I got a letter that states that my wife's visa application will be cancelled since it's been a year since the response was given the problem is she has been here in the United States for a year already.

She got issued a visa and already got her green card.

He refer to your application for an immigrant visa. Section 203(9) of the Immigration and Nationality Act requires that your application be canceled and any petition for you be canceled if you do not apply for your immigrant visa within one year of being advised to do so.

You were advised of this requirement on the date shown below, but we have not received a response from you since then. a result, you are hereby notified that your application for a visa has been canceled and any petition for you bas also been canceled.

Your application may be reinstated and any petition revalidated if, within one year, you can establish that your failure to pursue your immigration visa application was due to circumstances beyond your control.

When communicating with this office either by telephone or letter, please provide your name and case number exactly as shown in this letter.

Refusal after interview - does it ever end

I have been keeping up with my fianc s "status" since her interview on Nov. 19th. Her status has been "refused" and to follow instructions given.

She was told her Visa was approved and they took her passport.

I thought the refusal was due to our son's CRBA interview, since we we waiting on his US passport and that they told her they would send them together.

I sent a request for information on why the status was refused since his Passport had been approved.

The Embassy responded with the following:

Dear Mr. Barnett:
To enable us to continue processing the applicant's case, please have the applicant submit her valid passport to the U.S. Embassy in the Philippines (Attn: Immigrant Visa Unit) via any branch of 2GO courier service with the applicant's name, case number, and current contact information clearly indicated.

Once we receive the letter, we will refer the case to a consular officer for review.

I can only assume that this "refusal" was because she was not thinking and had her current passport renewed and the new number has superseded the one she used in the interview.

This was done just a couple weeks before her interview and the new one was only available "after" her interview. The only problem now is that the Embassy has her old one and she was told she had to have it in order to get the new one.

Anyway... at no time has the Embassy sent and email or notification stating anything was needed. I guess it would have stayed that way until I checked... OK rant over.

Good Morning, My Fianc es name matches on all of her documents. Cenomar, Birth Certificate, Etc. Her mothers name middle name however is spelled differently on all of the documents. Could this present a problem at the interview?

For those who already have an interview date, how long are the intervals (i) between being DQ'd and getting the interview letter and (ii) between receiving the interview letter and the date of the interview?
