130 Pending while in US on Tourist Visa

Timeline

My friend's mother came NY to visit while on Tourist visa. Her daughter applied for 130 permanent residence. She is in the US for like 16 months now while the application is pending. She need to see a surgery done, please what type of options she has for insurance coverage? also, can she leave the US, and come back when the application is approved? Thanks

What was filed?  Was an I-485 package filed?

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yea, I believe so since the applicant is physically present in the US

Her sponsor (the person who signed the I-864) is responsible for providing for her insurance and medical needs.

This is the very reason we don't apply for adil's mother

i have posted on this before

any insurance u try to buy will be expensive for a foreigner

and there are 2 illnesses very prevalient in Moroc

Diabetes and TB

the disbetes medicine costs us $600 a month when Toria visited (this is not covered under a heath plan so understand that if she has surgery the post opt medicine could be expensive )

when adil's mom returned in August she needed emergency surgery for appenditis/  this could have taken a big chunk out of our savings but only costs us $1000 in Moroc

 

IS she able to return to Moroc?

Has your friend talked to the dr in US about the fee?

she will not be eligible for medicaid but many hospitals have social worker who can answer questions like this better than we can

 

if your friend is able to find a policy,  they better also look into one for senior care living later on as that is "out of sight expense wise"

insurance - well, what insurance is the mother on now? That’s what will answer the question. I assume she is on insuranc as it would be extremely reckless to have a parent living here uninsured.

If they filed i485, does the mom have AP? If yes, she can leave and come back. If no, she can leave but will have to complete the visa process abroad. (Is the i130 approved yet)

if no i485 filed, mom has been here without authorized stay and would incur a ten year ban when she leaves. 

Thank you for that! She is on no insurance, while I assume I-131 AP is not filed it yet! do you recommend any insurance coverage for a elderly women in that situation?

So far, no she is not able to return until she probably files for I-131. she need a minor back surgery in the meanwhile, and we will see her options while I take all said into consideration. Thank you so much

no back surgery is minor

 

i asked if she could leave as some injuries or illnesses don't allow travel 

i know she can' not go till she receives AP 

Did they file all ?  the  I 485,  I 131 (to travel(,  her medial exam from immigration dr (form I 693)'

Your friend should have done all this research 16 months ago. State of residence, income etc all matter, she needs personalized advice. There may be an exclusion on what can be done in the first few months on a new policy. don’t expect to be able to get insurance and get immediate cover for surgery for a pre-existing condition.

This is the most important advice. If the surgery she needs is urgent your friend are in trouble and make his mother lives here without insurance is crazy. 
 

This kind of surgery is not simple and is really expensive even with insurance and like SusieQqq said, get a insurance that will cover this kind of mayor surgery in such a short time will be hard to find.

 

I hope he is prepare financially to deal with this.

It seems even minor back surgery (whatever that really means for someone in that age bracket) can cost $20k-$50k. I somehow suspect a trip back home for surgery and completing the visa via consular processing is on the cards. ( I may be off base here, but if someone can afford those kind of costs out of pocket I suspect that they would have been paying health insurance already. Because it’s either cost or sheer recklessness that leads to someone having an elderly parent uninsured here.)

yea, surgeries here ain't no joke. even if it is a cyst removal, it s still a lot of money that we are talking about. Thank you
