Can I attend my AOS interview without my spouse if he is active duty in another state?

Hello, I have my AOS interview scheduled. It just happens to be scheduled during a time that my husband cannot take any leave as he’s in training and he would get behind in training. He’s stationed in Florida and I’m in Ohio. I would rather my husband go with me, but my lawyer said that we could try and see if we could attend without him as it’s at the officer’s discretion. Is there anything I should take other than my husband’s orders and phase manual which state that he cannot take leave once in training?

I cannot think of any other documents needed.  Hopefully the IO is understanding and allows you to interview on your own.

when my friend attend her n-400 ( 3 year marriage) interview, her husband is in korea for active duty. she brought the order, but the person who checked her in in jacksonville,FL refused to let her in. after back and forth exchange, the same person asked other staff to handle the situation, the IO actually came out and let her in. the IO was a military and one time has been stationed in korea so he gets it. she actually got on the spot oath ceremony that day. good luck

Here is what the Policy Manual has to say (item #2):

 

USCIS may waive the personal appearance of the military spouse petitioner; however, the adjustment applicant must appear for an interview. USCIS makes every effort to reschedule these cases so that both the petitioner and adjustment applicant can attend the interview before deployment. The adjustment applicant may choose to proceed while the petitioner is abroad.

 

You may want to try and go to the interview. It's at the officer's discretion

Get a letter from his command describing the situation and not just a manual print out. Admin can take care of it.

 

I did my adjustment interview alone but my husband was deployed and not just TDY so that's different.
