Fingers crossed. There's an old saying in Dutch, Nee heb je, ja kun je krijgen - You have no but yes you can get - essentially nothing gained if you don't try. I think that the best bet would be the Bureau of Consular Affairs.  However, when you write to them, it can take around 2 weeks because of standard screening for harmful substances, then 2 to 4 weeks for an answer.  This applies to regular postal mail, FedEx, etc.  Maybe your Congressman's immigration liaison has a way to intercede faster.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Well we don't have anything to rely on...My husband's passport will become ineligible in 3 months and we are stuck in SE Asia because the trip here was pretty expensive for an interview which we were rejected from before it even took place and our case is in limbo now. Unless a miracle happens idek what we can rely on or even what to plan. Where to go next. Now a new law came out in his country that you can't renew a passport abroad but if he goes home he'll be arrested for missing mandatory army service. I have no ideas tbh and don't even know where we can go to after his tourist visa in Vietnam ends.

The problem is that there is no way to contact them other than snail mail (see contus Us page). Otherwise, they send you straight to the NVC and we all know how useless that is.

I still think there is a very strong case here to fly to the US and have him be admitted under humanitarian parole. You only have 3 months before his passport expires, call CBP and see if they can arrange it. The situation is beyond your control, both his country's laws and the US Embassy and DoS have created barriers.

I have only come across CBP reviewing HP at the Border. If they could do it in other cases what would be the point of USCIS having a procedure?

 

I am not sure I believe the 90 day review time.

 

U4U which is pretty automated and used to take a few days now seems to take 90.

Seems to be the case. I emailed Rep. Jayapal and got a response with 20 minutes from a real person who said that Ms. Jayapal cannot help in my case because I am not in her district. It's a Congressional ethics thing....but they were nice about it and even looked up the Rep who I should contact. I  had made it clear in my email that I thought the situation should be solved at a higher level than simply a case-by-case basis, but that is obviously above an intern's pay grade.

I missed that she is not your Congressperson. That was a quick response.

I wrote to Patty Murray yesterday thorugh her contact form and haven't heard back yet. My request to her was general in nature because I was hoping for a solution that would be helpful to everyone who is in this situation. Now I realize that the system just isn't set up like that.

I was mistaken, for some reason I thought it said you could contact them in advance. It appears the option is just show up at the border as you said. Edited my post so as not to confuse. Either that or apply in advance via USCIS.

 

Not an easy feat for a Belarusian passport. Apparently they require visas to Mexico even. Definitely one of the harder cases I've seen here. Even Russians can get to Mexico without a visa.

Yeah our last option which my husband is now considering is going home and asking for leniency. In best case scenario he'll go to jail for a few months and then he'll have to serve in the army for a year...but that's the optimistic scenario and if all goes our way. I guess we still have a few months to try and figure something out. 

 

Right now I'll wait until the Embassies we contacted reply. Hopefully that'll be soon, if they reject us, I'll try to contact the congressman again, and start the form for humanitarian parole.
