I will be applying for AOS for my mom (Ukrainian/Russian citizenship) and another one for my wife (Australian citizenship) pretty much at the same time. Is there a danger/risk associated with the fact that I'm sponsoring  two AOS beneficiaries? Does it make sense to delay one over another? And if there is, what would be the preferred state of one of them before starting another?

do i include one of them on the I-864 filed for the other person? as part of my household? part 5 item 5 asks for other dependents. does one under AOS process count as a dependent on I-864 for another?

Nope. Each I-864 is independent. That is, don't count the other (mom) on another's (wife) I-864 and vice-versa.

That is quite the loop hole.  So someone earning $25,000 a year can file a 100 I-864s and get away with it?

No. 

 

If I remember correctly, this particular question on I-864 is in past tense. It asks "if you have sponsored." Being that you haven't sent/ USCIS hasn't received any of the files you are currently want to petition, you haven't actually sponsored anyone yet.

it's the section about current household:

 

Part 5. Sponsor's Household Size

5. If you have any other dependents, enter the number here.

 

you're referring to item 6:

 

6. If you have any other dependents, enter the number here. If you have sponsored any other persons on Form I-864 or Form I-864EZ who are now lawful permanent residents, enter the number here.

This is straight forward. Do you have anyone under your care who depend on your income? Children? Elderly parents? Siblings?

 

The number above is important because you will then use it to check how much you need to make under the USCIS poverty guidelines so as to sponsor.

well, i do. my mom who is about to get her AOS started. does my I-864 that i'm filing for my wife need to know about it?

Question is...are you gonna ship BOTH out at SAME time/day/ envelope? YES or NO?

This is at odds with your come by then. If one is sponsoring   100 people, then best case, when the first I-864 is signed the count is 2, and when the second is signed the count should be 3, and so on until the 100th I-864, and the count is 101.

My argument here was: if they haven't been filed, then no petition has been made...I'll defer to others

Thats the way the I864 is handled for consular processing …… but the beneficiaries are  not living with the sponsor in that case ..There is no sponsorship  until they activate the visa. 

 

So… when you do adjustment of status they are living with them if household members  .. so for adj of status are they then  included in the household size but not in the “other people you have sponsored”? 
My head hurts Mr Gumby !

I agree completely.

 

Now, what happens if you're starting 2 people at AOS? These 2 people never went through consular processing.
