What you were intending to do was fraud. Entering the US on visa waiver or ESTA as you call it is fraud!
What you need to do is file a waiver which has nothing to do with the visa waiver/ESTA. The waiver if approved will lift the ban you got for overstaying last time. Then you can go through with the K1 visa.
And yes you would have to explain your overstay in great detail

When a K1 is returned it's basically dead.
If they only wanted additional paperwork they wouldn't send the case back they would just let you send in the missing documents.

You received your Noa1 a month ago according to your timeline so you won't get any other answer than what you were given on Friday.
I suppose you could ask to speak to a tier 2 because they are the only ones being able to look closer at your case but it's only been a month..

One tip is to apply for both the passport book, and the passport CARD for your child.
Someone here recently had her passport stolen years after becoming a citizen as your child is about to, and it was a hassle to go through the process again.
If she had a passport card in her possession, it would have been super easy to get a replacement passport book.

This shouldn't have come as a surprise really. But in worse case you just have to wait until you have the money. It won't look good but it's not like you will get deported or anything.
Curious question, you said you both get paid, how is it you are working already?

@MorganandMichael: I didn't know every time I make a post I have to state "I'm an immigrant" considering this is a website built to help immigrants. Also, my understanding is when WandY wrote "this vike woman needs to be turned into US immigration" he meant my boss. (On a side note, my boss has been a US citizen for many many years.)
I guess you haven't spent much time navigating the forum. This is a great site for immigrants and those who want to bring their loved ones to the US. However, that doesn't mean only questions about immigration are accepted here. Thus, there are subforums called "Off-topic", "Moving Here and Your Life in America"...If you read my original post you would see that I said I have asked a lot of questions and have always got helpful answers.
