I’m not sure if this is the right place to ask but I would like some help in getting some information as it relates to what I can do.

 

I filed a vawa application like 19 months ago, with the application i filed adjustment of status, advance parole and Employment authorization. It has been 19 months, my lawyers had filed an expedition request which they denied because they said I didn’t meet the requirements. 
 

I was married to a us citizen that cancelled my i485 application this my reason for filing this application. I have been waiting 19 months for an Employment authorization.

 

i got a notice on December 26 that uscis received my i765 application and they are currently reviewing it. They did also notify me that they will be using my old biometrics. 
 

what can I do to get some answers about my Employment documents???

Merely canceling I-485 is not a basis to file VAWA. Did you actually meet the criteria for VAWA? 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

I should think I qualify. I received 2 prima facie one 12 months the 2nd 6 months

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

All you can do is wait.  VAWA cases can take a long time to adjudicate.  No one can predict if your ex-wife's withdrawal of your adjustment of status I-485 and generally being difficult will be enough evidence.  Most successful VAWA cases are based on physical violence backed up with strong documentation to prove it.  There have been a few on the VAWA threads that were approved based on emotional abuse, but not many.  Be ready with a plan B if you are denied and have to go back to your home country.  They may also ask for additional evidence of the abuse, so be ready to send more if you need it.  I assume that your attorney filed a strong VAWA package and hope that you will get approval soon.  Good luck!

Ok tell me actually you want me to say that would help you help me. I didn’t just filed the application because my i485 was pulled, and even that is a form of abuse just so you know. I have substantial evidence of everything that I went though and then some.

The highlighted is what we are asking. Tell us exactly what happened/ what you have.

 

As someone else said, pulling out a petition isn't abuse. Is it written on the VAWA criteria/ qualifications? I'm 100% sure NO.

 

From how it's going, it looks like you don't have a case. I stand corrected.

Yes it’s c09. I don’t see what the vawa application has to do with the process time of my i765. I’m sure if by now if there was an issue I probably would get an RFE but I got 2 of already. It’s still going in the right direction.

Carmel I have may more evidence than just a pulled application, but you know I’m not just gonna come on here and put my whole life story for people to see, talk and criticize. I’m going through such much as it is already living the life of someone in my case. It’s not easy to write out everything in words what I’m doing with my application either.

Withdrawing sponsorship is not a form of abuse in and of itself.
