    Let see my clothes are washed every week. All my clothes are neat and crisp. My house is spotless. My Job is high paying, I believe I am very intelligent and hold a high position at my company for 16 years. My family loves me and my wife loves me. Lets see what else.... I travel the world, provide savings for my niece, nephew, little sister, my wife's family and my self. I pray to GOD everyday. I am kind to others and give respect when respect is given. Mmmmmm I think I have a good self-esteem!!!
    Yes all of us in this world have flaws and weaknesses.. If you believe you don't then your in a dream world or denial.
    I have watched healthy runners, health fanatics, vegans etc... Die before me or fell ill for sickness from everyday normal living. At least I admit to what is my flaw..!!
    It amazes me how if you met me never knew I smoked and was the greatest person in the world to you or others but one day you see me smoke. You hightail it and run for the hills SAD!!
    That is why I treat those that don't judge and make presumptions with the most respect and generosity of my heart and mind.

    In your case - with the visa in hand, you get the sticker the same day. If there is no visa at the time of the counseling session - you get the certificate which allows you to get the sticker upon presenting a valid visa together with the certificate.

    Great post Crashed...
    My Wife is exactly that and she just happens to be from the Philippines. I've had a hard time with some of the posts discussing Filipinas as they're children. The patterns almost always is something like:
    Older white guy with a failed marriage or 3 hunts a child bride in the Philippines (usually because he believes he can control her or something like that).
    He treats her like a spoiled child through-out the K-1 process and throws every extra cent he can scrape together at her.
    Once she arrives in the US he either expects her to instantly be the perfect wife and shed the childish mannerisms that he had previously encouraged or he gets upset because she expresses an opinion of her own.
    When things fall apart it's because she scammed him!
    I'll admit my wife is 27 and I'm 42. I'll admit that she has at times acted immature. But I've never treated her like a child and I've always expected her to be my partner in our marriage and life together.
    I do think at least one of the persons here using the term "Filipina Unit" does it tongue in cheek and that doesn't offend me.

    No we are not.
    You are saying if a K-1 entrant married within the 90 days then they never accrue unlawful presence.
    The truth (and what I'm saying) is that the K-1 entrant will accrue unlawful presence if they don't file to AoS within the 90 days. This is almost never a problem though because the overstay is not an issue once they do AoS as the spouse of a US Citizen.
    If the K-1 entrant leaves the US after accruing unlawful presence without have filed AoS (and receiving Advance Parole to prevent them from abandoning their AoS Application) then they are subject to the same bans as someone who overstays any other Visa.
    PS: Please note that Advance Parole protect you if your overstay triggers a ban.

    Globe-trotter, me thinks the don't understand shoe is on the other foot...
    I'm not going to type the same info 200 times, re-read my posts.
    Regardless of what Visa you enter the US on, once the I-94 expires you are out of status and begin accruing unlawful presence unless you either adjust status or entered on an immigrant Visa (which the K-1 isn't) and were issued a Greencard (obtained LPR Status) upon entry.
    The overstay isn't a problem when adjusting status as the spouse of a US Citizen.
    Meeting the marriage requirement doesn't prevent the unlawful presence, it just allows the K-1 entrant to Adjust Status based on the K-1 entry.
    You must have legally entered the US in order to adjust status in country and the K-1 entry as 2 limitations to this:
    1) You can only adjust based on marriage to the original K-1 petitioner.
    2) You can only adjust based on the K-1 if you married within the 90 days of the I-94.
    So a K-1 can marry the petitioner within the 90 days and AoS 2 year later...
    or
    Marry the original petitioner after the 90 days and AoS if they also file an I-130 petition with the I-485.
    They can't marry someone other than the K-1 petitioner and AoS as the K-1 entry is only considered a legal entry for AoS if the marriage is to the original K-1 petitioner.

    The short answer is No, you need a Visa to enter the US, either B Class or immigrant. You no longer qualify for VWP because you did accrue unlawful presence in the US.
    I'll try to explain it again.
    The K-1 provided you with 90 days of lawful presence. You are required to marry within that 90 days in order to be able to Adjust Status to LPR based on that K-1 petition. If you marry after the 90 days then you can still adjust status just not based on the K-1, you would then need an approved I-130 Petition (but you could still only do this if married to the original K-1 petitioner).
    Once your 90 days is up on the K-1you are "Out of Status" and accruing illegal presence until you file to Adjust Status.
    If you file to Adjust Status after the 90 days of your K-1 you are not penalized for the overstay, in fact Spouses of US Citizens are never penalized for overstay when adjusting in country.

