Everyone here can relate to what you are feeling, understand that. yes, some may think you are being redic by complaining now, but also, place yourself in those persons shoes who have waited 6-10 months for just NOA 2, or even better yet some of my great friends who have suffered the HORRIBLE AP for YEARS!..yes, YEARS!
In all honestly, you are in charge of your own happiness. if you are not happy, and bored with life in general, make a change! go get a job, take walks, make new friends. no one can tell you what to do, or what to not do. I just suggest finding a hobby, anything. Clean houses, Clean yards, make scrap books for your husband / Fiancé. possibilities are endless. again we ALL feel your pain!

Wow. I'm REALLY sorry that this has happened to you, but before taking time to feel sadness, you NEED to PROTECT yourelf.
1) If she has an ATM card to your account - shut it down.
2) If she has passwords to any of your bank acounts, email accounts, ANY acount - change them immediately.
3) Send a letter ASAP to USCIS and notify them of the course of events. This will protect you against her saying you were abusive. She can not apply for VAWA but she can allege abuse and you'd have a diffiult time to ever petition someone else if you decided to.
4) Change the locks on your doorss. She has abandoned the premises but if she decided to return tonight and just enter your place you'd be powerless to do anything about it.
5) Do NOT be alone with this woman if she contacts you. You could be set up for a potential abuse allegation.
I am so sorry that this has happened, but it could have been worse. You could have married this woman and thing could have become very difficult for you. Time heals - believe me when I say this but for now concentrate on protecting yourself.

A K1 who marries after 90 days is still eligible to adjust status. They just aren't eligible to adjust based on the K1. They'd need to file an I-130 with the I-485.

I wouldn't stay with someone who cheated on me and I would return to my home country... but that's my personal opinion.
Yes if your AOS isn't approved you will be deported as you have no status. You need to be in a relationship to have that approved.
Don't make your life decisions based on immigration. Stay with him if you want to stay with HIM not because you want a greencard.

In most states she would be entitled only to half of the marital assets. Any assets each spouse owned prior to getting married are usually considered the separate property of each spouse. Marital assets are assets acquired during the marriage. It may also include an interest in assets partially acquired during the marriage, such as equity in a home if mortgage payments were made during the marriage from marital income, or a share in a retirement account for contributions made during the marriage, etc. Most states allow the spouses and their attorneys to hash out the property settlement. It's unlikely she'll get half of everything he owns unless he owned nothing going into the marriage.
Few states award alimony anymore except in cases of long term marriages (e.g., ten years or more). Most states don't order spousal support in cases of relatively short term marriages (e.g., less than five years). The difference between the two is that alimony is paid for life or until the recipient remarries, while spousal support is paid for a fixed period of time. The affidavit of support is still enforceable. If she's got a mean streak then she could always try suing him in a civil court, but those cases have also had mixed results.
He should hire the most vicious, evil, twisted lawyer he can find. He may not like talking to a lawyer like that but his wife will like facing him in court even less. If he hires a likeable milk toast of a lawyer then he's going to get steamrolled in court.

It shouldn't affect it, being from a modern/low-fraud country like Japan. She will have to disclose it, but she did the right thing, she did not get married, and so left the US. That evidence of following the rules will be a big plus in their book!

I believe that after NOA1 there should be NOA2 and then 'post decision activity' though... have you received your NOA2 or a letter from NVC?

Nobody here says it's mandatory to file for AOS before the I-94 expires. Everyone acknowledges that there is no time limit. People here do strongly recommend it because the K1 visa holder is out of status when the I-94 expires - a sort of legal limbo in which they can't work, can't get a Social Security Number (unless they already have one), can't get a drivers license or state ID, can't go to most community colleges or universities, can't travel outside the US and return, can't get within 100 miles of the border with Mexico or risk a confrontation with CBP, and the list goes on. In other words, they become a non-person.
We waited a few extra months to file the AOS applications for my wife and step-kids. We knew the risk and consequences, and we accepted them when we chose to wait. Anyone else making the same decision should also understand those risks and consequences, and should also be willing to accept them. What we see, all too often instead, are people saying "I can't afford the AOS filing fees right now. Can my K1 spouse start working so we can save up some money?", or "Why can't my K1 spouse get a drivers license? How will he/she be able to work so we can save up money to pay for the AOS?".

Visa is only for entry.
Day0 -->Day180 (Validity of K1 Visa) means she can enter US on any of the day between day 0 and day 180. So lets say she enters Day152.
Starting day152 you will have 90 days to get married and file for AOS.

I was about to get in the shower, I missed K's call cuz I did not hear it ring. I figure, I'd call him back if signal permits... no big deal. A text comes through saying they made a decision. OK now I'm nervous & praying [in shower] please do not be a RFE I can't take anymore LORD! Please.. it's Holy Week! LOL LOL... me yanno... . I made myself calm down and when I finally checked the uscis site, then it said they mailed our Approval on April 13, 2011. I checked my email and then I got this:

I just got to see Kadir on the WEBCAM for the first time in 7.5 mos since he's been on AF base in Iraq!!!! He looks a little bit fuller in the face... all that American food I guess. I just couldn't believe my eyes... he's so so handsome.
Really missing each other now more than ever. This is very different from the rest of you who get to see your Askim everyday on cam. Military doesn't allow civie contractors for security purposes. OMG I have never been so so grateful for just those few minutes today.
