Hi everyone,

 

I'm hoping someone can help answer my question about switching from the standard i130 consular abroad with USCIS to DCF? I've understood that you cannot technically "switch" over the application, but can I cancel my current i130 that is with USCIS and re-file with DCF? My embassy is France and I am a USC petitioning for my husband.

 

Long story short, I am an idiot who did not do their research before I did the regular filing, and I can now get a job transfer to the US with my company tomorrow if I wanted to. My PD is 02/27/2025 and I am feeling very anxious about the recent slow down with processing times. I have a very straightforward case (married for 10 years, husband has social security number, has lived in US and held green card before, 2 kids...), but I don't think that is making a difference and I see horror stories of people waiting 24 months now. I want to move back to the US with my 2 young children in July to be able to start the school year with them, but I am very nervous that my husband might not join us for quite some time.

Did you try expediting or going through your congressman/senator's immigration aide?

I don't think that getting a job offer is a valid reason to expedite. And I haven't reached out to my congressman or senator yet. I'm not sure if they can help as I am still technically within the normal processing time for USCIS, which is 17 months now! 😞

Attempting to switch from an existing I130 to DCF could be very risky.  As you mentioned, you would have to cancel the exiting I130 first, then hope the Consulate accepts a DCF filing.  They may with your job repatriation requirements, but they will be able to see your I130 was recently canceled and may view it as an end-around attempt.  It is entirely up to you, but you could contact the citizens services portion of the US Consulate and see what they say.  You can also attempt an expedite through USCIS as a need to repatriate as a USC should at least be considered for an I130 expedite.

Consulates are not authorized to accept cases when a previous I-130 has been filed.  You need to contact them as far as what they will do if you cancel the I-130.  They have 100% discretion.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It sounds as though your I-130 will be approved any day now, and Paris is one of the quickest consulates out there, so I don't actually think you'd save any time by going down the DCF route anyway. I'm guessing the 24 month 'horror stories' will be those with complicated circumstances, or they're in countries with a big wait for an interview, or they're from a country on the visa ban list. 

 

You can't do DCF if you've already filed an I-130, so pretty sure you'd have to cancel the existing application. When you're almost at the point of the I-130 being approved, I wouldn't risk cancelling it personally. What if DCF is refused? And then you have to start all over again!
