This has been asked several times, I am sure, I've already searched and while some info is helpful, it's possibly dated so bear with me while I ask again.

I am a Canadian citizen. I need background checks for both Canada & US (I have previously lived in the US, 15+ years ago).

I am scheduled to have fingerprints done tomorrow morning at the Commissionaire's office in London Ontario.

I want to ensure I'm getting the RIGHT sets --

For the RCMP I need "criminal record check for personal use under the Privacy Act" - correct?

And for the FBI I chose "digital fingerprinting" with a print copy.

The FBI online instructions look pretty straightforward but the RCMP site is confusing. Can anyone explain the steps once I have my fingerprints?

I want to do this correctly, I have seen confusion and people getting denied based on providing the wrong information.

I am Canadian. become US resident from Sep 2022 (CR1) and haven't worked on US soil in 2022.

I called my accountant and she said I dont need to because I had not worked in states yet and been here less than 6 months. So she is suggesting file separately and let me file mine in Canada for 2022. And from 2023, I can file for full year.

I thought I still have to file $0 in US by law. But the accountant seemed confident that I don't need to. So just here for second opinion.

Hello Members,

My 2-year conditional green card through K1 expires in May 2024, I know it's quite in advance but wanted to check a few things and be ready before the time when I have to file for ROC I-751.

  1. Is the 90 days window to apply before the expiry printed on the conditional green card or 90 days before the second marriage anniversary?
  2. I changed my name after marriage and my foreign passport of course has my maiden name. This passport is expiring in Jan 2024, I am planning to apply for renewal at an embassy here in California. But hopefully putting my new married name on the foreign passport should be fine when the time comes to apply for I-751. I have used my married name for all K-1 filling.
  3. From what I looked up online, the processing times for 751 for California Service Center is currently 15.5 months. What happens when I file for I-751 before the 90 days but the processing takes longer, do I get any document meanwhile to keep my residency in the States?
  4. Understanding when filling out I-751 I would get a 10 years valid green card. Can I apply for citizenship after staying in the States for 3 years in total (2 years as conditional GC + 1 year of 10 years GC)
  5. Does USCIS send mail to the address from where the K-1 visa was filled for notifying for removal of conditions or any other purpose? We have moved out from that address and now staying in another city.

Kindly assist with my questions above. Appreciate your help!

TN Visa Border vs I-129

I've been working in the US with a TN visa (medical/allied health) for several years (renewed every 3 years). Ran into an interesting issue with COVID restrictions for Feb/Mar 2023. I was not able to get vaccinated for COVID due to life threatening allergies to ingredients in the shots. I've got medical documents to verify as required by CDC. I spoke with two Border Patrol Agents at different ports of entry in Michigan before crossing to renew my visa and was told even with the appropriate documentation I would likely not be able to reenter the US! Apparently the border supervisors are not typically letting unvaxed people in regardless of documentation. Typically I do flagpole....drive from Michigan into Canada and back into Michigan. The agents suggested I purse my TN renewal via a I-129 with my employer. So I got that ball rolling quickly before my TN expired and we went with premium processing for a faster turnaround. Package was sent overnight on 2/23/23 and payments (checks) were cashed in 2 business days. Notice arrived 3/8/23 (dated 2/24/23). Looking forward to my renewal! Giving others a heads up as I would not have been aware of the situation without the Border Patrol Agents sharing.
