Need help here ASAP!!!

 

I-485 Interview in less than a month. Spouse not Cooperating with documents.

 

We have lived together at few occasions but not all the time. We do not have lease or joint bank statement or credit card.

 

We do have marriage certificate, Pictures, Motel receipts text messages and call records, some videos.

 

What should I do?? Can someone please help. I am genuine but Spouse is taking advantage and not cooperating at alll.

What is the reason that your spouse is not cooperating? Is this (still) a bonafide marriage?

It appears you are adjusting status from a K-1.  Unless your spouse coperates, there is nothing you can do.  You must adjust through your spouse.

This is not good.  A marriage certificate, alone, does not  prove a bona fide marriage.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

What do you mean you’ve lived together on ‘a few occasions’? Why don’t you live at the same address now? You’ll need a good reason for living apart. 
 

None of the stuff you’ve mentioned shows that you are in a proper marriage. And you won’t get a green card from what you’ve said. 
 

Can you give us more info? Why are you living apart? When did you arrive, when did you marry, and how much time have you lived together since you came to the US? What proof do you have that you’re in a bonafide marriage now? Or are you not in a bonafide marriage?

Not cooperating as in not providing the I 864, there is no way forward.

 

Your other comments raise questions, you are seeking to adjust based on a good faith marriage.

Thank you for reply.

 

My Husband is not serious about this at all. He has been un-employed since we filed our petition and we had to take a co-sponsor.

We do not have a Joint lease together or bank statement or cell-phone bill, But our marriage is a Bonafide genuine marriage.

 

He does not has a place to stay so he lives with his friends at times or parents. He visits me and we live together for sometime but then he goes back.

 

For this upcoming interview he is not helping me out with documents. 

 

Can you Advice me if should consider other options like VAWA. I am genuine person but my husband took advantage and now he is running away from responsibilities.

This is one of the major disadvantages of a K-1.  The foreign spouse is totally at the mercy of the US citizen.  VAWA doesn't appear to be an option as there is no indication of abuse.  It could be argued that you don't have a real marriage......as evidenced by " He does not has a place to stay so he lives with his friends at times or parents. He visits me and we live together for sometime but then he goes back."

There is a real possibility that your Adjustment will be denied.....if you get that far.  Your avenues to remain in the US are extremely limited.  You are in trouble, imo.....thanks to your spouse.

VAWA cos your part time husband doesn’t want to live with you???!

We have lived together at few occasions but not all the time. We do not have lease or joint bank statement or credit card.

 

We do have marriage certificate, Pictures, Motel receipts text messages and call records, some videos.

 

Spouse is unemployed, No money or place to stay, Currently Spouse stays with his friends. 

 

Never gave me any money or food. 

 

Can you please advise what do I need to do before the Interview.

Where is the VAWA case?

 

All I have is what has been posted here.
