Hey everyone,

 

I need help trying to understand the process seeking asylum using the CBP one app to schedule appointments and the Global entry travel program.

 

My sister in law is in Tijuana waiting for her appointment to seek asylum in the USA. She uses the CBP One app everyday to request an appointment. 

 

I reas that she can also participate in the Global Entry Travel program where she is able to use the express line instead of waiting long wait times in the general line.

 

The Global Entry program you can also schedule appointments but I'm not sure if the appointment she can also claim asylum or she needs to wait for the appointment through the CBP one app. She has a little girl traveling with her and I want her to wait the less time as possible for security and safety reasons.

 

Can she get Global entry and get an appointment to seek asylum using the global entry application or she needs to wait for the her appointment using the cbp one app?

How does she qualify?

Yes she qualify for asylum. She has proof of being persecuted because her daughter is a USA citizen and they are both being targeted and extorted by criminals in her neighborhood. They been asking her for money and been receiving death threats.

Has she considered moving?

 

To be eligible for asylum in the United States, a person must first meet the definition of a refugee as established in the Immigration and Naturalization Act. This means that they have a fear of persecution due to their race, religion, nationality, political opinion, or their inclusion in a particular social group.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I believe her global entry application would be via her own country, right?  The United States does not administer that for noncitizens/nonresidenrs.

Don't think that is a valid asylum qualifier.  She can move to another neighborhood.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

A quick Google said "No" she can't apply for asylum via her Global Entry application but that was Google AI and I cannot find anything definite. However she can certainly apply for Global Entry if she fulfills the requirements whether she is paroled into the US or continues to live in her home country. The issue would be that the location of the GE enrollment centers for interview are in US territory, Canada and Qatar.

Mexicans were able to travel to Canada visa free but I think that ended at the end of Feb,

Thats incorrect. I found out that she is more likely to qualify for asylum under "membership in a particular social group" due to her relationship with her U.S. citizen daughter.

 

True, the "nationality" category in the context of asylum generally refers to persecution based on belonging to a specific nation or national group, not simply by having a relationship with a citizen of another country.

 

The concept of "membership in a particular social group" is used in asylum cases to cover specific situations where persecution is related to belonging to a group that shares a common characteristic that is recognizable and particular. In this case, being the parent of a U.S. citizen can be considered as membership in a particular social group.

 

She just has to say,

 

 

"Officer, I am seeking asylum because my family and I have faced severe persecution due to my daughter's U.S. citizenship. In my country, being the parent of a U.S. citizen places us in a socially distinct group that is targeted by criminal elements who believe we have access to wealth or U.S. government protection.

 

We have received numerous threats explicitly stating that harm will come to us unless we pay extortion fees, which we cannot afford. These threats are directed at us solely because my daughter is a U.S. citizen, which makes us a target."

 Why is US asylum the only remedy?  Moving to a new location would solve the issue.

The number of United States citizens traveling to Mexico amounted to 33.54 million in 2022. I assume it is more now.

 

I have been to Mexico quite a few times, I know people who retired and decided to move to Mexico primarily because their money goes a lot further. People who spend the winter there, people who have second homes etc etc.

 

If it was just being a victim of crime or a potential victim then I doubt there is anyone on this site who would not qualify.

 

I assume the Daughter is also a Mexican Citizen, the only real reference to her is that she can sponsor her if she is over 21.

1. Where is this family member from? Mexico? 

2. Having a USC child isn't a basis for asylum. I'm sure many Mexicans have USC children and live peaceful in Mexico.

 

 

Are they from Mexico?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

She tried to. From Guadalajara to Colima. Her family lives in Colima. But the criminals did their research and they have her license plates. They know where her family lives, parents, siblings, as they were threatened too if she doesnt do what she is told. If she moves away snd they find her, her family is at risk. She is a preschool teacher, so anywhere she works, they will find her. As she was told they know where they live and how to find her.

@VictoriaS208 asylum would have had some level credebility if the family was bullied by Mexico government or government was unable to provide protection from bad guys. If the family moved few times to different parts of Mexico, was still a target, despite efforts and they had proof of government doing nothing - that would make it somewhat qualifying. What you're describing currently is a not an asylum case that would have success.