    Yes you did overstay.
    When you entered you were issued an I-94, that gave you 90 days of legal presence in the US.
    You must marry the K-1 petitioner within that 90 days to be able to Adjust Status to LPR based on the K-1 entry.
    Every day after the date on your I-94 that you remained in the US is one day of unlawful presence, you overstayed. The only question is by how much?
    You could AoS anytime, there is no requirement that it be filed within the 90 days.
    Also, FWIW, you didn't abandon your K-1 you used it as intended.

    The NVC does not deal with K1 visa applications. They receive them, assign a number, and immediately send them to the embassy, which takes care of collecting all necessary supporting documents and fees.
    For IR1/CR1 visa on the other hand, the NVC opens the case, collects the fees, and requests forms and documents. Only when they have decided that the case was complete do they schedule an interview and forward it to the embassy, basically just for the interview. This is called NVC document intake.

    Co-sponsors are rarely allowed as USEM and if they are, it is usually by a primary sponsor who has very good job prospects (such as a recent graduate). With pension, do you mean a disability/ retirement pension, ie your income is likely to remain the same or go down in value, never up? If so, the chances of a co-sponsor being allowed are very slim. Do you have any assets (savings, stock, second car etc) you could add? Another option would be to get married and file a spousal visa, co-sponsors are allowed for that.

    I agree with Vanessa and Darnell. Screw the mediator. You don't have to pay a nickel unless and until a judge orders it. You don't have to agree to the terms the mediator recommends.
    You don't need advice on a public forum. You need a vicious divorce attorney. It will be the best investment you ever made.

    Darnell is right. The mediator is wrong. The I-864 HAS been used for support but it also has been ruled invalid. In the event the I-864 IS ruled.. her income will offset the amount you pay, as does the children's income.
    She isn't eligible for Section 8 because it's a means-tested benefit. If she does by change use it then you will have to pay back the government (THAT is the true purpose of the I-864).
    You don't need to pay for her apartment. You don't need to pay for anything. I advise you to leave her in the apartment and stay with friend in the meantime until the divorce is final and settled. If the lease ends in the meantime she finds her own place to rent. If she wants to stay in the US this is her job, to earn money and support her children. She needs to learn to look after herself.

    The Mediator is wrong.
    The I-864 is a contract between YOU and the USGovernment,
    not anyone else.
    Once she starts using Public Assistance, the bill accumulates back to YOU from the FEDS.
    You pay it, ever so often, back to the FEDS.
    I'm thinking the mediator was biased ..
    Also, IMO, the fodder you've collected for ICE should be great stuff to use at the divorce hearing, in an effort to minimalize, if not set to ZERO, any concept of alimony.

    You need to listen to yourself and look at your actions. How can you file a report with ICE when YOU agreed to marry your wife ONLY for her & her kids to get GCs? Sir you were an accomplice, I'm surprised that you didn't get in trouble.
    Anyway, as I said, you and only you got yourself in this hellhole so you better get professional legal advice to see how you can mitigate your financial obligations to your wife and step kids.

    Ok, if you are flying from the US, most airlines fly in and out of only one airport Manila, if they fly to Cebu it is ALOT more expensive.. I would love to fly into and out of Davao, I really would. But it is at least $500 more expensive to do that and I waste more time. The best bet for you to do is what I do. Book a plane ride from ORD to MNL, then a seperate one from Manila to Cebu. That's what I do, and it hasn't gone wrong for me yet.
    Be advised if you do that for your fiance. Philippine Airlines will require a photocopy of the eticket, a photocopy of the credit/check card used, and a photocopy of your id if you paid for it. It sounds a bit much but I nor my fiance have ever had a problem with it.

    If he loses his job due to the chooses he made by Assaulting you.. So be it!! Hard lesson learned not to put his hands on women.
    Love in nurturing and caring. Arguments can be worked out. Misunderstandings can be figured out to be understood. Cheating and Violence only leads to the door and the end. You gave him chances and he has returned the favor by continuing to cheat and then beat on you.
    Take it from a man telling you this. Leave and leave fast.. People like that need therapy, jail and losses to learn and become a upstanding representative of himself. Right now he needs a hard lesson.

