Marrying another foreigner after divorce

Hi all,

Long story but I wanted to come back to VisaJourney and confirm a few things because with my previous visa process these forums were a huge lifesaver.

  • I divorced my green card holding spouse (he received his 10 year sometime during it all. It was already processed/approved, he was very fortunate with the timing) because he cheated on me in late 2019-early 2020 and I found out in March 2020.
    • We started dating in 2014, got engaged in 2016, he moved here in 2017 and we had our wedding party in the same year.
    • Our marriage was failing in the 3rd year and we did go to couples therapy but he wasn't honest so it went no where.
    • I did try my best to fix things but in the end he had already "checked out" mentally and it was difficult to reconcile.
    • I do have correspondences, photos, a mortgage, car payments, wedding photos, wedding bills, etc. to prove it was a bona fide marriage.
    • I do have the option to request an affidavit from my ex spouse stating that it was a bona fide marriage. We are not on good terms but I believe he will cooperate.
    • I do have evidence of his infidelity. Not sure if this would help my case but figured I should mention it
    • Last bit I wanted to mention, we separated in April 2020 and officially divorced in August 2020, I have the divorce decree as well.
  • I did a search on Google and found that there is only a 1 year wait time for the petitioner to get married and petition for another K-1. Is this correct?
    • My boyfriend has not proposed yet but we have spoken about marriage and likely to pursue a K-1 visa around 2024. This is just me being proactive :).
  • My boyfriend is Canadian and we got together late 2020. I know I moved on quick, unfortunately my previous marriage was going downhill for a year. After I found out my ex was cheating I could see a light at the end of a very dark tunnel. An answer to the question I hadn't been able to answer for a year as to why things felt different. I am so much happier now and no longer living in a constant state of worrying and self loathing.

I immigrated in a k1. Became a U.S. citizen 6 years ago. Long story. > I ve been estranged from my son for 13 years. From the time I divorced his father. I continued to make attempts to connect over the years, u successfully. The entire time I was emailing my son or texting but it wasn t really him but my ex. My ex died last year. We have since discovered that my ex was portraying g himself as my son and was telling me he didn t want a relationship etc. at any rate my son and I are trying to build a relationship that we were robbed of. Since his Dad died he really has no one in Canada to turn to and is very alone. He came to visit me last year in the US and us now seriously thinking of moving here. Many questions. Can he come here and apply for aos. ( ?) or do I need to apply for him to come while he s in Canada. We ve lost a lot of time and heartache so the quicker the better. Being legal of course. Ty everyone for your guidance.

Mistake on my N400

Hello,

So I have my interview next week and as I was reviewing my N-400 online I realized I made a mistake, and I was wondering how big of a deal it might be. On Part 10 Question 8: It asks how many times has your spouse been married and I put 0 instead of 1. (I am filing based on marriage.) I think I was tired when I filled it out and thought the question was asking how many times has my spouse been previously married, not how many time they've been married in total.

Also, my spouse is not able to attend the interview due to an important work obligation that day, but we did ROC years ago and from what I understand it's not necessary for them to attend after ROC. Will that hurt my case?

Greetings good people!

The abbreviated version of our story: I entered the US (from Canada) in 2012 on a K1 visa. We've been happily married since. Yay! Around the start of Covid we moved to Canada for family reasons and originally did not intend to return to the US in a full-time capacity... at least for the foreseeable future. Well, things have changed of course and now we're looking to return. My wife (US citizen by birth) is moving back next week for a new job and I'm hanging back here until we can secure an IR-1.

I do have a green card, but as per everything I read online, because I've been a full-time resident outside of the US for almost 3 years, it's considered as abandoned. Now, there's been nothing official from me or USCIS about said abandonment. I did find out recently that there is a form to formally notify that I'm not longer a resident, so I'll be filling that out immediately. I am kicking myself a bit for not knowing that before, but here we are.

Question is, does anyone know if we can just immediately apply for CR-1 after submitting the I-407 (green card abandonment) or if they may reject due to my having only just abandoned my green card?

Also, before anybody asks, yes we have thought about the SB-1, but it seems pretty clear that I have to have intended to return to the US all along and were unable, which is clearly not the case.

We are waiting to hear back from an immigration attorney but I figured I'd post here to see if anyone has any insight.
