My wife had a interview today, we have a joint sponsor who filed her taxes with her husband, we gave a note to say she didnt want o use him as a sponsor, her income was enough for 5 people, at the interview they denied my wife and said my joint sponsor didnt make enough and because she doesnt have a phone couldnt call me then they wouldnt let her back in to try to make her case and show the documents again proving that here is the w2s, the letter saying no need for husband to be a joint sponsor and we had transcript, my wife is pregnant and we got expedite because it is high risk

Sorry, dude.  You must be reeling, and that's understandable.  Did she get a 212(g) to provide more financials, or outright refusal of the visa?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If it is the only issue, the consulate can resolve a financial 212g with an updated affidavit of support very quickly, so no need to panic.  I wonder if there was a language issue between your spouse and the consular officer.  Not sure what you mean by "the letter saying no need for husband to be a joint sponsor".  All that was necessary was the I-864 from you and your joint sponsor.  In any case the path of least resistance may be to add the I-864A to add the income of the joint sponsor's husband, if that is possible.

Many consulates want the spouse of a Joint Sponsor to sign an I-864a if they file joint taxes.  It sounds like you just need to find another willing,  well-qualified joint sponsor who has sufficient income.   Did they give her instructions on how to overcome this obstacle?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yeah have my step dad send in a 864a signed and his passport which i don't know if he has

It is 6 months from the medical 

but she is pregnant and if in last 3 months of pregnancy she can not fly on most airlines

that would mean flying to manila and doing the CBRA for the new baby and US passport

Where did you see this requirement?  I don't believe it was necessary and perhaps confused them.  But as others have mentioned here, it is possible that they simply want to see the sponsor's spouse sign the I-864A.

 

Edit: it is not clear to me if the person filling out the I-864A has to provide a copy of their identification, but in any case it doesn't have to be their passport.  According to the I-864 instructions, a person filling out the I-864 can provide:

  1. Proof of U.S. citizen or U.S. national status includes a copy of your birth certificate, certificate of naturalization, certificate of citizenship, consular report of birth abroad to U.S. citizen parents, or a copy of the biographic data page of your U.S. passport.

I don't believe the household member (the person filling out the I-864A) has to be a US person.

That is always at the discretion of the Consulate Officer.  For one thing, It protects the spouse of the joint sponsor since they are using joint finances.
