I am cautiously optimistic that we will be moving to New Hampshire at the end of july, as long as my visa arrives in time. My oldest daughter is 14 this year and is supposed to start high school in the fall, but we contacted the school and they said I cannot do anything until I actually move there. I want her to get the best start possible with all the other kids, so I am worried she will be delayed. Getting her immunization records and CRBA is no problem, but they said I have to show proof of physical and legal residency. How can I get that fast enough? Anyone have any tips? I plan to go get my social security number as quickly as I can, because I assume I might need that to be put on the mortgage or any bills? I would really hate for her to start late because of this. >_<
 

Anyone know if any documents stating I will be living with my fiancee might work?

Can't advise regarding your daughter starting school, but yes you will need an SSN to be added to anything like mortgage, bank account, etc. If everything goes through at your interview, then SSA normally advises it can take up to 4 weeks to arrive in the mail - but there's quite a few experiences, including my own, which saw the first SSN card never arriving and a replacement being arranged (which can take up to a further 4 weeks).

 

Additionally, in my own experience, when I got my first SSN before marriage, in my maiden name, it wasn't possible to get me added to any of my husbands accounts after marriage because my SSN name did not match my now-married-name. I tried to get it changed with SSA a couple of times, but it wouldn't go through until I received my EAD card and could present that to the SSA.

 

I'm just letting you know this in case your own potential delays with an SSN has a knock-on effect on you proving residence and your daughter starting school.

If you're moving at the end of July then you should have plenty of time. For residency, a bank account statement, or your SSN with address on it (if it does get mailed), or utility bill will be fine. We didn't need our SSN's to get utility accounts opened in our names. A learners permit would be good too.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If it's a public school, you don't need proof of legal residency to enroll a child. You can go through the enrollment process quickly when you get here because all children are required to attend school up until the age of 16. Many undocumented children have no problem going to school and usually hit a road block when it comes time to apply for college, but that's not your case.

 

"All children in the United States are entitled to equal access to a public elementary and secondary education, regardless of their or their parents’ actual or perceived national origin, citizenship, or immigration status. This includes recently arrived unaccompanied children, who are in immigration proceedings while residing in local communities with a parent, family member, or other appropriate adult sponsor."

While I do think they will have time, and as @centric23 pointed out kids have a right to education, "plenty" might be a bit much as many schools start mid-August, so it is something that OP should work on pretty quickly after arriving.

 

But @Nywoek, are you all buying a house? Renting? Staying with family initially? And have you asked the school what they require for proof? I am asking, because when registering my child for school this year, right after moving to the US, we did have to show more than just a utility bill or something -- we had three options to show residence: deed/mortgage for a house we owned, lease/rental agreement, or notarized affidavit from someone if your child lives with someone else that lives within the district (so if you are staying with family, that might be the option).

Just adding that we usually start first week of September up in New England and end in June. I think the more southern states start in August.

My fiance bought a house last year so we are living with him, but since he is not her legal guardian he couldn’t do anything. 😕 

 

I will attach a photo of the letter the school gave us.

 

Could he write me a contract, like a renters agreement? Even if I am not renting, I don’t know, trying to be creative here. 🙈

Thanks. ^_^ I will go get it sorted asap, and since I am not planning on changing my name (at least not now) that wont give us more problems. 🙈

That seems simple enough, and can't see why you'd need a contract, the third option would work?  "Notorized letter with explanation of living arrangement".

Yeah agreed, notarized letter along with proof your fiance owns their house in the district seems like it would be good to go. In the school's view, I can't imagine it is uncommon to have a student who lives with one of their parents and the parent's partner who is not a parent of the student -- seems like exactly what the notarized letter would be for.
