    Haha, I think that's more of a major city vs. small town thing. There's no difference in price from Chicago to Montreal!
    But I (the American in this relationship) am trying really, really hard to be sensitive to my husband's fears and worries about moving to the US. Perhaps this doesn't apply to all American spouses, but part of what makes it difficult for me to sympathize is NOT because I think the US is the be-all-end-all; on the contrary, I wish we were moving to Canada. It's rather because I (and a lot of Americans, I think) am not attached in the same way to where I live or where I'm from. My parents moved 700 miles from their parents to raise my brother and me, I moved another 125 miles away from them for college/the rest of my life, and they have since moved back east, now almost 900 miles away from me. We* have always been super mobile: a twelve hour road trip to see our families is nothing to me and my friends. My husband, by contrast, grew up about 20 minutes from his grandparents/aunts/uncles/etc. and has lived within a two hour drive of his extended family for his entire life. I can understand missing some things about a place where I once lived, but I can't quite understand all of the anxiety my husband feels because I know he has me and other friends here, and because I know this is a great place to live, and I know he knows that from the time he has spent here. Even while I'm trying to be sensitive, I still can't help but think his fear is more about his lack of experience in moving around than it is about crossing a border.
    Anyway, I just wanted to pipe in to say that's it's not always insensitivity or hubris about the amazing lifestyle in the US.
    *And I hesitate to say "we" because I know this isn't the only American experience, but it's mine and one I share with many people my age.

    I think what people are reacting to is less than he is canceling a petition and more that he has canceled a petition SO RECENTLY that he hasn't received or sought confirmation of it being canceled, and he already has plans to marry another woman in just over a month. It appears as though he must have met and pursued that woman while he was already petitioning for another.

    Um, you might want to rethink this. Marriages that are legal abroad are also legal in the US unless they violate US law, in which case your original petition wouldn't have been approved and gotten to the NVC. From the info you've given here, you are still legally married in the eyes of the US government.

    Yeah, the bottom line is that if you are married to two different people anywhere in the world you'll be barred from getting a CR-1 visa. They'll obviously know because of the prior I-130 petition. Honestly, you sound like you're engaging in immigration fraud, so don't expect this to turn out well.

    This is completely incorrect.
    The US citizen husband can receive food stamps and Medicaid. The child (when he/she is born) will be a US citizen entitled to food stamps and Medicaid. The LPR spouse is not eligible for food stamp or regular Medicaid for the first five years in most cases. The LPR spouse is eligible for emergency Medicaid (such as emergency delivery).
    The signers of the I-864 agree to reimburse the US government if the immigrant receives a means tested benefit. This applies only to reimbursement for benefits used by the immigrant. The US citizen petitioner can still receive food stamp and Medicaid.

    1. The length of time allowed in the country (affects filing time).
    2. The fact that someone on a VWP has no recourse if denied. (They waive their rights as VWP entrants.)

    Canada is't a visa waiver program, they fall under the Western Hemisphere Travel Initiative, which have different rules all together. CR-1 doesn't adjust status. If that was the case all Canadians would be coming here and not leaving during the process.
    If he overstays the six months, when he goes back to Montreal for the interview, and then crosses back, they are going to see he overstayed. It will then be up to the CBP officer to let him in visa or not.

    Just a point of clarification.... Canada is not a part of the Visa Waiver Program.

    Nope, he shouldn't file as single. He should file "married filing separately" or "head of household" if he has dependents. He is not single.

    Yes, he can file jointly, but ONLY if you get an ITIN, which means you have to submit your passport to the right authorities for verification, fill out and sign a W-7, sign the tax return itself (a joint 1040 needs to be signed by both spouses), and sign a letter saying that you want to be treated as a resident for tax purposes. That means any of your income abroad will be subject to American taxes unless you have it excluded by filling out a foreign income exclusion. None of this can be done electronically. All of the paper forms have be mailed to a particular IRS processing site in Austin, Texas. Since the due date for taxes is just over a week away, your husband should probably file separately and then amend to jointly when you get here. Otherwise, he's going to have to get an extension.
    There are tons of forums on VJ discussing all of this, so do a search for them for more information.

    You can drive in all the states with any state's license, but if you move permanently to a new state, you have to get a license from that state.

    I don't know if the OP is actually still reading the responses here or not . The last thread he is shown to have been reading here is one with the charming title:

    Seems to me the plan is to soldier on regardless. To lie at the interview, and attempt to get what he wants regardless of whether it is legal, or even possible, or not.
    I take a little comfort really, in the knowledge that he is going to be interviewed at a very tough embassy in a known high fraud country. With even a modest amount of luck on behalf of those of you making a genuine effort to successfully obtain a Visa out of this place, it is my profound wish that they catch him outright lying to them. I hope they toss his behind into infinite AP. I hope he gets denied, and revoked.
    It wasn't a week before. He was posting and asking similar question in early February.

    The question on the tourist visa application was not "do you have an ongoing relationship with someone?" but "do you KNOW someone?" So YES, you are expected to list your ex-bf and other people you KNOW. Not doing it is misrepresenting the facts.

    Well, I'm sorry but having an ex-bf in the US is knowing someone in the US. So you lied on your tourist visa application form by saying you didn't know anyone there. Had you told the truth, your tourist visa might not have been granted, which makes this lie material misrepresentation.
    This is going to cause you trouble in the future, as in, you'll probably never be able to get a visa to the US now.
    They don't care about "appropriate" or "we had broken up" or any of the excuses you are trying to find, there was a simple yes/no question and you decided not to give a truthful answer, I'm afraid you're now facing the consequences.
    The number one rule is NEVER lie to a consular officer or on an application form.

    Sorry but provoking people isn't fun, nor is it polite/mature. If we are all stressed out, maybe we're coming in here to relax/get answers/feel BETTER...not worse. And for the record, every time I see you ask about "where's my interview date" I want to punch my computer...I have been waiting for two weeks for an invoice that EVERYONE ELSE gets in DAYS, but that's less important than your interview? Nope. We're both just as important to the people who love us and are waiting for us. So play nice.
