You can petition her now but there is a multi year wait for a visa number . If you get citizenship you can change classes. Either way it will end up being petitioning an adult child. The wait will be about 8 years and your daughter would be deportable all that time and laws could change to make matters worse. It might be better for her to leave is she is only slightly over her date.

The USCIS office has nothing to do with the Jamaican Consulate processing your K-1 petition. The embassy is still open.

I have friend who was very succesful and educated, did her masters in the US and came back to Romania and started a promising career. Then she married this guy who was succesful financially but less educated and he felt threatened by her position and success and he insisted she quits her career and becomes a stay at home mom. Fast forward 10 years, he wants a divorce and wants to keep the business money because " he made it". He didn't let her get involved in his business and he didn't let her continue her own career and like him there are many people. When a woman accepts that situation she does it because she thinks that man will be there for life. She is " insured" by the marriage certificate. When something happens ( divorce or death) the " insurance" should pay right ???

If i am not stable how can I give stability to them. I am a very kindhearted fair person. I just want to be treated fairly that is all.I work so there is childcare ,also. There is 12 years between us. I do not expect most to understand this unless they have to go through this. It not about anything except getting what rightfully fair period. Thanks. I wont use his lawyer as I told him. He told me that 1500. on paper but i will be getting lot more than that, but why would i trust someone that could not even tell me he is leaving me and the kids for whatever reason. Someone posted he didnt leave the kids, well they are with me so he left them, too. Im sure after some of the hurt die down I will be ok. Asking for half is no gravy train. if i am not stable there is no stability for my children.

let me say this, $1500.00 may sound like a lot of child suport to some people, and it is in a way but, as these children grow they will cost alot more ! child suport should be in the amount to which your childrens life style does not go down because of your husband left you. in most states spousal suport is 1 year for every 2 years of marriage, child suport must be paid till the children turn 18 years old, and he is not behind on any child suport payments, But if your children deside to go to collage child suport continues as long as their is not a break in school longer then 6 months between high school and colage, in which he will have to pay till they finish school, also he will have to pay half of their expences while going to school. also he is liable to pay half if not all medical expences till the turn 18 or finish school.
Dont sell yourself short, he may have another family to support but that is not your problem, A judg will make that clear to him. so get yourself an attorny because they know the law, they know what to go after, also if he has a 401k a retirement savings or any saving in the bank you get half of that. so let him go move on with your life and take care of your children ! Remember two important things never allow the children to leave the country till they are 18 or you might not get them back, and dont down grade their dad in front of them, as they grow let them decide how they feel about him, dont sway them or they might turn on you !

Fair is normally 17% of the gross for child 1 and 10% more for each additional child. So he should be paying about 3 times what he offered.

I agree, get a lawyer, you should get half of 401k and other retirement plans and investments, half of all assets and half on the overseas account money. And he should be paying you both spousal support and child support. Get a lawyer, don't let him fool you, his support should be based on income not on what he thinks children need. Also being married for 10 years weighs heavily when it comes to spousal support. Make sure you don't sign anything and don't use his lawyer....

Thanks for the article. I am sorry for the OP situation. It is so sad that the world consist of these kind of persons, but some will go to the extreme for thier own personal gain. My heart goes out to him. I have never in my life been a violent person nor do I even raise my voice. I am a peaceful person that always try to resolve matters peacefully. Two kids expenses can easily exceed that amount. If your means are not to the point where you can provide the proper life for your children maybe they have to settle for less but we are financially stable. A real man would make sure before himself that his children best interest comes first.

I am not or never have I been that kind of person nor will I ever be. I want fair for me and my children. These assets were from this marriage even though my savings was used, it is considered marital property. If you feel Im punishing him for standing up for me and my children, well I guess he getting punish. Even he walked out that's his choice and right but my rights are to protect myself amd my children.

1500. is not fair when the assets gross over 200,000. a year. I have mortage,medical dental vision insurance for the kids , they have to eat have clothing and I should be able to make thier lives as normal as possible. It would require me to spend more time with them than working so the absent of thier father will not be so difficult of an adjustment for them. Taking care of your own children I did not know this was generosity. Never was this about him wanting a divorce but how he went by it. If this was about his up bringing why even marry and have children outside of it. Even if that is the case, no one forced him to marry and have children. Im in the State of Alabama which is an equitable state. I want fair that is all, plus my savings is why we have the assets. Im requesting only whats fair for me and the children. There are many individuals on this site whom are noble and respectable. Many with personal experience, and even law degrees offering free and accurate advice. Some are even immigration attorneys, and some work for the uscis. All walks of life exist here on vj. And I'm sure that you've already offended some of them. I'm not criticizing you. You do what you want. But I don't think you'll get the answers that you're looking for with your attitude.

To lloydboybebop: people on this forum are trying to help you. Please do listen to NikiR and Ryan H. Do not use the I-864a, which is meant for a co-sponsoring household member combining their income with the primary sponsor. In your case, you want your mom to be a joint sponsor, not a co-sponsor. As joint sponsor, your mom will file an I-864 and tick the joint sponsor box in the form. The USCIS guidance on the I-864a is not clear on this issue but trust me, if you want your AOS package to be successful, get your mom to file the I-864 as joint sponsor. It also doesn't do you any favors to carry that attitude on this forum.
