    Good news everyone! My wife did the walk-in, and they took care of her. Apparently it depends on the amount of people there, had it been booked, they would have rescheduled her. She says it was fast, and very few people were there. I am extremely excited that they took care of her because this entire immigration process is stressful. I want to thank everyone who chimed in and gave helpful advice. I need to learn to have way more patience. Having a leveled head through all of this is VERY important, and working on things together is better than going at it alone. Lesson learned!

    I know, but she still has her passport so she has something to show for now.
    Look at the link provided by Reyan, the NY DMV seems quite precise on which documents they want in order to get a State ID/Driver's License.
    They want:
    - a proof of date of birth (the EAD or GC will work)
    - 4 "points of proof of name" along SS Card. (not sure if that means 4 points + SS card, or 4 points, SS card included? someone help me on that one?)
    All proofs of names should show the same name.
    I suggest this plan for your wife:
    - Apply for AOS/EAD (and AP) with her new full name
    - As soon as her EAD or GC is received, go back to a SSA office and update her SS card (with her new full name + to tell them that her immigration status changed). Their system may not be updated yet, but they should make a copie of her card. She will receive her new SS card once the SSA will have verified her EAD/GC with the DHS.
    The EAD or GC counts for 3 points, the SS card for 2 points.
    If they mean 4 points (SS card included), once she gets her new updated SS card, she may go to a DMV office and apply for a State ID (or Driver's License if she prefers).
    If they mean 4 points + SS card, she may use, for example, a US ATM card or a US Health Insurance card as it counts for 1 point.

    Yes, EAD is a temporary work permit (valid for a year once approved).
    Once the green card will be approved, her EAD will be void because the green card is also a work permit.
    I suggest that she applies for AP too (temporary travel permit, I-131 form), it's not much more paperwork to do, and it will be approved with her EAD (the result is an EAD card with an AP note on it). With the AP, she will be able to travel while her AOS is pending. The same way as her EAD will let her work while AOS is pending. Also, applying for EAD/AP is free when applying at the same time as AOS. It will takes 2-3 months to be approved.
    Concerning timelines, you won't find much help. Her case may be chosen to be waived from an interview, and there's no timeline available for those cases. It just takes months (it's long). If her case is scheduled for an interview, you can look at timelines from other VJ members who went to the local USCIS office in your area.
    All in all, it's really difficult to know how long it will take to be processed, as you can't know when filing if there will interview or no. It may be a few months, as it may be a year. That is why it is a good idea to apply for EAD/AP.
    Quite a bit of work to do for you! But the tax part is your priority right now. So, good luck!

    For the people jumping the gun and shouting TAX FRAUD!!!!! Quiet down. I have stated that I worded the OP wrong (which I can't edit). I wasn't the one that handled my taxes ( I wouldn't know where to start). I went to a tax preparer, he looked at my two previous taxes. Told me that the guy who filed my previous taxes (another tax preparer) filed them wrong. Do I know ####### he did specifically? No. Do I have the records? Yes. Have I cashed the checks? No. Will I go back to the Tax preparer to double check (just in case) since some people here have expressed concern the APPROPIATE way? Yes. Most likely sometime next week i'll be able to make the appointment. Would I purposely do anything stupid to jeopardize my wife's AOS? No. Do the checks amount to more than 2k? No. Am I trying to go behind my wife's back to cash a few extra bucks? LMAO ridiculous since they are signed by both. Have I gotten some important feed back from good people on this thread? Yes. I had no Idea my wife could get a state ID/Drivers Licence. I have everything prepared to go with her tomorrow morning to get her state ID. hopefully we don't have a problem seeing as other people who aren't Residents (yet) on this thread have recieved their state ID or opened up bank accounts. Will I now try to open a jointly account with a different bank regardless of the issue with the checks? Yes. I had no Idea banks allowed it. The two tellers I spoke to are obviously ignorant so i'll be speaking with manager.

    although it's a photo,
    this isn't photo paper .
    The visa is printed in it's entirety on a special paper, similar to currency paper.
    The photo inside the visa is a SCAN of a photograph - there is no glossy paper, no photo paper, nothing 'extra' .
    IMO, attempt NO FIX - instead, simply make a photocopy to fulfill the requirements, then make a color copy of the page, and write a letter of attestation outlining what the little darling did to yer visa page.

    if you were to read...the passport was not "laying around" and do you per chance have children? Doesn't sound like it. The OP was asking for advice, not for people to pass judgment. If you have nothing to contribute to help her out, why even comment? I guess you're perfect.

    Well, our 2 year old dughter grabbed a blue pen, and decided to scribble the face/picture of her mother's K-1 VISA! We recently got married, but we have to file AOS. We have to send a copy of my wife's K-1 VISA in the AOS packet. But since her face is scribble, will this be a problem? What can we do? Should we be worrying?

    Never try to remove marks or other blemishes from either a visa or passport. Both are designed to clearly show any attempt at tampering. I wouldn't be surprised if any attempt at repairing it resulted in the entire background image being removed, leaving only the word "VOID" visible.
    The visa is no longer valid anyway. The CBP officer voided it when they put their stamp on it. Just explain what happened. I don't know of any basis for them to deny a green card because an invalid visa has been defaced.

    I wouldn't try to erase it in fear of making it worse. Just explain the situation and I am sure that they will understand, things happen especially with children. To all of those scolding the AP things happen, no need to chastise, it is obvious the passport wasn't left where it could have easily been found. Kids are kids and they always do the unexpected. I think it's sweet that the baby brought her artwork to show Mommy

    For the people asking how a 2 year old child got a hold of that passport, you must not have kids? It was on top of our dresser, IN a small 'travel pack'. Our daughter managed to climb the individual drawers, unzip the travel bag, grab the pen, pull the lid off, and start scribbling on mommies face. Then she went to the kitchen, with the passport in hand, and showed mommy what she did. - Anyways, I can try the wippie option, but what if it gets worse? I dunno, maybe putting a letter next to it, explaining what happened may be enough?

    OP, more than likely ANY attempt to "fix" the photo will result in the reviewing officer thinking the photo has been tampered with. Leave it as is, supply addition photos and confirmation it really is you, and a brief explanation of what happened.

    It's all luck. My petition was at the vermont service center and it was approved in one month. Other people sent even before me and waited over 6 months and their petitions were at california service center. But then there are few petitions that are at CSC for a short amount of time and others at VSC for a long time. IT'S ALL LUCK. And obviously if you make a mistake on your petition or fail to send required documents that will further delay your case.
    If you don't have any patience, you will learn to have it during this process. Wishing you the best of luck.

    I honestly feel the same as you do but the only difference is that it is worse for me because our interview date is in 4 days. I am bringing with me everything that I could find for evidence whether they look st it or not I know that I was as prepared as I could have possibly been. As Steph said the rest is up to God. If they have truly made up their minds before the interview then I hope that we are approved already. I have had no RFE(s) or any problem so far so I am praying that is a good thing. I am leaving for D.R. in 2 days and once I get there my fiance and I will be practicing those questions all the way up to the interview. I don't want to leave any stone unturned. Continue to talk to all the GREAT people here in the D.R. crew because they are who have kept me calm and also kept me from making some pretty common mistakes. We all are really close and we are all willing to help in whatever way that we possibly can to get you to and through your big day. :thumbs: I am praying for a smooth interview for you and that your nerves are calmed more and more.
