Identify theft and fraud

So the last time I came on here I was trying to get a divorce but I'm still waiting on texas to grant me one. But I'm reaching out because my soon to be ex husband is determined to turn my life upside down. He's broken into my house several times stoles my clothes, shoes, and other items. He cost me over 8,000 in repairs and the cops tell me there's nothing they can do but take a report. I just recently learned he has my social security number and driver's license information and had used it to open phone accounts and etc. They have him on camera committed theses acts and employee has come forward and the cops are telling me there's nothing they can do because we're still married.

If any one has any suggestions it would be great. I'm receiving no help from him w my child and he's determined to ruin me. He's caused me severe depression not to mention, anxiety and ptsd. It's like the cops want folks to take matters in there own hands at this point.

Restraining Order? Best discussed with your Divorce Lawyer.

Could also be State specific, which State do you live in?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

still waiting on texas

Texas can take forever.  There also isn't a simple divorce certificate (like a marriage or birth certificate), but instead a divorce "letter" -- usually unavailable through the state Bureau of Vital Statistics.

Regarding the theft and new accounts, consult your lawyer as a priority.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I would highly advise freezing your SSN and consult your lawyer.  That is identity theft and fraud.  Also lock your accounts with your bank.  Many credit cards and accounts can have access turned on and off through your banking app.  If you don't already, have all transactions on any cards you own text you when they happen and definitely monitor Credit Karma to see if things pop up on your account.

Sorry you're stuck dealing with all this garbage!

I cannot believe the police aren't doing anything when there is proof. That is just nuts. Definitely talk to your lawyer.

I assume this is part of the VAWA case

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Freeze your credit with all three bureaus (Experian, Equifax, & TransUnion). This is good practice for anyone because it helps prevent identity theft in general, but it's especially important in your situation.

I think from your past thread you are the USC correct?

Your husband has his 10 year GC correct?

VAWA is a process that men and women can file to get their first GC, if they were abused. It doesn't apply to your husband as he already has his 10 yr GC.

I'm so sorry he tricked you into thinking this was a forever marriage and you planned a family with him. It sucks and hurts more then we can imagine and I feel terrible for you. Big hugs.

At this point get all the information you have to your lawyer. See if the lawyer can file charges for identity theft. I don't know why the police are not stepping in when you have proof he stole your identity or when he broke into your house. Seems ridiculous to me, and that is why you need to talk to your lawyer. He will know the right steps.  He should also prepare something for you to send to the Fraud Department at USCIS. Once they have that information then it will be in their hands.
