hello guys my wifes greencard had expired so we went and got a i 551 stamped on her passport so she could travel back home with my 1 year old son..

she left 4 days ago and now she does not want to come back...what in the world should i do...she has my son and now fooled me once again...

please help...

If she returned to Afghanistan for a family medical emergency, do you not think that might have some bearing on her choice to remain? If that is not the case, and the child is your biological son (I am confused because your posts indicated a pregnancy, then no mention of a child) then you have recourse. No parent can unilaterally abscond with a child.

she left 4 days ago and now she does not want to come back...what in the world should i do...she has my son and now fooled me once again...

If she is outside the US, you have difficulty ahead. Extradition treaties only apply in certain countries, primarily, for felony crimes.

You will need to contact a private company for radical "recovery" options. I can recommend several good options. If you want to go this route, send me a PM. This option will be expensive, but should be succesful. I gain nothing personally, other than the satisfaction that "the right thing was done".

Without any basis this was kind of rude. Not everyone who runs away has been abused by the spouse.

You will want to check out the Hague Convention Agreement on International Child Abduction. The Convention states that it is the child's place of normal residence not the child's citizenship that is used to determine in which country a child lives. I don't know your wife's country of origin or if that country is one that signed the Hague Convention or not, but this is certainly something you would want to check out. Definitely consult a lawyer and follow the link provided above on international child abductions. You may want to take steps to have yourself declared in a court of law the custodial parent and as proof that your child is normally resident in the US, and that even though you gave your wife permission to travel with the child out of the country it was for a visit and not to change the child's residency. Please do consult a good lawyer. It may be a difficult case to fight depending on where the child now is. Good luck!

This will be a difficult legal issue, unless she voluntarily returns. I think it's time to face some facts though. This child has two parents, so should be referred to as "our son" not "my son". I suspect your wife has "reasons" for her actions. You or a court of law may or may not agree that her reasons justify her actions but her reasons are something about which you are likely to be aware. They may be as simple as wanting to end the marriage (also for reasons) and taking a short-cut to the end result of returning to her home country to raise the child.

Facts are cheap...knowing how to use them is precious...

Jan 10 2007 got receipt and case number!

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!
