I filled for I-130 and I didn't know that I was to also fill for my children too.

Hello everyone, I filled for 1-130 in November 2021 and I was DQ at NVC in January 2023 waiting for the interview date. I didn't know that I was to also fill for my children too at the same time. Well, I have filled theirs 3 months ago. My question is that, Are they going to delay my interview date to meet up with my children or they are going to call us for interview separately? It's been 4 months now that they sent me an email to await for my interview date but haven't heard anything. Meanwhile my children's case is still in progress. What do I have to do please.

Is Petitioner a US Citizen or a Green card holder? Who is the petitioner? You? Hole old are the children? Is the petitioner the biological parent.

What embassy is interview? No NVC will not hold up your interview waiting for children's petition.

u  , the poster ,  are the beneficary

the USC is the petitioner /sponsor

 

reasons people ask if he is LPR or USC

USC have to do I 130 for each child

an LRP can do 1 for spouse and children are derivatives of spouse visa

 

The queue for Nigeria is long so u can send email to NVC (state all case #'s including yours ,  all names and all DOB"s)  asking NVC to hold your interview till the kids catch up

My husband is the petitioner and he is a US Citizen. The children are 6, 9 and 10 years old. The petitioner is step dad. I haven't been given the interview date. Thank you so much.

In this case, your husband has to submit and I-130 for each child.  Therefore, 4 total I-130s (one for you and 3 for your children).

 

Your husband can request USCIS  expedites for the 3 I-130s, explaining the situation.  It may or may not be granted, but he definitely should try.  He should reference your I-130 receipt number.

 

You may also want to delay your interview.  You or your husband can contact NVC to wait for your children's cases and process them together.
