I have a bit of a situation with the I-129F and I'm not sure how to proceed. It says that if you were ever arrested or convicted, to attach certified copies of the arrest record and court case records. That's where I'm having a difficult time understanding what I need to provide.
My situation:
1. In December 2017 I was falsely accused of sexual assault and arrested. I spent one day in jail, was released on bond, and then had one court appearance (initial appearance) while the state continued its investigation. At no point was I ever officially charged. The case was dropped very soon after this due to lack of evidence and removed from the online court records.
After reading the I-129F form instructions, I believed that I would need to provide records of both this arrest and the outcome of the court case. However, I am unable to get the disposition document, since according to the court clerk, "no charges were ever technically filed so no disposition document is available". They did mention they had other court documents available pertaining to this incident.
2. In July of 2017, I was arrested for disorderly conduct. I was released the same day, with a fine, which I paid.
After reading the I-129F form instructions, I believed that I would need to provide a record of this arrest.
Here's my question:
Do I need to provide the above with my I-129F based on the information I stated? I would like to clarify before I pay for the arrest records and court records.
