Applicant will be visiting USA at time of Immigrant Visa Interview

Hello,

My In-Laws hold a B-2 visit visa and were going to travel to USA in June. They just received notice today of their Immigrant Visa being scheduled in July in Pakistan. I believe I have the following 3 options? Have them return to Pakistan for the Interview, Reschedule Interview, or File for Adjustment of Status

Rescheduling the interview seems like the most practical, but when I go the website for Pakistan, it says you can only reschedule if you have missed your appointment?

My advice is to have them return for the scheduled interview - I would not give up that interview date for anything these days. Make attending that interview as scheduled the most important thing in the world right now. Good luck! :)

No, that is not an option.  They cannot enter the US as visitors with the intent to stay and adjust status.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Repeated for emphasis, AOS is not an option as they are not currently inside the US.  How would they answer the question of the CBP officer as to the purpose of their trip?

 

I would change the trip schedule and attend the interview.

Another vote for them to delay travel until immigrant visa is issued.

Another vote for staying in home country and going to IR 5 interview 

 

and understand that if they cancelled to come on tourist visa,  CBP can see the IR5 petition and  cancel the B2 on the spot as the current petition show immigrant intent 

chances are they can be sent back on the next plane
