    PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this
    When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1."  The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!).  I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
     
    Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before....  I would kindly remind the officer "We married >2 years ago.  We can enter with an IR-1 visa now right?"

    Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).
    I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?

    Wrong USCIS application form filed by my lawyer!
    Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…

    Seeking advice for Thai/US couple - What US visa path to take?
    My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time.     Hi all, at the bottom of the printed I-94 pages, it says the document expires on July 31, 2025 despite the i-94 entry period expiring 3 weeks later. Is this version of the document still valid to use in the AOS submission even though it says it expired yesterday?

    Hi! I think I'm good to post in here? lol

    I also have some I-751 questions.
    I feel like I'm climbing up a mountain about how to file the evidence for this one. I don't know how to prove our marriage on paper cause we're both ADHD and have been procrastinating on a lot of stuff.

    Bit of backstory :

    • Husband has no driving license or state issued ID (we just kept putting it off and he's dyslexic so he panics at the thought of the permit test)
    • Car insurance won't let me put him on the policy until he has a license or permit number
    • I bought my house before we even met, I don't feel comfortable putting his name on my house when he hasn't financially contributed to it
    • Same thing for the car - I bought a new one in 2024 due to the old one crapping out. Paid cash for it. They wouldn't put his name on the title because he doesn't have a US license and he didn't financially contribute to it, so...idk?
    • I only filed joint taxes for 2024. We married in 2022, and he moved here in December of 2023. Accountant said I couldn't file joint for 2023 because he wasn't in the US long enough. I filed married-separate for 22 and 23.
    • He's unemployed (with light freelance work online). He's essentially a stay at home spouse), so no evidence of joint income
    • We do have a joint checking account which I pay our cell phone & trash bill out of - but it's only me contributing to the account. I don't direct deposit my wages into it because most of our finances are separate by a mutual choice.
    • We don't really travel. Only went to visit my mom about 3 weeks after he arrived. Lots of photos, videos and receipts of that, but we haven't gone anywhere since then
    • We don't take a ton of photos together, mostly cause we're together 24/7 now and didn't see much of a point? idk - we are weird lol
    • No kids and no plans to have kids
    • Utility companies won't put both our names on anything. We have AT&T, Xfinity and National Grid - all of them refused, not sure what to do on that. He IS an authorized user on all three accounts
    • We're both extremely introverted and keep to ourselves. We have absolutely no friends where we live, his family is all in England and mine is on the other side of the US. All of our friends are online only, and have never actually met any of them in person, so we don't know who to ask for an affidavit.
    • We are friendly towards our neighbors but not sure if any of them know us well enough to be willing to write an affidavit.

    How screwed are we?

    Is there anything I can do about the utilities not wanting to list two names? I asked them about it in our I-130 evidence gathering, and was told "Only one name may be listed". Attorney told me to get a formal letter from the companies explaining why they won't do that but I've literally never heard of a business ever doing that before. Is that even a real thing? Or can I just print off the webapge showing he's an authorized user?

    Same thing for the credit cards too I guess. He's an authorized user on several of my accounts, but he doesn't ever use the cards. Can i just print off the webpage showine he's on the account or do I really need a letter?

    I read somewhere that I can include a letter explaining our living situation and why our evidence may be kind of weak, but I'm guessing we're probably going to be selected for an interview

    The list of documents our Attorney sent us is daunting and making me panic a little bit.

    DCF in Vienna - From Start to Finish

    Folks here were very helpful in navigating how this process worked and in figuring out if it was even possible for my wife and I. We were able to manage it, from start to finish, in just under three weeks. Here was the timeline:

    1. July 9th: I (US citizen) got a job offer.
    2. July 10th: I sent the formal request for DCF to the Vienna embassy.
    3. July 14th: After a bit of back and forth (the offer needed to be on a formal letterhead), the embassy approved the request. We could come in any Tuesday or Thursday (surprisingly, no appointment needed).
    4. July 22nd: We both (me and my wife) came in for the formal I-130 petition. The consular officer interviewed both of us about our relationship, and they really liked the short booklet we had prepared with pictures/the story of our relationship (HIGHLY recommend you bring this! It won't be formally requested). We were approved immediately. They even asked us when we'd want it by; we asked for mid-August, which they said was no problem.
    5. Edit: July 28th: Medical examination (forgot to add this). The consulate had a specific doctor she needed to see, who was pretty quick.
    6. July 29th: My wife's interview, when the I-864 was filed (she had previously, after I-130 was complete, done the DS-260 online). This required some last-minute maneuvering (my parents graciously agreed to I-864A and we hurriedly got everything in order for that). Likewise, we had police reports from any place she had lived over the age of 16 for more. Do NOT wait on these. If you think a job offer might be coming, get them anyway (good to have on hand in case you unexpectedly need them). The countries we needed would have been quick anyway, but some take a very, very long time. There was unfortunately one hiccup (related to my parents' taxes; just did not have the correct form), but they said we could just email it to them. My wife self-translated her birth certificate, which was fine for them.
    7. July 29th (part two): By a literal random chance, my parents found the correct form an hour after my wife left the consulate. We emailed it to them promptly.
    8. July 30th: We sent another followup. They responded quickly, saying they'd get back to us soon.
    9. July 31st: Green card approved! They got back to us, approved the form, and said my wife could come in whenever to get the initial visa thing (the one they print in the passport).
    10. August 1st: My wife handed in her passport, and shortly after got an email saying to pick it up Monday (August 4th).

    Overall the consulate was incredibly friendly, professional, and efficient. If you feel like you're staring down a DCF barrel, stay calm and (if you think DCF may be a feasible possibility in the future), have the key documents ready ahead of time. Likewise, know your addresses DS-260 wants to know everywhere you've lived the last ten years. We did not necessarily and many of the pieces came together seemingly by chance.     Hi everyone,

    I have a minor UK conviction for fare evasion that is recorded only in court records not on police databases or the Police National Computer only court record. I m not sure how this might affect my eligibility for ESTA or if I should apply for a B1/B2 visa instead.

    The current ESTA criminal question asks if I ve committed an offense involving serious harm to a person, property, or government authority, which I don t believe applies to my case. But I m uncertain if I need to disclose the conviction and how it might impact future U.S. travel especially a k-1

    I d really appreciate any advice or experiences from others who ve dealt with minor UK convictions and U.S. entry.
