Hello everyone, I have a friend who came legally on a tourist visa and then applied to some protected status under Trump's administration for Venezuelans. She met a citizen and they just got married. She also has a minor daughter from a previous relationship back in her country.

In this scenario will her husband need to file form I-130 for her and the minor, or they can just jump directly to form I-485 ?

Also if they can just jump directly to form I-485 will they need to file a separte form for her minor daughter? Or can the minor be included in her I-485 ?

So they are both in the US?

 

How old was the minor when they married

I think Boiler is stating that they need to join here and ask their own questions.  I know you're being a good friend and trying to help (and bless you for that), but they need to be advocates for their immigration journey and we can best help him directly.

No offense taken, this forum was crucial when i petitioned my wife on a fiancee visa.  still not clear with Boiler's answer " separate petitions, adjust away"  Did he mean two I-485 or two I-130 

Still appreciate the effort to help.

Sounds like the minor child is still in Venezuela or some other country, so for the mother, I130- and I485 package, for the child, I130.

 

I agree, they should also join VJ.

OK, your OP seemed to indicate the child was not here.  In that case, I130 for both, and I485 for both.