    You will now pay for you the fiancé I-129f petition there in Philippines. Fee is U.S. $350 / P15,218. Send a little extra as it is bases on current exchange rate.     If your fiancé passes her Medical They will give her a date to come back to SLEC and get her results and medical will CD of chest X-ray
    On the interview date she will have a time most likely 6:00 - 6:30 AM to be at the Manila USEM. She needs to have all her required documents in hand, appointment letter, and passport. Again refer to K1/K2 Interview Preparation Instructions as for what is needed. Make sure she has all papers organized. It makes for a easier processing at the embassy and shows seriousness. Buy a organizer with tabs. Label the tabs for each requirement.
    Once at the embassy, she will fall in line. They will take her appointment letter, check passport and assign her a number. At the embassy they don't allow any electronic devices.
    You are not allowed to enter the U.S. Embassy/Consulate while carrying any of the following items:
    battery-operated or electronic devices such as mobile phones, digital diaries, digital watches, pagers, cameras, audio/video cassettes, compact discs, MP3s, floppy disks, laptops, or portable music players
    large shoulder bags/purses - only bags that can be carried by hand will be permitted
    bags such as travel bags, backpacks, briefcases, suitcases, leather, cloth bags, and zip folders - you can only carry plastic bags containing application-related papers
    food items (refreshments are available for purchase in the waiting area)
    sealed envelopes or packages
    cigarettes, cigars, match boxes, lighters
    sharp objects such as scissors, pen knives or nail files
    weapons or explosive materials of any kind
    If she needs her cell phone they will ask her to check it in at the security section. They will give her a card so she can retrieve at the end of interview.
    They will give her a form to fill out on how to deliver the passport with visa. Either it's deliver to her home address or she can go pick it up at a 2GO location.
    Once inside, she will need to look on the board for her number to be called. She will go to the window and ask for her paperwork. Then she will be finger printed. They will tell her to wait again. Once her number flashes again, she will have her first interview with Filipino consulate. They will ask her a few questions and check and process her documents. (MAKE SURE SHE HAS ALL REQUIRED DOCUMENTS). If all is in order she answered all questions to satisfaction. She will then wait again for her number to flash again on the board. Then she will have her final interviewer US consulate. Consulate will process her paperwork and ask a few questions. If all is in order she will be told to wait again for her number to flash. Then she will go to the 2GO window where they will take her passport. They will give her a receipt (make sure to ask if they do not give one).
    That's it for the USEM interview. You can now breathe a little easier.
    Now if there is a problem. They will give a 221g form and state what the issue is. Now you will need to get them whatever they want in order to proceed. Now this is pull a long process when your in Admin Review. Look on VJ for Admin Review stories.
    It will take 5 - 10 days for 2GO to receive visa and passport from USEM.

    Once you have received your passport with visa. Now its time for CFO (Commission on Filipinos Overseas). Now CFO seminar can be done in the beginning before obtaining the visa and passport. You will need to return to get the CFO sticker and Stamp in the passport after receiving the visa passport upon approval and delivery.

    The quote above is from the section where they are talking about getting married in the Philippines. However, the CFO has been known to require parental advice or parental consent from K-1ers.
    It's all on the Consular's discretion whether they require consent from a parent or guardian.

    I just wanted to share my experience with you all. I just returned home from a week long trip to the PI. My Fiancee met me in Manila and we then journeyed 9 hours from Manila to her Province in Bicol by bus. Spent 4 days there meeting her parents and family, sought their blessings, bonded with relatives, and just to take in the experience of her home. Being outside of Metro Manila was also a change of pace I really enjoyed. Great trip. Wonderful family as I expected, Fantastic food, and memories for a lifetime.
    Thanks for all the advice I got here on VJ prior to my trip. The Pasalubong ideas were great, even though the extra suitcase fee cost me more than some of the gifts I brought. Damn airline merger (talking about the largest airline in the world based in Chicago). Anyway, here's what I learned that might help you...

    Long bus rides generally don't make many stops for CR
    Bring 5 Peso coins with you for the use of CRs at the Sari Saris you do stop for
    Towns in the Provinces are generally cash only with few ATMs (if any)
    Chocolates are always appreciated. Hard candies for kids
    Little to no water pressure can be expected. Shower with a pail is often the means or pumping your own water
    Do not refuse food offered and never show you don't like what you've just tried
    Trikes are small! At 5'10" I could barely fit in the side car
    Power/Water outages are not uncommon
    Have a night out or two with Titas and Titos and foot the bills

    Most of all...

    Be courteous and respectful
    Don't act like the foreigner who's there to own the town
    Talk and plan things through with your Fiancee to see if your intended actions are acceptable
    Don't go around flaunting you have money. It's disrespectful and could probably get you into trouble quick

    For those of you VJers who have not visited their Fiance(e)'s province/home town, you are missing out on the opportunity for the family to meet you and get to know you. Most especially it gives them an opportunity to ask questions to you and for them to understand the whole K1/K2 Visa process. I had the impression that my fiancee's family thought she would never return home to the Philippines (which I dispelled). Going there was a win win situation and it turned out to be fantastic. I really want to go back again soon. That's how much I enjoyed it.

