Hi there.

I was told you can file an E2 visa while your on vacation only after 3 months of entering and allow to stay until your visa app is either approved or disapproved (even if it passes the 6 months allowed for visiting) and you can wait in the country? If not approved you have to leave within 30 days. Is this true about being able to stay in the country and over staying your 6 months visitors visa? Thank you.

My husband and I both graduated university in 2020 but didn't get married til Summer 2021. I came from Canada on a F1 visa and did my 1 year OPT post graduation from Summer 2020 to 2021. My husband was in nursing school and didn't work while he was in school. We filed joint tax returns for 2021 and earned about $85,000. For part 6 on the I864, I have checked off that he has not filed tax returns for the past three years but the note underneath reads "You MUST attach a photocopy or transcript of your federal income tax return for only the most recent tax year". We are also willing to provide any proof (as checked off in Part 6, 25) that he was not required to file taxes for 2020 and 2019 due to him being in school and awaiting the NCLEX. He currently now has a stable job working as a registered nurse at a hospital and has a very secure career.

With that, are we able to submit the I864 form without a sponsor (I864-A)? If we are able to proceed without I864-A and need to provide proof that he wasn't required to file taxes for the two years, would school transcripts suffice, or should we file amended tax returns for those years indicating he was a student earning $0 income during his studies?

My interview was on 15th August 2022, Visa officer "Approved" my case & on CEAC status turned to "Issued"

Almost 1 month has passed & i haven't received my passport....

I have contacted Consulate but they take 2 weeks to reply, if they do.

I have contacted all other emails to track passport but no luck, they don't help

I even contacted USS Citizen Services on my petitioners behalf - they just said contact consulate.

What's going on here? What do I do? help please!

Tourist visa (B1\B2) to Student Visa (F1) inland status changed

Hello,

I have enter USA on tourist visa (B1\B2) in 2014 (Valid till 2024) and did status change to student visa (F1) got approved (No stamp on passport) inland I was in USA till 2018 on Student visa (F1). Then I moved to Canada (in 2018) got married to Canadian citizen. Currently having Indian citizenship and Canadian PR.

The question is these November 2022 my wife's cousin getting married in USA and they have invited us for wedding can I still re enter USA on tourist visa (B1\B2 as its valid till 2024) or I need to re apply for new tourist visa because of change of status inland to student (F1) and not having stamp on passport before leaving USA?

If yes tourist visa (B1\B2) stamped on passport still valid, Speaking practically will the immigration officer will let me enter the USA or not as I previously enter USA on same status (B2) and change of mind to student (F1) he/she can deport me and bard me from re entering? (I will have my wife (Canadian citizen) traveling with me and will have return ticket for both of us)
