    Hey everyone. I posted a while back, uscis was asking for other people besides me to go to i485 interview. . It was a mistake of course. I think they were asking for my abuser to go. I contacted congressman and they spoke with immigration and gave me an interview date of Nov 9th. 
     
    I will call to make an appointment for physical tomorrow. My question.  How long does it take for them to give you results ?

    Stacie, sorry for all that is happening. Once they send that letter of removal, I doubt if they will come to your house. Not sure if the court will dismiss the case with just a receipt of 485 without the 360 approval letter. 
     
    It's good though your lawyer is doing something. Don't be scared it will be okay. 
     
    Some members here who know more about court proceedings will give you more information.
     
    In my opinion I think you will be OK since you filed VAWA before removal. I am hopeful. Cheer up!

    I don’t pay attention to those processing times at all. You can use it to see when your case is taking a really long time or something. I saw people who had VAwA approved in 14months on here, so you never know. My card went into production In July 2020, I filed in Jan 2019. I see people still waiting from 2017-2018, so nothing is set in stone. I didn’t do anything different except get my medicals updated and my attorney decided to mail it in to local office along with approval. The next thing I know is I got an email that umm we have your interview notice. I was shocked, but extremely grateful to God. I prayed and I asked him for approval in Oct and in Gods name that’s what will happen. I will walk out approved on Oct 26th. For everyone here, just believe in your victory. You know what you’ve been thru so trust God or whatever your faith is. There’s nothing that can’t be accomplished by just believing. I read most of the posts and stories on here. For those who are struggling to get a job, just keep trying. I’ve never had any employer ask about immigration status. I don’t divulge unnecessary information. I graduated this year with my Masters degree in June. I’m pursuing a career in the medical field. This year has been rough for everyone, but keep pushing. You’ll see your day will come.

    Thank you for ur reply back. That’s what I’m hoping. Lawyer said that there gotta be some miscommunication between USCIS and department of homeland security. According to law, they should’ve not send the removal letter and I’m really hoping that I don’t be put in deportation process.

    I honestly think it might complicate your case. If your vawa is approved and standing by for aos adjudication I wouldn't recommend you looking in the direction. You can renew your ead combo card for usual travel and work in the US.

    Hi my Vawa family,  I do hope all is keeping  safe during this pandemic and each and everyone I360 which were approved will get their interview soon and for those awaiting for i360 approval it will happen in the name of Jesus.🙏❤...I am a bit excited this morning because I have contacted my congress person twice ., once in August 2020 and was advised that my i485 was in queue for interview  she also  reached out again to USCIS September ending and this morning I got an email from her stated that my case is now assigned to an officer for adjudication..to be honest I am happy and nervous at the same time knowing this process will soon come to an end...this forum is one of the best place to keep our head straight and I do appreciate each and everyone here., @Stillwinning!!!😊 you are one of our  best motivator ..may we all pray for each other has this journey is a very long one ., but throughout it all there is a bright light shinning at the end of the tunnel.🙏🙌👏💯💃💓

    3rd August 2018 Applied 
    14th Oct 2020 Approved.
     
    I had already sent  I765 for 3rd EAD and they took the fees as well. and saw this Good News ........
     
    I wish we all get approved. Don't lose hopes and don't over think your approval is coming don't worry .....

    First and foremost if you got caught somewhere far away from where you live you should motion the court to change venue (motions can generally be filed at any time including right now). Obviously if you live in somewhere like NYC and your hearings are in Newark, NJ that's not that bad, but if you live in California and your hearing is in Florida then that's a problem should your physical presence be required.
     
    Anyways, you generally can file I-485 with the court prior to your first hearing, however I definitely understand where the lawyer is coming from. Namely hoping that I-130 will be approved by then and getting a termination so you can file straight up with USCIS. USCIS is also generally a much more friendly forum for the I-485 because you won't have opposing counsel nitpicking at your application.
     
    The first hearing will be just a master hearing that'll go over your deportability charges, your relief avenues (i.e. the I-130) and depending on whether it's approved or not the following will happen:
    If approved: The judge will either terminate or tell you to file I-485 with the court and set an individual hearing date for you
    If still pending: The judge will just issue a continuance and give you another master hearing date in a few months.
    If denied: You better get the appeal for it going ASAP. Unlike most other appeals, appeals for I-130s go to the Board of Immigration Appeals.

