It is the same form as the fiancé visa. You can only apply by paper. https://www.uscis.gov/i-129f

Here's what you need to submit.  You should have almost everything from the I-130.

Form G-1145

Form I-129F

I-797C from your Form I-130

Marriage Certificate

Divorce Certificates (if any)

Evidence of Name Change (if any)

Petitioner’s Passport or Birth Certificate or other proof of US citizenship

Petitioner's Court Records (if ever arrested or traffic ticket over $500)

Petitioner Passport Photo

Beneficiary Passport Photo

Already did I-130 plus all of the above . Nothing else is necesssary.

OP, unless I missed it you never said what country your spouse lives in or if either of you have any criminal or immigration issues. Those are the two most useful responses you could provide us before trying the I-129F.

Filed petition for my wife, who lives in another country. Everything is clear and clean.

Not sure where you’re reading that it takes 12-14 months at most, that’s not correct at all. I gave you the link above to check the official current processing time. And to check the date you can enquire, you’ve still got a couple of months to go.

A lawyer can’t help, and a congressman can’t either unless you’re outside quoted processing times, which you’re not yet.

But once you get past that date you can enquire, and push things along (including suing if needed).

Just to confirm, you were a USC when you applied? Not green card holder? Which country is your spouse in?

when I applied the time line was 12-14. Now they changed it recently.

Which country? It matters as some countries naturally take longer to process so we can’t tell you how normal this is without knowing.

By clear and clean you mean no criminal history, no previous foreign marriages, no nothing that’s not boring?

I am US citizen, I petition for my wife who lives in another country.

So if you've already filed the I-130, why do you need another visa? Was it denied?

Edit: OP has another thread where they say they filed I130 20 months ago and it's still processing. Guessing they are just trying to circumvent wait times via another visa.

I already did I-130 petition. So I think I don't need to file for fiancee I-129F

You need to look at the form.  That IS how you file for a K-3 (along with an I-130).  But, as mentioned, you won't get a K-3, but it might prompt USCIS to take action on the I-130.

Yes, which is perfectly normal. My point was that you said it ‘usually’ takes 12-14 months, and that’s not been true for quite some time. The fees increase in April 2024 caused a rush of new applications, add in a new administration, and you can see why the quoted processing time has gone up.

Your enquiry date isn’t too far away though, so if you don’t have a response by then you can give things a nudge soon.

You use the I-129f form and check the box at question 4.b.

But as noted by other members, it is not likely that it will get issued but it might nudge the I-130

Already discussed here.  You can file the I129F to ostensibly petition for a K3, few are issued these days, but there are some.  There is also some anecdotal evidence that an I129F filing with a pending I130 may jump start things, YMMV.

Good Luck!

P.S.  I asked a moderator to merge this with your existing thread.

You are misunderstanding.  You can file an I-129F for a K-3 visa IN ADDITION to the I-130.  People here are saying it is no longer issued (there are only a few every year).  But some think it helps push the I-130 along.  It's free and takes only a few minutes to get together.  I suggest you do all the free steps that you can (K-3, out of normal processing time inquiries, Senator/Representative), then proceed to a Mandamus if you don't get a decision by winter.

The problem is, there is no solid consistent evidence proving filing I-129F works. We know K-3 gets closed when I-130 gets approved, but we don't have anything to indicate K-3 forces decision on I-130.

The only thing USCIS will honor with great level of success is Writ of Mandamus. Everything else provides mostly psychological relief for petitioner (e.g. something is happening, case isn't fully stuck because I'm getting replies and various updates)
