How soon can I apply for work?

Hi friends! Quick question here, as I'm finding conflicting information online. I'm moving permanently to the US on my IR-1 visa, and naturally I'll be looking for work. I know that we elected to have my social security card mailed to me, but do I need to wait for this to arrive? Some websites say to wait as I'll need the number to apply for work, while others say that the visa in my passport is fine temporarily until the card arrives. For those who moved to the US on the IR-1, did you look for work right away? Were you able to? Or is the SSN required before I can begin applying?

Thanks in advance. :)

Urgent Help Needed!!! Stuck on RFE

Moved to the US on a K1.

Filed for AOS on Dec 17th. Today, Dec 29th, received RFE.

My husband recently got a new job making 35k a year. However, in 2021 he made 28k. In 2020 his AGI was only 17k due to Covid.

Since he has a daughter, our household size is 3 and the income requirement is roughly 28k.

We received an RFE because his 2020 AGI was so low. However, we did submit his paystubs from 2021 as well as a letter of employment from his new job.

As his wife, I was able to include my assets on the I-864 which is what I did. My liquid assets alone are over 200k.

Why did we get an RFE, and how can we respond? We were hoping our assets would help us avoid the RFE in the first place.

Joint sponsor is not really an option for us. We only have his dad who is retired and his AGI on his tax transcript shows only $1,734.00 (even though his social security was over 25k). If he did agree to be a joint sponsor, wouldn't the AGI trigger a denial?

Hello,

Today I received the dreaded pink letter from USCIS.

As a backstory I've been working remotely for company in U.K. since 2017 and when moving to U.S. I read that there's no explicit law prohibiting me to keep working remotely. The law about employment was written when internet was till dial-up and no remote work was possible. I also had read here and many other forums that people have gotten their GC when working remotely in similar situations.

However I included my income in my sponsor's i-864. They now are asking for evidence I am authorized to in the United States.

Quote from the slip:

  • For the intending immigrant's income to be included in the household income, it must been from a lawful source and earned while the intending immigrant was authorized to work in the United States.

The intending immigrant, (name), listed on the petitioning sponsor's Form I-864, Affidavit of Support, or Form I-864A, Contract between sponsor and household member, must submit evidence that they were authorized to work in the United States.

My question is how other's in exact/similar situation dealt with such request?

Should I response with letter, stating that according to my understanding I was not needed to have work authorization to perform remote work for company based in U.K. and it is not affiliated with United States?

Thanks in advance,

Art

Hi, are you the sponsor or the K1 visa holder? I'm a little confused. I moved to the States (I'm Canadian) with a K1 visa and got married but am anxious about not working so I was thinking of working remotely (through a Canadian company) while I wait for my green card/employment authorization. Are you saying that this may affect my 485?

Beneficiary Income for Affidavit of Support

Hi Everyone!,

Starting to think about the Affidavit of Support requirements during the immigration process for my son and me (he s 2).

Our family was living together in Canada before my husband (a US Citizen) returned to the Texas, where we are looking to relocate as a family. I m the breadwinner and he was a stay-at-home dad with limited income potential beyond a pension he has access to at any time but is electing not to take until necessary for 4 more years.

My employer operates in Canada and the US, and is willing to transfer me to the US office, allowing my employment to continue when we move.

Two questions:

1. Does this mean that my income can be used in the affidavit of support without requiring a co-sponsor? It is well above the requirement.

2. Can my income be used as an affidavit of support for my son?

Thank you!

I-485: what is necessary to include?

I'm applying for I-485 and have researched extensively over the past two months and am confused about whether these things are MANDATORY, SUGGESTED, or NOT NECESSARY. I'm getting confused because in the 10+ applications I've seen in YouTube, there doesn't seem to be a consistency on what files are included in this package. On the USCIS instructions, it doesn't mention anything about photos/boarding passes for evidence, W2s, pay stubs etc. for example, but some people have included those things.
1. For the affadavit of support:
a) is the 1040 sufficient for the most recent tax year or do you send in W2's as well?
b) is the most recent tax year sufficient (of 1040 and/or W2) or did you include the last 2-3 years?
c) are pay stubs mandatory, suggested, or not necessary at all?
2. I understand that for the interview, I will have to prove our relationship's validity, etc. but for this package, do I need to include photos, email exchanges, boarding passes, etc.? Are those things helpful or not necessary?
Thank you in advance!