    Not sure on the first time, but the second time, you either missunderstood something or your hubby is not telling the truth. There is a spousal visa for less than two years, the CR-1, and for more than 2 years, the IR-1; the process is exactly the same, the only difference is the one letter in your visa in your passport.
    When was your visa supposedly denied? Ie at interview, or by letter? There is no such thing as denial by phone call.

    It was probably just the letter from the embassy telling you they have received the file from the petition, like said everything is done online.
    If I was home I could post you links to everything. You go to BPI with the passport and MNL # to pay the visa fee then wait half a day (we waited a day) then go online to schedule your interview.     You will now pay for you the fiancé I-129f petition there in Philippines. Fee is U.S. $350 / P15,218. Send a little extra as it is bases on current exchange rate. Cash payment at any Bank of the Philippine Island (BPI) branch. Just go into the branch nearest to her and tell them you are paying for K-1 Visa application fee. They will know what to give her to fill out. If she is unsure on what to fill out ask the staff there to help her fill it out.

    Income taxes are not paid through an employer (unless wages are being garnished for the payment of back taxes) and any money withheld from the employees wages is determined by the number of deductions or exemptions claimed on the form W-4 at the time of employment or at any time the employee decides to change the number of exemptions.
    The filing of (form 1040) taxes is strictly the responsibility of your husband, the company plays no part in that. Filing back taxes are not that complicated if the company will provide your husband with duplicate W-2s, your husband can get the appropriate form 1040s for each year he needs to file the back taxes for from the IRS or from an accountant/tax preparer. If his taxes are complicated with lots of "Itemized Deductions" then an accountant/tax preparer would be highly recommended. Even if your husband does not have lots of "Itemized Deductions" the use of an experienced tax preparer or accountant would be wise considering the several years of back taxes that need to be filed and the enormous interest and penalties that have accrued.
    An accountant or an experienced tax preparer would be worth ever penny if they can prepare returns where the government owes your husband money and not the other way around. Otherwise, the interest and penalties can be expensive. No need for an attorney, this is not a criminal matter.

    Hello everyone,
    My now wife came from the Philippines last summer. Before she came to USA, I was a bit nervous about her getting home sick. I leave home to work early in the morning and come back early in the evening. I read so many stories here in VJ about HS and that really got me worried. In my area, I didn't know any one from the Philippines before she came here that was worrying me a bit more.
    Good thing these days we have FB, EBAY, Yahoo-messenger, skype, and so on. It makes it easier for her to keep in touch with her family and friends back in the Philippines. (Ebay ?? continue reading and you will understand)
    She is young but she likes to work. She likes to feel useful and busy like many of the ladies here. She is a strong believers that people need to find opportunities no matter what the situation is (That is a beautiful positive way to look at things).
    She also knows there is only one income in the house. I don't own my business. I am a 9 to 5 employee.
    She has about 8 months in USA. About a month after she came to USA, she told me she needed some money, I jokingly said, why? do you have a date?. She just smiled at me. She then explained that since she didn't have working paper, had so much free time on her hands, she wanted to make a good use of that free time. Instead of going through depression and things of that nature. She always was thinking of a way to utilize so much free time. Seriously guys? how much cooking and cleaning can some one do in a day?
    After she explained to me, I told her not to worry that I was going to give the money she wanted. She looked at me with her eyes wide open "REALLY". (The amount was very low. Wait she keeps on thinking of dollars to pesos conversion)
    Suddenly, everything changed. The empty closet we have in the house is no longer empty. Her desk is no longer occupies with decorative items but with folders and receipts and things like that. The land line phone is no longer collecting dust because lack of usage. She started a very very very small online business. With one customer/person. I meant we are talking about $75 or $100 profit not much but it is something to keep her busy. My friends tell me to keep supporting her and let her continue do what she is doing because she is happy like that. She looks busy which is something pretty good. What happened next? That customer/person told another person, that other person told another person, and the wheel still spinning & turning. (Who will complain about free ads?)
    I thought she was going to spend her profit on daily things that we really don't need. Instead, she opened a little store in the Philippines and hired those members in her family who don't have a job. She has few more ideas but they are on baby steps now. But knowing her, she likes to walk the talk. I need to admit, I am learning many things from her. She is a lot younger than I am. She is in her mid 20's.
    I am so happy for her. I know for many of you that is not a big deal. For her, accomplishing what she did in less than a year, is a big deal. I think she found one of the formulas to ease the feeling of staying home alone during week days.
    On a personal note: I thought she was not going to survive more than 3 months in USA. I was always thinking how could I pull a rabbit under my hat and makes something good out of the first few months. I did not have do anything. She managed to come up with some ideas.
