Hi everyone,

 

I'm hoping someone can help answer my question about switching from the standard i130 consular abroad with USCIS to DCF? I've understood that you cannot technically "switch" over the application, but can I cancel my current i130 that is with USCIS and re-file with DCF? My embassy is France and I am a USC petitioning for my husband.

 

Long story short, I am an idiot who did not do their research before I did the regular filing, and I can now get a job transfer to the US with my company tomorrow if I wanted to. My PD is 02/27/2025 and I am feeling very anxious about the recent slow down with processing times. I have a very straightforward case (married for 10 years, husband has social security number, has lived in US and held green card before, 2 kids...), but I don't think that is making a difference and I see horror stories of people waiting 24 months now. I want to move back to the US with my 2 young children in July to be able to start the school year with them, but I am very nervous that my husband might not join us for quite some time.

Did you try expediting or going through your congressman/senator's immigration aide?
