always heard the main reason for a denial of a waiver is lack of evidence of hardships, so just make sure to back up every argument you have, not necessarily a lack of hardship is an automatic denial, however, lack of argument of same is worse. As far as NVC, yes they asked me for any court documents relating to his traffic ticket and any court orders from immigration when I disclosed it on the immigrant visa application it asked for any document back ups.

    Your first marriage was not dissolved, so your second marriage is not legal. You must have a legal marriage to file for a spousal visa.

    What you should do:
    1. fill in your timeline so people here can help you on when to apply for Removal of Conditions, etc.
    2. quit listening to your spouse on what you can and cannot do/obtain. why would you trust someone that went behind your back to divorce you?? If you are a named party in a case, you have every right to get a copy of what has been filed against you.
    3. go to your county courthouse clerks office and ask for a copy of any cases, pleadings in which you are involved. there may be a fee for copies, but yes if there is an actual case it is there and you are allowed to get copies.

    When you are in a better relationship than your first it can feel liberating. Now that you are aware of the kind of relationship that you want to be in, have that one and enjoy it. Give yourself a break Trust your partner but learn to put your foot down without being afraid and know that eventhough some of the happiest couples argue, there never has to be abuse. Agree to disagree on things and yes it is totally normal what you are feeling right now. Remember that if you and your new husband maybe argue about something similar that you did with your ex (for example housework) keep in mind your new guy is not the monster that your old guy was, so dont let your past torment your future. To me the most important is for you and your future husband is to set an example for your children that what you went through before is not acceptable and is not the "norm". When your children see you as a happy couple that is always able to talk things out without verbal or physical abuse, it gives them the security they need and makes you just shine. I wish you and your family a lifetime of happiness.

    This is yet another in a long line of similar incidents which just goes to show that a lot of people who have guns shouldn't have them. They cause more problems than they solve.
    People who get guns out of fear tend to use them out of fear.

    Not able to work for at least six months? Where did you get that number from?
    And there are plenty of married couples who can live (albeit within their means) on less than $30,000/year. The fact that it is tough for you doesn't mean everyone else is in the same situation.

    my husband's status was the same after the 601 approval and after he sent the passport and medical for a couple of days still. its normal dont worry, it takes a few days to update.
