Hello me and my husband are starting the visa process but have some concerns, he as a job in there and we have a sponsor but I was wondering do I put the prison address for his side or a different one?, also I was wondering if he will still get accepted or if we should wait till he is home, he is home in 7 years and I wanna get my self situated before he comes homes. Will anything disqualify him?, Thankyou in advance

Surely you have a lawyer involved and they are able to tell you?

 

I would think your husband being in prison for 7 years will make this impossible to DIY? 

 

How long have you been married before your husband went to prison?

If he is in Prison what different address could he have?

 

He has a Joint Sponsor presumably.

What could disqualify him is what put him in prison in the 1st place 

 

A disqualifying criminal history for immigration typically includes convictions for serious offenses, particularly those involving violence, moral turpitude, or drug-related activities. Specifically, aggravated felonies, crimes involving moral turpitude, and drug-related crimes can make a person inadmissible. Additionally, spending 180 days or more in jail or prison for any crime can also negatively impact immigration eligibility.

HIs prison job does not continue after release so he needs joint sponsor

He also needs proof of where you will live in US

If he has up to 7 years left on his time, I must assume it is a serious crime, you will definitely be needing a lawyer. Also I don’t know about your relationship or what you tell each other, one thing I know for sure is I hope you are doing this for yourself and not because he asked you to, because we all know or can guess he is a felon by now and this will prevent him from getting a decent job when he gets out. On another note, the job he tells you he has in prison typically pays 25 cents to a dollar an hour, at the end of the month some inmates can make up to $500, this simply helps them have some money in their books for commissary and usually you must be a medium or minimum offender (low risk) in order to get a good paying job in there. So I will advice you to have an extensive talk with your spouse and make sure you are not investing your money and time to come be the one doing all the work because real things happen behind bars and inmates will always tell you what you want to hear as long as they get what they want. Like others said, use the search bar to find more topics on others who went this route.

He has 3 years  left in side 2 years on work release and 2 on probation, he as only done 3 years so far, we have been together before he got locked up so I know it he is definitely not using me, I’m definitely doing it for my self also lol don’t worry I would not leave my family for someone who would just leave me lol and he is low risk there and we do have a sponsor. I will definitely look at the search bar, thank you for helping me

When I was looking at the form, it’s address so I was not sure if I should put the prison address or his moms lol but I’ve just looked it up and it says to put the prison address and yes he does have joint sponsor

I talked to a lawyer they said because it is not a serious crime and we have sponsor we will be ok but they wanted 9k to start of with to file everything, this lawyer said not impossible but it will be harder then a normal ir1, it was nearly 3 years after we got together when he got locked up, I’ve been over to see him and he was over in the uk for uni that’s how we met first met. We have been together 9 years. 

im going to look at the other topics like some other people been saying.

If it's not serious, you don't get 7 years of sentence... You have to see things from a bit more objective perspective.

 

$9k for such case is a very reasonable price. Regular cases can cost $5k to be filed by a lawyer.