    Funny note just to spread some cheer here!
    When I sent in my VAWA application, I treated it like a pregnancy lol. When USCIS accepted the package it was “pregnancy positive”; when first prima facie  came, it was” first checkup smooth” trimester one complete. With every prima facie the pregnancy progressed and when it reached 12 months, I celebrated its first birthday 🎂 🤣🤣. Finally when the case approved, It was the “delivery” LOL. All in all smooth process 😁

    dear friends 
    I am thinking that lot of the people who got  VAWA approved are waiting for their interview 
    so I request the people who already have an I-485 interview after VAWA approval share their experience and the commonly asked question so that someone can create a guideline for the interview Ie the do’s and don’t for the interview in a question answer wise sequence this will really help the other member to be mentally prepared for their upcoming I-485 interview

    Stay put @MarSam701. We'll all be fine. I got approved since 2018 but my approval notice got missing, couldn't apply for AOS until I got it in May. I'm still waiting for next steps, my case was transferred about 16months ago too. Just stay positive, keep using your EAD wisely and develop yourself. 
     
    Don't get worked up over GC. I couldn't work until May 2019 and I've been in this country for almost 7 years. My lawyer always felt bad cause I have a PhD. Don't be frustrated, be grateful for the little privileges you have now. This is just an encouragement to everyone on this platform. Positivity is your only key to happiness. 
     
    @Blunt you'll be fine brother. Listen to the advice from everyone and be positive. Stay away from the negatives so you don't drive yourself into depression. What you have is RFE not Intent to deny, so it's another chance to prove a stronger case.

    For those who have reached their wits end, frustrated, worried, anxious, depressed, afraid and lots more I pray this morning that God's mercy and grace speak for you! It makes the difference everytime! The race is neither for the swift nor the battle for the strong but God who shows mercy! Long before I was approved..I read about people's evidences submitted and worried that mine wouldn't hold a candle to it...Really I didn't have much and explained why in detail..but I know GRACE spoke for me! Today I have my Greencard and I can't help but to acknowledge the way maker, miracle worker and promise keeper who said it and did it for me! I encourage you all this morning to look towards HIM, the author and finisher of our faith! Your testimonies will be sure! HIS promises are yes and AMEN!!! No more denials..let the approvals come through!🙏🙏🙏💖💞✨💫

    Start living your life, I say go for that job/ classes it helps a LOT. And stop re-reading your application over and over, it’s just going to make you relive the horror. Get busy, take baby steps to get back your life 😘🤗

    @Blunt You are a comedian..it's hard not to laugh when reading your ''epistles'😂😂 again be rest assured no officer is out to get you..and please do not put any mean remarks or laughing emoji in your RFE response..LOL😂😂 I'm kind of concerned you might want to lash out to the officer or show your displeasure somehow..three words hon DON'T DO IT!🙅 I like your carefree spirit and resilience but learn to get a grip on your emotions. I got an RFE too and so did a host of other people here..I don't recall fussing this hard..I simply answered it touching all the salient points that was brought up and here I am..💁 take it easy man..I pray you get approved after this low moment!🙏🌺🌻🌹🌼🍀🌸💐😊

Of a truth..this journey is tedious and depressing, but I urge you all today to be strong, keep your eyes on the prize..don't be distracted in any way..your celebration draws near with each passing day!     Timeline
    I-360 sent April 2018 received Prima facie..
    renew my EAD 2 times
    I-360 approved february 2020 received approval letter and C31 card march 2020
    06/2020 received courtesy letter
    End of 07/2020 Case ready for interview.
    09/2020 Interview was schedule for October 2020
    went to interview with my lawyer officer was super nice, he only ask me the questions on I-485 and then review my paperwork that I brought but didn't take anything other than the divorce decree.
    By the end of the interview day. I-485 status change to "New card is being produced"
    Next day "Case was approved".
     
    I wish all of you to get approve on I-360 and I-485. This journey was super super hard for me but I always believe in the power of the ALMIGHTY. You just need patience lots of patience and keep praying.

