    Do not pursue adjustment of status and cancel the EAD application. She can only do AOS through you or via a VAWA claim. Protect yourself by documenting everything and proceeding with a divorce. Then move on with your life...

    Do NOT spend your time, money, and energy trying to get her deported.....It will NOT work.
    Spend your time and energy distancing yourself as far away as possible from this woman.
    Look into divorce proceedings and start that as soon as possible.
    A scorned filipina can and will be vey hateful and vindictive....She will do anything to bring you down.
    She is a cheater and a scammer....I have seen this before. She probably wants to sdjust status and eventually petition her filipino boyfriend.

    1) Collect all the evidence.
    Make an infopass with your local USCIS.
    Ask to withdraw your I-864, that you are no longer willing to support her AOS.
    2) Protect yourself from false Domestic Violence claims. Never be alone with her. (If you have to move out temporarily)
    Don't be like this guy who took his time to act and was royally screwed in the end.

    I think it's pretty easy to dramatically cut one's chances of getting defrauded by someone out to get to the states. Not eliminate, but decrease substantially.
    At least when it comes to Southeast Asia, the mistake I see people (mainly western men) making is getting involved with women they meet online/through dating services. As someone pointed out up-thread, there are numerous professional scammers who make a bloody good living doing this. I've been to internet cafes in the Philippines where I have personally witnessed women chatting/camming with up to 10 foreign guys at once. She 'loved' them all and probably half of them were sending her money every month.
    I feel it very necessary to point out, I have many, many friends, and amazing in-laws, in the Philippines. As an example of what I mean by amazing: my in-laws let me live with them, fed me, and asked nothing from me, for many months when I had no resources, no job, and no prospects. They aren't wealthy people by any stretch of the imagination, but they've always loved me and looked after me as if I were their own flesh and blood. So this posting is not polemic about Filipinos all or mainly being scammers. To the contrary, all it takes is a very small percentage of unscrupulous and/or desperate, and/or lazy people to make everyone else look like #######. Nearly everyone I have interacted with in the Philippines over the decade I have been visiting there has treated me fairly, at a minimum, and more often have been kind and welcoming.
    I did not meet my wife through a dating site, or online. She had never thought of coming to the U.S., and never found American men terribly appealing. We ended up together despite my being American, not because I am. Now that she's a citizen, we're trying to decide which country we will live in for the next several years. I have qualms about raising our son in a country where all that matters is being forced into being liked everyone else - a cog in the machine to further enrich, and be obedient to, the ruling elite. There may be no absolute escape from that, but at least in the Philippines, I feel like he will have a chance of valuing the love of his family above whatever useless consumer junk the conglomerates are telling us we must possess.

    Definitely on getting the green card, she knew, given the prenup, she wouldn't get his money.
    Since she won't leave and go home, it's obvious she's here for only one reason - she even said she'd leave as soon as she got the green card. That's an explicit admission that the relationship is fraudulent on her part.

    Don't get snotty. Realize your situation of your choosing does not sit well with law abiding US citizens. You choose to break our laws. Don't pass judgment on others wHen you don't know their situations while asking for help with your illegal situation. That takes brass balls.Realize that your only path to a green card is marriage to a USC.

    People like you are why those that are deserving of tourist visas are denied for ridiculous reasons. People that have no intention of being an illegal, and just want to visit, can't get visas because the consular officer assumes they will be like you and slither their way into the United States and stay illegally. How about going home and applying for a work visa?

    I am a family law attorney, though not licensed in Florida. In most states, a prenup can be deemed unenforceable if procured under very one-sided circumstances, or if the terms are extremely unfair. In my state, I would probably be able to get the prenup thrown out. Additionally, the husband could be made to pay spousal support and attorney's fees while the divorce case is pending.
    Your friend should see an experienced family law attorney in her area. Depending on circumstances, there are some who may take the case with the expectation that the husband would be ordered to pay attorney's fees. It's also possible that legal aid is available in her area.

    If you will not or can not put her up she could go to a local shelter. She is not a prisoner, if she wants to leave then leave.

    It isn't that hard to get a job paying 125% of the poverty line. Most decent waitresses make way more than that, for example.

    This brings back vivid horrors of how we and others were treated at Guayaquil -- like fraudulent criminals.
    Hindsight is 20/20... having to do it over again, I'd have not left the place until I got to speak with the Section Chief of the Immigrant Visa Unit (= the CO's boss).
    You say that you're "back home" -- in the U.S.? You might want to turn around, go back to the D.R., and not leave the embassy until you get to meet face-to-face with the Section Chief of the IVU.
    Whether calling or visiting (forget e-mailing), insist on speaking with an American. Play the "USC" card. You will not stand wasting your time dealing with Foreign Service Nationals (the locals who work at the embassy). You are an American and you insist on speaking only with an American, and "anyone who blows me off or fails to transfer my call to a live line or hangs up on me will be in deep trouble." You are indignant and righteous and have every right to redress of your grievances.
    Egad, but this brings back memories that still leave me shaking with anger.

    Some of these points are 'ok,' some are wide of the mark.
    It is not altogether likely she's be allowed to take the child abroad to live. See In re Marriage of La Musga 88 P3d 81, 12 Cal Rptr 3d 356, 32 Cal 4th 1072 (Ca 2004). It's very case by case, per that decision, and this guy lives in California, so that's the correct case law. If he can get primary physical custody, which he needs to step up and fight for, then it definitely won't happen.
    With her making 90K, she would be the one to pay HIM spousal support (for a limited duration, given the short marriage) and if he can get primary physical custody, SHE would be the one paying child support. (IIRC, OP mentioned in another thread she is making more than he is now).
    Getting her deported isn't necessarily the bad idea some seem to think it is. If she's half the snake you say she is, I'd try it, and simultaneously fight for primary physical custody. Make sure you have that child's passport secured, so she can't take off with the kid. You can also get a court order preventing her from taking the child out of the country while all this is being resolved.
    As to the 30K cost, it depends. If she lawyers up, you'd better do the same, so it could come to that. Do you think she's willing to spend that kind of cash? If not, you can both proceed pro se.

I tell you what, since you seem to be so interested in the topic, why don't you have a conversation with yourself about it? You're from Morocco, which adopted significant portions of Sharia law in the past few years. For my part, I have no interest in discussing Sharia, beyond condemning it for its horrible treatment of women. If you want to discuss it further, take it up with someone who cares. Hope this helps.

    I wasn't talking about marriage in Saudi Arabia, I was talking about the legal system there being based on religious dictate, i.e., Sharia law, as opposed to secular law.
