I-864 question

Hello VJ,

I have a question regarding filling out the houslhold count part of I-864 form.

in question 21 where it asks for Household size under " Person NOT sponsored in this affidavit" option "E- if you have dependent children, enter the number here".. I have a child from previous marriage , he is living with his mom and I pay her child support, will I include him when answring the question above?

Do you claim him as a dependent when you file your taxes? If yes, then yes, he is a part of your household and needs to be counted.

I think, I have read this answer from you more than once and it's some what incorrect. Even if they are divorced and he would only have part time custody 2 days, etc. a week, he still has to include this child on the i864 even if he does not claim his child as a dependent. I didn't claim my child as my ex husband claims her yearly, but I still had to file her on the i864.

Where did you find this info or link pertaining to your answer...?

Any biologically child where your parental rights have not been terminated is fully dependand on you. Any adult child or step child that you are not legally bound to support but you choose to support out of love is partially dependant under the theory you could stop the support with no legal issues.

I'm sure you didn't read the answer from me before since I've never given it before. I don't remember where exactly I read the information but I remember seeing it as a rule of thumb here on the forums many times. If it's wrong I do apologize to the OP and it's nice to have a community where we can correct each other. You'll always get the right answer here...eventually.
