rfe deadline passed

hi.. i need urgent advice on a very serious issue.. we received the dreaded RFE with the stated deadline.. we filled the appropriate response 15 days before the stated deadline but due to some delievery issues it got delayed and did not reach the office on time. it clearly shows on the uscis account that the deadline has passed and we have not received any evidence.   what should be the course of action now.. i have filled a case with the courier services as to why they delayed but the damage has been done.. what should be the course of action now... how can i explain this sitatuion to the uscis

If it hasn't been delivered, the immediately re-send another response.  However, you could still face a denial for failure to respond to an RFE.  You might send them proof of mailing on time.

it waa technical error from my couriers company side.. everything was send timely but the package was somehow not received... would the uscis entertain this valid excuse ??

there in update on my official uscis account.. how should i proceed with this matter.. plus there was a technical issue from the uscis side as well.. they failed to include the cover sheet in the rfe letter which resulted in the delay.. who should i contact now at uscis in this regard

Has your response to the RFE been delivered to USCIS yet?

At USCIS stage it is up to USC to give evidence and prove the relationship

the RFE would have been sent to USC via email

Per other post USCIS wanted to see things like boarding passes,  photos to show her trip / she would have  had these

you are the bene and at this point its up to USC to show the marriage and reltaionship are bona fida

You could have emailed items to her  as copies are ok at the USCIS part

Evidence. At the time of filing, you must submit all evidence and supporting documentation listed in the General Requirements section of these Instructions. USCIS may issue a Notice of Intent to Deny (NOID) or a Denial Notice for petitions filed without the required supporting evidence.

She should have had the proof needed and sent from her US address and it would have been received on time

When was the deadline?  Does your carrier show it was delivered?

Did you send the response with tracking? Does the courier info/tracking number show that it was delivered?

deadline was march 18 but we have concrete evidence that the response package was indeed in the courier system 10 days before the said deadline and would have been delievered on time

deadline was march 18 but we have concrete evidences to prove that the repsonse was indeed in the courrierr system 10 days before the said deadline and would have been delieviered on time had it not been for the gross negligance..

additionally there was a huge mistake from the uscis side.. there was no coversheet attached with the rfe which resulted in unnecessary delays...how can i bring this up with the right people

no i dont know where the package is... it is lost in the system.. how should i proceed with this
