If your wife commits a crime while in an overseas command and she is command sponsored yes I can see that reflecting poorly on the spouse as they are expected to be responsible their dependent's actions and she would of course answer to local laws or be subject to early return or dependents depending on the offense. If your CO is vouching for her then he no longer serving his role as a company commander but as an Army Officer who either personally knows her or states that if she fails to comply he will hold you to a certain standard. The reality is she the one applying and will get the visa on her own accord not based on any letter from a company commander. Those letters cannot hurt the process but he/she cannot hold a Soldier responsible for a visa that is issues based on her application. I am much too aware of the attache duties, having been assigned to overseas commands 13 of 22 years and those personnel are helpful but they have very little influence on consulate officers when it comes down to approving a visa.
This is an forum to assist others that going through their visa journey and I like most am trying to be helpful all while wishing everyone a speedy process. I am not one to hand out lessons just provide information and if it helps anyone even better. As stated previously good luck to her and I wish you a quick reunion.

First I apologize that you are in this situation. If you have a video of the abuse, a computer he stole in your possession among other email evidence as stated by others collect all this legitimate information. If your spouse enlisted reporting being married then yes he is entitled to BAH/BAQ only after he applies and birth certificates and marriage certificates are verified by the personnel services battalion. If he does not claim BAH/BAQ it is not automatic he has to provide civil documents. A Commander can only force him to take care of her and any children born to him and perhaps step-children if court ordered.
There are resources available to you as his wife, go speak to a chaplain they are obligated to do something. If his actions are criminal the Chaplain will call CID (criminal investigation division). You can hand over all your evidence to them and CID will contact the Commander. Last resort do a Congressional that pretty much forces the Commander to reply to the Congressman on the issue. It gives the situation visibility up the chain of command plus all responds to the Congressmen have to be complete within 14 days. If your intent is to stop his criminal activities then yes pursue this otherwise I would never recommend revenge it will not address the pain you feel. If it is not addressed, he will offend again in the military they always do and their past catches up to them, this is 22 years of military experience speaking. I have seen so many cases at some point they will need a clearance and the truth comes to light.

First my condolences for your loss, from looking at your timeline you took over 15 months after your wedding to file and you were approved at USCIS since Jul 12 why has it taken so long for you to submit the paperwork? It took me 1 month and I closed out all requirements with NVC and then waited two months for the interview just to be placed on AP for an additional 2 months. I get it it bites to wait so long, we all did the waiting game 13 months before my hubby came home but you cannot be mad at the system for not being prepared. I think you are blessed that your sister found it in the kindness of her heart to sponsor him. It is not her responsibility to take on it is yours the delay is your responsibility for not being abled and prepared to take this journey. I calculated at least 18 months of lost time on your clock and now you are mad because people cannot make it to work to take your call because of a storm?
I am not trying to be mean, just stating the facts sit back reflect and really think what you could have done to speed up the process. So at this point you are either more irritated by my comments or can relate to the facts. It is not an easy process but realize you are almost done frustrations will only get the best of you and yield no results in getting your hubby home quicker.

You get a letter of employment from your commander, I wrote these for my Soldiers all the time for VA loans and immigration documents. Just give the commander or the admin personnel everything that is on the information request or they can confirm by looking unit commanders finance report. The commander is just confirming that you are indeed serving on active duty and make sure you include your Termination of service date or if on indefinite duty state so. You can also include a copy of your DEERS form to prove you added your wife to your military records as a dependent.
The letter of employment is printed on an official Department of the Navy letterhead and coming from your commander is more official.

He should not add her to DEERS with the fake SSN there is no need for this, he can request a foreign identification number that is issued by the ID card section and can be used to file taxes and draw benefits like basic allowance for quarters (BAH) on the other hand if he adds this fraudulent information about his dependent on his official record he is opening up a can of worms that can all be punished under UCMJ, BAH Fraud, if he gets assigned overseas she still has to have all her immigration records straight. He needs to do things legally, his commanding officer can help make this happen but doing thing on his own and illegally will only result with the CO exercising his command authority and in accordance with regulation it will not be in the sailors interest.
If he is your sailor take care of him and afford the commander an opportunity to assist his family.

I will say we all went to Morocco and managed to marry our husbands with no issues I am certain if we ever decided to move to Morocco getting a visa would not be an issue. If you know anything about being married to a Moroccan is that we Americans gain some civil benefits from being married to them. Please focus on your task at hand our hubbys are here already so it's safe to say some of us got the process right.

There is only one way to find out if he will be approved and that is to apply for the petition. The advice given here is very accurate but when a person is in love and determined they will do as they wish. Unfortunately, being confident and having money does not guarantee anything with this process when dealing with Casa consulate. I have seen countless of married couples be denied after having met all the requirements much less a K-1 visa. For those of us that have come before you all I can say is prepare him for what he will experience and much of the preparing only comes from the shared experiences from members of this site. Don't take anything personal just extract what you will need to set him up for success. As I have told my 20 and 22 year olds, sometimes we have no clue or are aware that we don't know something.
We wish everyone here luck, take what you really need from all this advice, even if you don't know.

Not sure why the reference to the flag, and most of the people replying are American not Moroccan. It seems Sunrise USA and green card 2013 are the two accounts created by the husband and wife. Green card 2013 would use the same pattern of asking the same question in different ways. She is pregnant awaiting her priority date in April also at the NVC stage. They know the interview timeframe due to their priority date. She dropped off and the Sunrise USA started posting initially claiming to be the male LPR in the USA then the male in Morocco awaiting the visa and having the pregnant spouse in the US. I think they are both using the same account answering at different times confusing the gender references. If I understand it correctly he is the LPR she is pregnant in Morocco and they are just trying to get through NVC stage which has been ongoing since Jun which is a lot longer than the 35 days it takes most to close out at NVC. At any rate whoever is the LPR and beneficiary does not matter good luck on your journey.

They are not in your custody thus not in your household count and you are correct since you don't claim them on your tax return they are not your dependents. Don't include them the affidavit of support has to match the tax return.

They apply for the tourist visa at the consulate not you, if they can prove strong ties to Morocco (bank accounts, assets, business) perhaps they will get a tourist visa.

Your case has taken a while to process from the time the NOA2 was approved these questions and what procedure to follow will depend when your interview is scheduled and when a visa is issued. You should try to close up NVC requirements as soon as possible so you can have the interview and visa issued before you are no longer allowed to fly (normally before the 7th month) otherwise you will have to wait to travel after the birth of the child and then have to deal with waiting for his/her birth certificate and passport before you can apply for the immigration visa. Last time you asked this question someone told you that the child could travel on your I-130 which sounds like the follow-to-join benefits. Your best bet is to call the consulate and just ask. Look up their number under the state department website.