    Guys just because you have a lawyer ( someone with a degree in immigration) don't assume they know everything. Especially if their specialty is not VAWA. Double check your paper work for yourself. Also if possible insist on the paper work/ evidence that they need to send.
     
    My lawyer overlooked some stuff too, and I paid for it down the line big-time. 
    At the end of the day only the Good Lord will make a way.
    Now, I check and recheck my paperwork for myself. I do my own research and I use that to move forward. 
     
    If you go back to old threads here on VJ, as far back as five, six years, you will find alot of information about VAWA that Sandra used to give. 
    Human is to error. Even a lawyer can mess up. So double check for yourself.

    Venting can be cathartic.  However, disparaging other VJ members by name is a violation of the site's Terms of Service.  One more instance by the member in question will certainly result in an enforced period of cooldown.
    If there were a button for 1,000 upvotes, this post would get mine.
     
    Blunt, your mood reminds me of what happened when the [censored] Guayaquil consulate hosed Mrs. T-B.-to-be out of her K-1 visa.
    That was in 2008, our marriage is over, and I'm still spittin' mad at the consulate.
     
    Unlike my situation then, you have ammunition.
     -- You have an army of supporters here who are giving you usable advice.
     -- You have an experienced VAWA attorney here who has told you how to proceed.
     -- You already have a personal attorney who (if you both focus) can help you.
     -- You know exactly what you need to provide:  overwhelm them with secondary/supplemental evidence.
     
    In my day,  I had almost none of the above.
     -- I had many supporters, but they had no idea how to proceed in substantive fashion.
     -- I had to cast about for immigration attorneys... who either couldn't help or who gave drastically wrong advice.
     -- I was on my own as to what to do.
     -- I had very little idea of how to proceed amidst a closed, very opaque process.
     
    From my intense, still very vivid memories of that time and that torment, I recommend that you perform some violent physical exercise to blow off your tension, for as long and for as many times as your body can take it.  Then, resolve that you're going to win because you're going to present a case that the adjudicator can't possibly reject.  Then present that case.

    Vawa family my day has come. I have been pacing around now for 3hrs. Okay, so I have an interview notice for Oct 26th.
    My timeline for anyone who’s been tracking:
    Initial I-130/485 Aug 2018
    I-485 interview/placed on hold Feb 2019
    Filed I-360 Jan 2019
    I-360 approved July 2020
    Card arrival Aug 2020
    I-485 interview date Oct 26th.
    Please pray for me.

    What i am seeing about your case, you need to submit to them every copies of proof you submitted before with a explanation letter that you didn't have ssn and working permit that time that's why you couldn't do such and such.
    Tell them in details you were limited

    Yeah I think I will have to write another declaration on all the documents I have and wrote a lengthy letter back to the officer ..cuz there is nothing that is there that doesn’t show real marriage or is it until I show do videos of how we live and go places together the officer would believe,just like my lawyer said he said the officer is mean and wicked ,that we will fight him cuz we have mote documents even psychological evaluation and medical reports of where she hits me ..can a stranger hit me ?? Can I report a stranger as my wife for a police ..I have the police report as well..just like my lawyer said ,he said the officer is sentimental or likely the officer is racist or a potential abuser that wants to mess with my emotions and my emotions is too strong beyond that cuz I have realized that green card dnt even determines someone’s happiness in life ..so am not gonna be desperate or worry myself about what I can’t control ..all I just have to do is to fight it hard and win the case ..that’s it !! I even have pictures in different scene..yet this officer is still saying something different !!! All they want is someone should have immigration problems so that you won’t even have peace of mind during your years in America!! But God is greater than the evil ones amongst them !! I will send all what I have here again and write another affidavit about all am resending again and my lawyer would write is own to back it up again ..last time I check green card dnt guarantee happiness and a fulfilled life ..what will be will be ..thanks

    Hi, i was also in removal proceeding when my VAWA was approved. If you have a lawyer they should file for a motion to terminate your court hearing. You don't have to wait until the next court hearing. However, the ICE attorney must agree to terminate your case at the court as well before the judge will grant you that. In my case the ICE attorney and the judge both agreed to cancel the hearing. Once my removal proceedings had been cancelled i filed for the I-485 with the USCIS back in April 2020. Hope this help! 😊
