So Im in a complicated situation right now. I came to Colombia last month ( for a surgery ) and while I was here I received the notification that my 10 years GC was approved ( my ROC was pending when I left the US in MAY )...my new green card is in my house in America

I cant travel right now coz Im recovering from the surgery but am I  be allowed to fly to the US, next month, with the documents I have right now ? ( I have a expired GC + valid 48 months extension letter....and I also have a I-751 Stamp on my passport valid until DEC 2023 ).

 

So I think its not gonna be a problem board the flight,  however what should I expect from CBP?

 

- Are they only let me enter the country with those documents?

- Should I ask my partner to bring the new green card to the airport ?

- what are the chances the give me a big FINE? 

- What worse can happens?

Legally they must. LPRs have a right to enter the U.S.

If your partner is your spouse and understands the severe negative consequences of losing your gc, yes.

An I-193 fee can be assessed. It think the odds are under 50 percent.

CBP should be able to see that the date the new GC was issued was while you were out of the country. Worst case scenario i think would be a detour to secondary on arrival .. and you get to  explain as you have done in your post

thats a $585 fee, what if I don't have money to pay? I get arrested? Can I pay later? do

You are fine!  You didn't have the new card when you left (it wasn't sent) so you won't be expected to have it when you enter.   You have the necessary documents to enter.  You may go to secondary so they can look at the paper trail.  If you have a copy of the boarding pass for when you left the US it would be good to take as backup.  You won't be arrested and won't get into trouble.

 

Recover and rest, come back feeling better.

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

That is up to CBP:

Worst case: detention until you are bonded out. Your petitioner and joint sponsor should have the money. 

 

These are worst case scenarios that are unlikely to occur, as I have noted.

Do you mean that you have an I-551 stamp on your passport?  If so, that I-551 stamp is equivalent to your plastic GC for all legal purposes, including travel, until its expiry date in Dec 2023.

yes, I have the stamp that I got when my 24 months extension letter was about to expire!

 

So I have the stamp valid until DEC 2023 + Extension letter valid until OCT 2024
