When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

8 RepliesGood evening. I've been a bit confused about what procedure to follow to legalize my daughter's status. She is currently in the US on a valid non-immigrant visa and is a minor, 17 years old. I am a naturalized citizen. Is it possible to apply for a citizenship certificate for her directly, or do I have to go through the standard process using forms I-130 and I-485 for status adjustment, and then apply for her citizenship certificate later?

I received an update today for my I130 application. When I looked at the USCIS website(case status), it says that our case is still being processed. But when I logged in my USCIS account, I found an approval letter document (in pdf) in there. I honestly don t want to celebrate yet because I m confused and not sure if our case is actually approved.
In the letter, it says The above petition has been approved. And they sent our case to NVC in NH.
Did anybody experience the same thing?

Some background.
After dating for 6 years, my wife (American born) and myself (British born) were finally able to marry recently.We are both late 50s / early 60s and had desperately wanted to reach the marriage stage sooner but endured so many personal obstacles (extreme business commitments, family death, and health related) which all prevented it sooner.
I currently have a US P-1 work visa (as I travel the world related to the entertainment business) and visit America often with my work.
This is third American P-1 related work visa issued to me in the last 10 years.
We jointly rented a US property in TX last December, where my wife has been living since and plan to live at the property one our application has been approved.
For now, I naturally retain and live at my UK property, but when possible, have stayed with my (now) wife at the US address when a US base is needed for my work.
Naturally, we will have many questions along our CR-1 application, but these are the first basics.
1) How UpToDate and active is the information contained here?
2) Are there other recommended accurate sources of discussion for the CR-1 application?
3) As times have changed, is filing on-line the recommended application process via http://www.uscis.gov/?
4) We don t believe we have any reasons that could prevent an application being approved, however, as I hold the P-1 entertainment visa, not as a musician, but as essential supporting staff, would anyone here have any experience via a similar situation with a P-1 visa, and would you in this case advise the use of a specialist attorney?
5) Although the US property is in registered in both our names and we both financially contribute to monthly payments including utilities, we don't yet hold a joint US bank account. Would that be recommended / required for CR-1 application?

What 'supporting documentation' should my parents-in-law bring for B2 visa interview in regards to financials/income? 3:16 pm yesterday

4 RepliesI read the https://www.visajourney.com/guides/visitor-visa/, but I am still unsure what supporting documents I should advise them to bring for establishing the financial/income requirements.
For a bit of background, my wife (K-1 Visa / Pending GC Decision) wants her parents to come visit sometime in 2026, which I believe should be fine given they have ample evidence of ties to Philippines (e.g. taking care of family members, owns a home, owns multiple plots of land, etc.), no criminal background, no prior visa/immigration issues, etc. However, the problem comes in regards to financial/income requirements as they are basically retired other than some part-time selling of crops, so on paper, no income.
Now I know unlike K-1 Visa, there is no actual connection to myself or even my wife in regards to the application, so no need to provide an Affidavit of Support, but realistically, we would be supporting them when they come to visit and we would be paying for all their travel costs. I'm just curious how to best go about advising them to evidence this plan or if this in itself is a huge red flag that they cannot pay for themselves.
