Husband caught cheating/AOS pending

Hi All,

I am in a dilemma. To make the story short, i just found out that my hubby has been cheating on me from December of 2010. I am so sad/depressed/shocked/mad/frustrated.......Now problem is my AOS is pending from September of 2010. We have tried contacting everyone we could think of from senators to congressman, to infopasses to CIS Ombudsman. No answer yet. No RFE yet. No nothing!

What do you think is going to happen if my husband and i separate?????? We had a very bad argument about this and as of right now we are not on good speaking terms. Nobody has moved out yet. This just happened this past weekend. Am i going to be deported if we separate/divorce????? Should we seek a marriage counsellor???? (Though i know my hubby would never agree to do this). What should i do????? I trusted my husband 100% and now this, i dont know what to think/do anymore. I seriously do not know if i can trust him again. Do not know if i can forgive him. What if he does this again??? What if he brings me diseases?????? How about immigration??? We have only been married for 16 months and for the most part i can say the marriage has been pretty good.

AOS Timeline:

June 2nd 2010- Filed for adjustment of status

June 16th 2010- Biometrics letter received scheduled for July 9th.

August 9th 2010- AOS interview letter received. Interview scheduled for September 21st, 2010.

August 14th 2010- EAD arrived finally!!!! Thank you God.

September 21st 2010- GC Interview @ 0100

April 20, 2011- Applied to renew EAD &AP (paper)

May 9, 2011- AP RECEIVED! Talk about fast service!

June 8, 2011- EAD card received!

September 20th, 2011- Home visit by USCIS officers!!!!

November 21st- Fingerprint notice for Dec1st

December 5th- Card Production Ordered email/text

December 7th- Card production ordered again email/text

December 8th- Decision on case status email/text

December 10th -GREEN CARD RECEIVED IN THE MAIL, WHOOP WHOOP !!!!!!!!!!!!!

I'm so sorry to hear this.

I would try to avoid thinking about immigration right now. Take some time to focus on your marriage. Once you have a better idea about what the future of your marriage is you can come back and decide what to do with pursuing your AOS.

Assuming you receive your green card soon, it shall be valid for 2 years before you must do removal of conditions. Either you will have sorted this out and be able to file as a married couple, or you will divorce before then and file earlier, including proof that your marriage was bonafide.

It is weird how long it is taking for you to receive your green card, and if for some reason they ask for a second interview or something then that could mean you end up not getting it, if you've separated by then. But I don't see why they would need a second interview. So other than that possibility it should not affect your immigration status right now. So focus on your marriage :-)

Thank you for the replies. Ofcourse i was not planning to stay with him just for the green card. If we end up staying together it is because we want to work things out but not for immigration purposes. Was just wondering if there is anybody who has ever been through such a situation. My case is taking forever and we have no idea why. During our interview we were there for like 5 minutes and the IO said she was approving it. I guess her supervisor did not or something else happened. Whatever happens, i want to thank everyone on VJ, the valuable information i have gotten here. I will forever be grateful even though i end up going back home. Thanks all!

you should contact someone to check if your greencard was approved, sometimes on change of address can caused a mix up if the greencard is not sent back they would assume you recieved it, there is some way for them to find out if your case was approved, I also read on this forum few months ago that there was a couple who for the last 3-4 yrs have been waiting for green card when all this time that they were approved and the only thing was someone forgot to update the system and made it looked liked the case was still on review but they find out they have been approved for a very long time and that single mistake made them wait for so long, I couldnt find the post but if someone has read that post please provide the link if you can. And I hope that things will be better for you, Don't give up keep calling and somehow you will get the answer.

On your other question I believe there is another way to AOS if i am not mistaken if you have been abused by your husband you can still AOS its on the instruction on either I-130 or I485 its somewhere there.

June 3, 2011 Email notification EAD Card was mailed

Timeline

I had read through your prior posts.

I think your husband's situation is seriously hard, and counter-balance that with your AOS case (which was hard, as well)

you've got a lot of stress and strain going on.

I dunno, after I read your prior posts, and reading your new topic, I can only suggest you might want to think seriously about leaving USA, get a job in Australia for the next few years, make a new life there, soonish.
