Hi. My boyfriend and I are looking at our potential options for the near future. He is from Ontario, Canada but is currently visiting on a B2 visa for several months.

He is able to visit more freely but does currently work in Canada as well as has a rental there so he has strong ties. His current B2 visa expires Oct 1. Unfortunately traveling to Canada for me is limiting even once the land borders open as I have a young daughter and work full time.

We've been weighing all of the options but we can't seem to make a clear decision. We've considered getting married after he's been in the US 90 days but have concerns about the potential deportation if the immigration office is unhappy we got married while he's on a visitor visa even if we wait 90 days and we had no intent upon him first visiting.

K1 is the option we're most seriously considering but with increased wait times and added expenses, it's a concern. I make enough money to support him while we wait on his work permit while less than ideal. We also have a wedding we are both standing up in that is on a Disney cruise in April 2021 and don't want to risk being unable to go while he's waiting on AOS.

CR1 would be a great option if it weren't taking 1.5 years plus there is the potential concern from family if we were to get hitched without a proper engagement timeline. There's also the concern of being unable to visit while waiting for the CR1 to process as with the K1 he's more likely to be able to visit in short bursts.

Really looking for any feedback or suggestions as we keep flipping between the different options and would like to start moving forward on one of them by August/September. Thanks in advance!

Case is Ready to Be Scheduled for An Interview, not sure where this should go

Hello

On the USCIS website it says my Case is Ready to Be Scheduled for An Interview, it's been that way since Oct. 2020. I had to go get an extension stamp in my passport. My wife and I submitted the documents and payment to have my conditions removed in May of 2019. When I was at the USCIS office I asked if they had any other info of the interview, they agent said that she looked at the USCIS site and said she didn't know when the interview could be scheduled and to just keep checking. I was just wondering if any one else has experienced this wait time? I understand that there is a pandemic going on.

I m trying to figure this out but can t seem to find straight forward information. I came to the US from Canada in June on a B2 visa. I think I meet the substantial presence test because I was in the states in 2020 for more than the required number of days.

My husband and I ended up getting married in August and applied for AOS. Our case hasn t really moved (still not even biometrics) so our lawyer has said we need to file taxes and get me an ITIN. I also filed my taxes in Canada since I was working there until March. We want to file jointly in the US. We will be getting my passport certified at the IRS when we go for an appointment.

Is there anything other than the W7 form we need to include on the tax return? Am I able to be treated as a resident alien? Do I need to include that letter stating I want to be treated as a resident alien or is the substantial presence test enough?

So here's the deal...

Due to Covid, my fiance was unemployed for awhile and his income for 2020 was only 22k. In mid July 2020 he started a new job making 27k but obviously he won't see a full years salary until the 2021 taxes. By then, our AOS would have already been sent.

Anyways... his AGI for the AOS will be significantly below the requirement of 27k (about 10k below since he has a daughter).

He has assets totalling only 20k.

However, I am the Canadian spouse and I have savings over 120k. By adding these to the I-864, will we definitely be in the clear?

Co-sponsor is not an option.
